ELFF Monthly Confidence Fell in August
to 66.6 from 72.9 in July

The Equipment Leasing & Finance Foundation (the Foundation) releases the August 2021 Monthly Confidence Index for the Equipment Finance Industry (MCI-EFI) today. The index reports a qualitative assessment of both the prevailing business conditions and expectations for the future as reported by key executives from the $900 billion equipment finance sector. Overall, confidence in the equipment finance market is 66.6, a decrease from the July index of 72.9.

NMLS Transition and PACE Program Administrators,
California Financing Law Now Effective October 1, 2021
Effective October 1, 2021, new regulations under the California Financing Law become operative. In general, the regulations provide as follows:
- All new license applications under the California Financing Law must be submitted through NMLS on and after October 1, 2021.
- All licensees not yet on NMLS must transition onto NMLS by December 31, 2021.
- PACE program administrators must comply with new regulatory provisions.

Types of Fraud

Methods of lease fraud are constantly evolving. Individuals perpetrating these frauds have studied our industry's practices and methods. Many of these frauds involve Vendors and Lessees who meet most of the screening criteria utilized by leasing companies - directory assistance listing, time in business, and physical storefronts. Lease Police, Inc. has identified the following general types of lease fraud:
Disguised Working Capital Fraud - In this scenario, a vendor presents himself as a legitimate seller of equipment; however, he is nothing other than someone soliciting for working capital loans. He will take a customer's current equipment and disguise it as his equipment and lease it back to the customer (the lessee). The vendor will keep 30% to 50% of the lease proceeds and will give the remainder to the lessee. This type of fraud can be very damaging and hard to detect, as many of the re-liquefied lessees will make payments for a while after funding. Most funders will experience a default rate between 10% to 40% with these transactions. Many of these vendors will "spread their paper" among several sources to further conceal their detection. Overpriced Equipment Working Capital Fraud - A vendor will overprice a piece of equipment and offer the debtor or lessee money back. For example, a vendor will lease a $5,000 computer for $30,000 and give the debtor or lessee $15,000 as an inducement to enter into the lease. This type of fraud will have higher loss rates over the portfolio life, but because the debtor/lessee has just received a "lump sum" from the vendor, they will make payments for a while. Using LeasePolice.com, detecting these vendors is easy - just take note of excessive early termination activity.
Product Representation Fraud - In this scenario, the vendor may offer a deal that is "too good to be true." It may involve a 100% money back guarantee, inflated promises on the equipment, or a "promise and disappear" scheme. These vendors appear to be tremendous engines of new leases. They can produce hundreds of new leases per month from the beginning of their existence. In most of these cases, the vendor is gone after one to two years, leaving funders an endless stream of litigation. "Broken Up" Transaction Fraud - This type of fraud includes activity by Vendors and Debtors/Lessees who break up a larger deal into smaller pieces to avoid financial disclosure (without disclosing their other requests to the lenders). In most cases, those involved are aware of the application-only limits and apply for a large number of smaller transactions due to poor financial information. Imagine a $350,000 deal that is achieved by "splitting the transaction into five $70,000 transactions with five different funders. Some of these deals are further disguised by applying for corporation-only signatures - with no credit bureaus reports reviewed. In many cases, the debtor/lessee is already in distress and they fold under the higher debt levels. Past Due Account "Layoff" Fraud - This is one of the oldest and least reported types of fraud in the industry. A Vendor has an internal delinquent open account with a customer. They usually threaten the customer to either pay the past due balance or they will pick up the equipment. As an option, they offer the past due customer the option to convert their account into a lease. By converting the delinquent customer into a lease, they get paid by the equipment leasing company and the leasing company gets an almost instantaneous delinquency. Many of these deals show up as first payment defaults. All participants are legitimate companies and fraud is almost never suspected! General Misrepresentations by Vendors and Lessees - This general category includes activities such as submitting altered financial statements, hiding prior bankruptcies, hiding ownership, false references, misrepresenting used equipment as new, falsifying actual date of sale or delivery, equipment being sent to other locations without disclosure, concealing large judgments or liens, and leasing the same collateral twice. SEC Charges Floridian, 2 Companies in
$70 Million Merchant Cash Advance Ponzi Scheme

The Securities and Exchange Commission (SEC) has filed an emergency action and obtained a temporary restraining order, an asset freeze, and the appointment of a receiver to stop an alleged Ponzi scheme and misappropriation of investor proceeds perpetrated by Coral Springs, Florida resident Johanna M. Garcia and two entities she controls.
According to the SEC’s complaint, filed in federal court in the Southern District of Florida, over the past year Garcia and her companies raised at least $70 million from more than 2,150 investors in a fraudulent securities offering. The complaint alleges Garcia, and companies MJ Capital Funding LLC and MJ Taxes and More Inc. told investors that offering proceeds would be used to fund merchant cash advances to small businesses and promised investors annual returns of 120-180 per cent.
The reality was quite different. Garcia and her companies only made, at most, $2.9 million in loans and earned little revenue. Instead, the defendants allegedly used at least $20 million of new money to pay purported returns to existing investors in a classic Ponzi scheme fashion. The complaint alleges the defendants misused another $27.4 million of investor money by making payments to various other entities, a substantial portion of which represented payments to sales agents for promoting these investments.

