Washington Wins the Case Against Wells Fargo “I have the best
news for the Wells Fargo Victims: Their motion for summary judgment
was thrown out with the judge indicating Wells Fargo could not be a
holder in due course because they did not pay value for the lease -
in fact, they appeared to be nothing but a collector for unnamed note
holders. “Despite this setback,
Wells Fargo is continuing its scorched earth litigation against
defrauded lessees. I will provide

written about leases assigned to Terminal Marketing of New York ( no
longer in business ) who never paid the vendor, and often the broker,
but sold the lease to Wells Fargo.
Often, Terminal Marketing was making the monthly payments until
they went out business. As long as they
were adding more leases, the discounted transaction created money to
make the payments. When the
leasing world turned around, those companies who were playing this game,
got caught as the income was not enough to continue
to make the payments plus pay for current transactions, including broker
fees. It was Wells Fargo's position, according to
the attorney's involved, that those who referred the lease were financially
responsible, even though they never received any remuneration or were
involved in the scheme. Their "hell
and high water" claim, especially in the State of New York, made
the referrer of the lease as responsible as the funder of the lease. In California, Dale Washington is defending some of those who are
claimed "responsible" for the financial liability and here
he explains the defense he is taking against Wells Fargo, who he also
believes is guilty of not doing

Equipment Fund Raising Equity" ABS Net Lease Equity Appreciation
Fund II, under the guidance of LEAF Asset Management, has filed with
the Securities and Exchange Commission to sell some of its limited partnership
interests to raise up to $60 million for equipment leasing. With the
sale proceeds, Lease Equity plans to purchase equipment for leasing
and to acquire existing equipment portfolios from other lessors. The
fund says that about 67 percent of its acquisitions could be financed
through securitizations, and says it plans to focus on medical, industrial,
and climate control equipment. LEAF has assembled a team of principles
and executives with equipment leasing experience to run the fund once
it enters the asset-backed securities market. LEAF Vice President of
Finance and Treasurer Matthew Goldenberg, who joined the company last
October, previously was the director of structured finance at DVI Financial
Services. Crit DeMent and Miles Herman, previously of Fidelity Leasing,

Commission announced Gary G.
Johnson, 50, of Peoria, who agreed to pay a $12,500 penalty and return
$164,000 in commissions that he earned from selling unregistered long-term
promissory notes issued by CapitalPro Asset Management Fund, a California-based
company dealing in equipment leasing. Johnson, who the
commission said has been cooperative, could not be reached. Leasing
News could find not other information on Capitalpro. The company should
not be confused with Capital Pros Network. It was reported that
Capitalpro filed bankruptcy in California, but this could not be confirmed.

Regulators Invite Further Comments ABSnet (aimed also at SBA Loan-Bank agreements) U.S. regulators have
added a month to the comment period for a proposal that could make banks
accountable for the actions of third-party lenders whose credits they
securitize. Market players now
have until July 19 to submit comments on the "sound practices guidelines"
formulated by the SEC and four bank regulatory agencies. Some industry
players hope to use the extra month to raise awareness of the proposal,
which has been largely overshadowed by other regulatory issues. The new guidelines
are meant to guarantee that banks who securitize other companies' loans
through term transactions and commercial-paper conduits - as well as
those who participate in credit derivatives - make sure that those lenders
follow ethical business practices. Issuers that fully adhere to the
guidelines would be shielded from any liability. Banks are worried
that the proposal could force them to adopt costly procedures to ensure
that they won't be held responsible for the actions of unscrupulous
clients. At the same time, many are suffering from a case of "regulatory
overload," said Richard Schetman, a partner at Cadwalader Wickersham.
"The banks know this is out there and know they should be concerned,
but they only have so many resources they can devote" to sparring
with regulators, he said. Industry participants
pointed out several problems with the proposal in letters submitted
to the SEC before the original June 18 deadline. Some complained that
the rules aren't clear on what banks would have to do to demonstrate
their awareness of other lenders' practices. In some cases, the rules
would require issuers to demand proprietary information from clients,
said Gwen Ritter, senior accounting advisor at the American Bankers
Association. It's also unclear
which transactions would be exempt from the rules. In addition, there's
some fear that the proposed guidelines call for more than a sound judgment
call on an issuer's part. Because the SEC expects issuers to police
the knowledge and intentions of loan originators, banks could actually
face more - rather than less - legal liability and potential damage
to their reputations, the British Bankers Association wrote. The association
also maintains that the proposal conflicts with European Commission
rules applying to European companies that sell bonds in the U.S., and
should be drafted in cooperation with regulators abroad. Deloitte & Touche,
meanwhile, said the proposal doesn't define when issuers should seek
legal and accounting help. Issuers may be willing
to pay small sums to ensure that their collateral information matches
up with the data supplied by loan originators, Cadwalader's Schetman
said. But some could also decide that the proposal adds too much legal
risk, prompting them to seek other funding options. "The rules
almost make you a guarantor" of the counterparty or lender participating
in a transaction, he said. The "Interagency
Statement on Sound Practices Concerning Complex Structured Finance Activities"
was issued in May by the SEC, the Comptroller of the Currency, the Federal
Reserve Board, the Federal Deposit Insurance Corp. and the Office of
Thrift Supervision. The agencies delayed
the comment deadline at the request of the American Banker's Association,
the Bond Market Association, the International Swaps and Derivatives