Eric I. Bustillo, Director of the SEC’s Miami Regional Office, commented, “As alleged in our complaint, Garcia and her companies lured unsuspecting investors with false claims and promises of triple-digit annual returns,” said. “We continue to caution investors to be wary of any investment that promises returns that are too good to be true.”
The SEC’s complaint, filed on Aug. 9, 2021, and unsealed last week, charges the defendants with violating the antifraud and registration provisions of the federal securities laws. In addition to the emergency relief, the complaint seeks preliminary and permanent injunctions; disgorgement, prejudgment interest, and a civil penalty from each of the defendants; and an officer and director bar against Garcia. The court set a hearing for Aug. 25 to determine if a preliminary injunction should be entered and whether the asset freeze should remain in force for the duration of the litigation.

Chipotle Turns to Plant Based for Chorizo Recipe

Chipotle Mexican Grill Inc. (NYSE: CMG) said it has begun testing plant-based chorizo in some of its restaurants.
The Newport Beach chain has tapped locations in Denver and Indianapolis to begin the latest menu item test. The last time the company released a plant-based option was seven years ago with its Sofritas.
The company will now listen to customer feedback and make changes accordingly in a phase it calls its stage-gate process.
The company since 2019 has added five menu items, including its quesadilla and carne asada.
Chipotle is OC’s second largest restaurant operator with more than 2,850 restaurants and a workforce of over 100,000.
The company was trading up about 1% in midday trading Thursday to $1,868.29 with a market cap of $52.5 billion.

Retail and food services sales in the United States declined by 1.1 percent in July, dropping to $617.7 billion on a seasonally adjusted basis. That’s according to advance estimates published by the U.S. Census Bureau on Tuesday.
While it’s easy to chalk the slowdown up to the resurgence in COVID-19 cases, the reasons for the setback are in fact manifold, starting with an ongoing global chip shortage constraining supply in several industries, particularly the automobile sector. Sales of motor vehicle and parts dealers declined by more than $5 billion in July, accounting for 74 percent of the overall decline in retail and food services sales. Another big driver of the decline was a drop in nonstore (i.e. online) sales, which was largely caused by inflated June sales due to Amazon’s Prime Day. In fact, excluding motor vehicle and nonstore sales, retail sales grew ever so slightly in July, thanks in no small part to the ongoing rebound of restaurants across the country.

Ashes and Diamonds (Andrzej Wajda, 1958): A pinnacle of the burgeoning Polish cinema of the 1950s, director Andrzej Wajda’s stylish and intense drama bleeds a nation’s struggle into that of a man. Said man is Maciek (charismatic and doomed Zbigniew Cybulski, often dubbed “the Polish James Dean”), a young Polish resistance fighter during the last days of World War II. Tasked with killing a Russian soldier, he finds himself questioning his goals and his morality. What follows is a grim tour of ruins and hideouts, where betrayal, disillusionment, and death are never far off. Filmed with fierce, often baroque style, the movie plays like a political lesson in the skin of an atmospheric thriller, given an extra electrifying jolt by Cybulski’s iconic presence. Flowers of Shanghai (Hou Hsiao-hsien, 1998): Beauty and cruelty blur beguilingly in Taiwanese director Hou Hsiao-hsien’s masterful look at 19th-century Shanghai. Taking place in high-class brothels nicknamed “flower houses,” the story charts the crisscrossing destinies of four men and the courtesans they visit. At the center is Master Wang (Tony Leung Chiu-wai), a well-off, quiet man torn between two women—Crimson (Michiko Hada), who turns down his marriage proposal, and the younger Jasmin (Vicky Wei), who becomes his bride. Stunningly filmed using the burnished light of old lamps, the movie contemplates an insular world of rituals and transactions and betrayals. Making sumptuous use of décor, gestures, color, and movement, Hou offers a delicate, sympathetic look at the people snared in a system of refined exploitation. With subtitles.

Pariah (Dee Rees, 2011): Talented director Dee Rees (“Mudbound”) made a promising feature debut with this striking, poignant drama. An autobiographical portrait, it focuses on Alike (luminously played by Adepero Oduye), a Brooklyn teenager exploring her identity as an African-American lesbian. Though her parents (Charles Parnell, Kim Wayans) are scarcely supportive, Alike finds help with her friend Laura (Pernell Walker) and with Bina (Aasha Davis), a “good girl” who’s surprisingly open to experimentation. As her relationships become complicated, however, she discovers that heartbreak is never far from joyous romance. Exploring people and situations rarely touched upon by big-budget releases, Rees’ soulful indie is sensitively attuned to the heroine’s emotional highs and lows. Mixing mood and humor, the film is at once modesty specific and vibrantly universal.

La Piscine (Jacques Deray, 1969): Sixties icons of cool and sexiness, Alain Delon and Romy Schneider star in this moody, underrated psychological thriller, which would be later remade as “A Bigger Splash.” Delon and Schneider star as Jean-Paul and Marianne, a vacationing couple whose stay at a sun-dappled villa grows complicated by an unexpected visit by Harry (Maurice Ronet). An old friend who’s also a former boyfriend of Marianne’s, Harry arrives with his teenage daughter Penelope (Jane Birkin). Tensions promptly rise as resentment grows between the men, leading to a death. What follows is a police inquiry that will change the characters’ lives forever. Visions of Eight (Multiple directors, 1973): Just as the Tokyo Olympic Games wind down, check out this unique documentary about the Munich Olympics, composed of short films from eight distinguished filmmakers. Among them is Mai Zetterling’s “The Strongest,” which sees the weight-lifting team as a group of sinewy titans, and “Bonnie and Clyde” director Arthur Penn’s “The Highest,” which filters pole-vaulters through an abstract prism. Kon Ichikawa’s “The Fastest” analyzes the 100-meter dash, Milos Forman injects some whimsy into “The Decathlon,” while John Schlesinger’s “The Longest” acknowledges the terrorist attack that shook the events. In sharp contrast to the athletes’ victories, Claude Lelouch’s “The Losers” considers the weight of defeat. Splintering the games into shards of personal expression, the film is an absorbing, imaginative collage.

1494 - Columbus returned to Hispaniola. He had confirmed that Jamaica was an island and failed to find a mainland.
1619 - The first Black slaves brought by the Dutch to the colony of Jamestown. The colonists desperately needed workers for the tobacco crop. Europe was becoming “addicted” to snuff and smoking tobacco in a pipe, inhaling. The Indians had introduced the colonies to tobacco, who were learning to grow and dry it. Europe was “mad” for the smoke and snuff for gentlemen. John Rolfe writes in his diary, “About the last of August came in a Dutch man of warre that sold us twenty negars.” By the time of the American Revolution, the English importers alone had brought some 3,000,000 captive Africans to the Americas. After the war, as slave labor was not a crucial element of the Northern economy, most Northern states passed legislation to abolish slavery. However, in the South, the invention of the cotton gin in 1793 sharply increased the need for slave labor, and tension arose between the North and the South as the slave or free status of new states was debated. In 1807, with a self-sustaining population of over four million slaves in the South, some Southern congressmen joined with the North in voting to abolish the African slave trade effective 01 January 1808. Nevertheless, the widespread trade of slaves within the South was not prohibited, and illegal trade of African slaves to Brazil and Cuba continued until the 1860s. By 1865, over twelve million Africans had been shipped across the Atlantic Ocean to the Americas, and some one million of these individuals had died from mistreatment during the voyage. In addition, an estimated three million died in Africa in slave wars and forced marches directly resulting from the Western Hemisphere's demand for African slaves.

1704 - The first underground sewer in Boston was constructed by Francis Thrasher, at his own expense. The move led to municipal regulations governing disposal of refuse and garbage. By 1710, the selectmen of Boston were giving licenses to private citizens for digging up streets for sewer construction. Now you may not think this is a big deal, but think how waste was removed in this time, most often just thrown raw into the streets.
1741 - Danish navigator Vitus Jonas Bering, commissioned by Peter the Great of Russia to find land connecting Asia and North America, discovers Alaska as well as the Pacific Coast of America.
1788 - A small but powerful hurricane inflicted great havoc upon forests along a narrow track from New Jersey to Maine. A similar storm track today would cause extreme disaster in the now populated area.

1833 - Benjamin Harrison (d. 1901), the 23rd president of the US, born at North Bend, Ohio. He was the grandson of William Henry Harrison, 9th president of the US. 1867 - Anson Mills, brevet lieutenant colonel in the Army, Fort Bridger, UT, was granted a patent for a new cartridge belt. Moisture had previously affected cartridge belts. Mills invented a woven cartridge belt, and the machinery for making it, which was adopted by both the army and Navy.