Vehicle Lease Volume Down Another 20% in 2003 NASHVILLE, Tenn.,
/ -- The Association of Consumer Vehicle Lessors announced that member
leasing companies reported a total reduction in new leases from 2.0
million in 2002 to 1.6 million in 2003.
This 19.8% volume decline shows the continued effect of high
cash rebates and interest rate subsidies, combined with longer loan
terms. These manufacturer programs
have created attractively low monthly loan payments and induced some
consumers to finance rather than lease their new vehicles.
Since the peak of leasing in 1999, leasing volume has fallen
more than 50% from 3.4 million new leases to 1.6 million new leases
in 2003. The 2003 decline
hit ACVL captives a little harder than banks:
captive total leases were down 20.5% while bank leases were down
16.3%. The decline was much more dramatic for large lessors than smaller
ones: large lessor lease volume dropped 21.5% compared
to 6.0% for medium lessors. For
both the bank and captive lessors, the volume of the larger members
declined more than smaller ones such that the average (unweighted) volume
decline was 14.9% for captives and 6.4% for banks. "There were
a number of factors contributing to lower lease volumes," explained
Rob Mize, ACVL President, "including the expansion of the 0% retail
installment programs and other similar manufacturer installment sale
promotions, continued declines in residual values (causing higher monthly
lease payments making leasing less competitive compared to financing),
and fewer manufacturer subvented lease programs. However, those trends
appear to be abating in 2004 so lease volume may climb this year." ACVL members also
reported that their end-of-term residual losses decreased somewhat in
2003. Residual losses declined to $2,909 in 2003
from a weighted average of $3,269 in 2002, an 11% decrease. While the declining residual loss level was
a welcome development for lessors, consumers who had leased their vehicles
continued to reap substantial benefit by having lessors absorb these
used car market losses. While
it appears that residual losses will fall dramatically during 2004 and
over the following years, leasing still protects consumers from unexpected
declines in trade-in values. Consumers have come to appreciate the protection
that leasing affords them from excess depreciation. The ACVL survey highlights
a number of areas in which bank and captive vehicle leasing programs
differ. For example, the average lease term of bank lessors was 51.4
months in 2003, compared to 38.6 months for captive lessors. This is
the largest difference in the 11 years for which lease data has been
compiled by the association. Additionally, on an unweighted basis, more
than 20% of new bank leases were longer than 60 months. "Now more than
ever, it's important that consumers be informed about the benefits and
responsibilities of leasing before they decide whether to lease or buy,"
said Mize. "The ACVL web

rights group recognized for organizing massive voter registration drives

I remember this day very well, the start of my teenager years,
when the first “Rock and Roll” song to hit Number 1 in the pop charts
was “ Rock Around the Clock.,” The recording artists were Bill Haley
and the Comets, one of the first all-white acts to play “Rock and Roll.”
It was the title song to the movie, “Blackboard Jungle.” Haley
was originally a country and western singer, who my father hired in
Chester, Pennsylvania in 1948 to sing “rock-a-billy” to a radio station
when he was the general manager. Haley