1910 - The big blow up of forest fires finally came to an end in Idaho. A record dry August fueled 1736 fires which burned three million acres destroying six billion board feet of timber. The fires claimed the lives of 85 persons, 78 of which were fire fighters, and consumed the entire town of Wallace. The smoke spread a third of the way around the world producing some dark days in the U.S. and Canada. The forest fires prompted federal fire protection laws.
1911 - “This message sent around the world,” sent at 7pm from the New York Times and received back at 7:16:30pm, traveling over 28,613 miles via 16 relay stations to become the first telegraph message sent around the world. It was the front page headline and quite an event for its era.
1912 - After the Japanese beetle invaded the East Coast and other diseases were affecting agriculture, Congress passed a quarantine law for plants, directed against dangerous plant diseases and injurious insect pests “new to or not theretofore widely prevalent or distributed within and through the United States.” Plants that could transmit white-pin, blister rust or potato wart, and plants that might harbor the Mediterranean fruit fly, were immediately affected. Other species before the turn of the century had been affected, such as the “mighty American chestnut oak” that dominated the Northeast was basically extinct by this date.

1920 - The first radio station to be licensed was 8MK, owned by the Detroit News, which began later instituted daily service with the program, “ Tonight’s Dinner.” The call letters were changed later to WWJ.
1921 - Birthday of Jacqueline Susann (d. 1974), Philadelphia. Her novel, “Valley of the Dolls” (1966, and the movie in 1967), became the world's most popular, best-selling novel to that time and remains the top selling novel even today. It sold more than 17 million copies. Her other novels were also made into movies and were best sellers. She died at the peak of her success at 53.
1924 - Birthday of Jim Reeves (d. 1964), country music star, born at Galloway, Panola County, TX. The single-engine plane in which he was traveling crashed in a dense fog. Reeve’s biggest hit was “He’ll Have to Go.” (1959) and he was inducted into the Country Music Hall of Fame in 1967.

1942 - Birthday of Isaac Hayes (d. 2008), Covington, TN. Singer, songwriter, actor, and producer. He has been one of the creative forces behind Stax Records, where he served both as an in-house songwriter and as a session musician and record producer, teaming with his partner David Porter during the mid-1960s. They were inducted into the Songwriters Hall of Fame in 2005 in recognition of writing scores of songs for themselves, the duo Sam and Dave, Carla Thomas, and others. In 2002, Hayes was inducted into the Rock and Roll Hall of Fame. “Soul Man,” written by Hayes and Porter and first performed by Sam and Dave, was recognized as one of the most influential songs of the past 50 years by the Grammy Hall of Fame. It was also honored by The Rock and Roll Hall of Fame, by Rolling Stone magazine, and by the RIAA as one of the Songs of the Century. In addition to his work in popular music, he worked as a composer of musical scores for motion pictures. Hayes was known for his musical score for the film “Shaft” (1971). For the “Theme from Shaft,” he was awarded the Academy Award for Best Original Song in 1972. He became the third black person to win an Oscar in any competitive field covered by the Academy. He also won two Grammy Awards for that same year. Rank and organization: Sergeant, U.S. Army, Company E, 359th Infantry, 90th Infantry Division. Place and date: Near Chambois, France, 20 August 1944. Entered service at: Bremerton, Wash. Birth: San Francisco, Calif. G.O. No.: 55, 13 July 1945. Citation: He manned a light machinegun on 20 August 1944, near Chambois, France, a key point in the encirclement which created the False Pocket. During an enemy counterattack, his position was menaced by a strong force of tanks and infantry. His fire forced the infantry to withdraw, but an artillery shell knocked out his gun and wounded him in the right thigh. Securing a bazooka, he and another man stalked the tanks and forced them to retire to a wooded section. In the lull which followed, Sgt. Hawk reorganized 2 machinegun squads and, in the face of intense enemy fire, directed the assembly of 1 workable weapon from 2 damaged guns. When another enemy assault developed, he was forced to pull back from the pressure of spearheading armor. Two of our tank destroyers were brought up. Their shots were ineffective because of the terrain until Sgt. Hawk, despite his wound, boldly climbed to an exposed position on a knoll where, unmoved by fusillades from the enemy, he became a human aiming stake for the destroyers. Realizing that his shouted fire directions could not be heard above the noise of battle, he ran back to the destroyers through a concentration of bullets and shrapnel to correct the range. He returned to his exposed position, repeating this performance until 2 of the tanks were knocked out and a third driven off. Still at great risk, he continued to direct the destroyers' fire into the Germans' wooded position until the enemy came out and surrendered. Sgt. Hawk's fearless initiative and heroic conduct, even while suffering from a painful wound, was in large measure responsible for crushing 2 desperate attempts of the enemy to escape from the False Picket and for taking more than 500 prisoners.

1949 - Birthday of American composer Leonard Lehrman, born Ft. Riley, KS. Lehrman has composed 238 works to date, including 12 operas and 7 musicals. Entered service at: Holland, Mich. Born: 25 June 1942, Holland, Mich. Citation: For conspicuous gallantry and intrepidity in action at the risk of his life above and beyond the call of duty. S/Sgt. (then Sgt.) Lambers distinguished himself in action while serving with the 3d platoon, Company A. The unit had established a night defensive position astride a suspected enemy infiltration route, when it was attacked by an estimated Viet Cong battalion. During the initial enemy onslaught, the platoon leader fell seriously wounded and S/Sgt. Lambers assumed command of the platoon. Disregarding the intense enemy fire, S/Sgt. Lambers left his covered position, secured the platoon radio and moved to the command post to direct the defense. When his radio became inoperative due to enemy action, S/Sgt. Lambers crossed the fire swept position to secure the 90mm recoilless rifle crew's radio in order to re-establish communications. Upon discovering that the 90mm recoilless rifle was not functioning, S/Sgt. Lambers assisted in the repair of the weapon and directed canister fire at point-blank range against the attacking enemy who had breached the defensive wire of the position. When the weapon was knocked out by enemy fire, he single-handedly repulsed a penetration of the position by detonating claymore mines and throwing grenades into the midst of the attackers, killing 4 more of the Viet Cong with well-aimed hand grenades. S/Sgt. Lambers maintained command of the platoon elements by moving from position to position under the hail of enemy fire, providing assistance where the assault was the heaviest and by his outstanding example inspiring his men to the utmost efforts of courage. He displayed great skill and valor throughout the 5-hour battle by personally directing artillery and helicopter fire, placing them at times within 5 meters of the defensive position. He repeatedly exposed himself to hostile fire at great risk to his own life in order to redistribute ammunition and to care for seriously wounded comrades and to move them to sheltered positions. S/Sgt. Lambers' superb leadership, professional skill and magnificent courage saved the lives of his comrades, resulted in the virtual annihilation of a vastly superior enemy force and were largely instrumental in thwarting an enemy offensive against Tay Ninh City. His gallantry at the risk of his life is in keeping with the highest traditions of the military service and reflects great credit upon himself, his unit, and the U.S. Army.

1989 - About 20,000 people ended a week-long 20th anniversary celebration of the Woodstock Festival at the festival's original site near Bethel, New York. 1996 - Just ten days after Microsoft shipped its first Web browser, Netscape released a letter they had sent to the Justice Department earlier in the month alleging that Microsoft had sought to gain an unfair advantage by offering computer makers and Internet service providers improper payments and other incentives to use Internet Explorer instead of Netscape Navigator. Microsoft denied the allegations, but the question of Microsoft's tactics in promoting Internet Explorer came under heavy scrutiny in the Justice Department's 1998 antitrust suit against Microsoft.

1998 - At Shea Stadium, Cardinal first baseman Mark McGwire becomes the first player in Major League history to hit 50 home runs in three consecutive seasons. Mac's seventh inning solo shot helps to defeat the Mets, 2-0.
2000 - Tiger Woods won the 82nd PGA Championship in Louisville, Kentucky. Woods birdied the last two holes in regulation and won the championship in a playoff over Bob May, becoming the first player since Ben Hogan in 1953 to win three majors (Masters, U.S. Open, British Open) in one year. He was the first player to win back-to-back PGA championships since Denny Shute in 1936 and 1937.
2000 - The winningest pitcher in franchise history is honored by the Yankees during Whitey Ford Day ceremonies at Yankee Stadium. The crafty lefty holds the team record for victories (236), innings pitched (3,170 1/3), strikeouts (1,956) and shutouts (45). Ford set numerous World Series pitching records, including consecutive scoreless innings (33 2⁄3), wins (10), games started (22), innings pitched (146), and strikeouts (94). The Yankees retired his uniform number 16 in 1974 and dedicated a plaque in his honor in Monument Park in 1987. Ford was elected to the Baseball Hall of Fame in 1974.
2002 - A judge issues a temporary restraining order preventing the sale of Barry Bonds' 600th career home run ball hit into the Pacific Bell Park stands on August 9.
