Leasing and Financing of Robots Excelling
for US Warehouses and Fulfillment Center

According to Sara Lebow, emarketer, "Nearly 40% of medium to large US warehouse and fulfillment center operators (with more than $10 million in annual revenues) will deploy robots in one or more of their locations by the end of 2021, up from 28% two years ago. In 2023, over 44% of these operators will call on robots, as usage of the automated workers climbs."

The Complaint Process for Leasing and Finance Associations
AACFB, CLFP, ELFA, NEFA

The Leasing and Finance Associations have procedures to consider complaints about its members, often to resolve an issue or take other action.  

Here are synopses along with a copy of the full procedure.

CODE OF ETHICS AND COMPLAINT PROCEDURES
Enforcement Provisions
A Member may be censured, suspended or expelled from the Association for violating the Code of Ethics (“Code”) of the Association, set forth in Appendix 1 herein. Accordingly, the disciplinary actions that the Association may take in the event of a violation of the Code include:
1. private censure;
2. public censure;
3. probationary membership with such conditions as may be determined by the Association;
4. suspension of membership for a term and on such conditions as may be determined by the Association;
5. expulsion from membership; and
6. non-renewal of the membership of the Member.
This Code is most effective when Members ensure that their own practices and actions conform to the standards set forth in the Code. In those instances where a party alleges that a Member has violated the Code, the initial complaint, whether in writing or verbal, is to be directed to the Association General Counsel. The General Counsel will initially attempt to address the matter by acting as a facilitator to open lines of communication between the parties in an effort to have the parties resolve the situation without commencing an inquiry under the formal complaint procedures. If the complaining party determines that these initial steps do not resolve the issue to the satisfaction of the complaining party, then the complaining party may avail itself of the formal complaint procedures set forth in Appendix 2 herein. The validity of the complaint will then be determined by the Association Ethics Committee (the "Committee"). The Committee will consist of five (5) members of the Association, who are appointed by the President of the Association. The President of the Association shall also designate one member of the Committee as Chairman of the Committee. If a matter or dispute between the parties to the Complaint is involved in arbitration or

litigation at the time of the filing of the Complaint, then a party is prohibited from availing itself of the initial complaint procedure to the General Counsel or the formal complaint procedure set forth on Appendix 2. If arbitration or litigation is commenced subsequent to the Complaint being filed, then the pending Complaint procedure will be suspended. In those situations where a Complaint cannot be filed due to pending arbitration or litigation, or a Complaint is suspended due to subsequent arbitration or litigation, the Complaint process may commence or be reinstated, as applicable, upon action by the Complainant when the arbitration or litigation is concluded, including any applicable appeals.

Appendix 1: Association Code of Ethics
As broker members, funding source members, associate members and honorary members of the AACFB, we ascribe to the following Code and pledge ourselves to the word and principal of this Code:
1. We will demonstrate honesty, professionalism and integrity in all our relationships and business dealings with customers, fellow members, the public, equipment vendors, licensed professionals, other brokers, and our funding sources. We will at all times adhere to two golden rules: First, treat other business professionals as we would like them to deal with us and, second, always conduct our business dealings so as to reflect a positive image upon our profession and the AACFB.
2. We will be mindful of our obligations with respect to funds remitted by customers. Specifically, we acknowledge that in order for funds remitted by customers to be earned, we must provide goods, services or value to the customer in exchange for those funds.
3. We will communicate as soon as it becomes known to us all information germane to our funding sources where such facts may impact a funding source’s credit evaluation of a proposed customer. We acknowledge that as brokers, we are responsible for sharing all information known to us regarding all aspects of a proposed transaction with our funding sources.
4. We will never knowingly make false statements to anyone. Under no circumstances will we perpetuate, encourage or disregard fraudulent or inherently dishonest activity by any person in connection with a business transaction.
5. When we are asked for legal, accounting, tax or any other similar professional advice, we will always qualify our advice to the individual with whom we are speaking to ask the same question of a duly licensed and qualified professional.
6. We shall cooperate with our funding sources on all issues reasonably required by a funding source for completion of a transaction, including but not limited to all issues of documentation as a funding source shall require.
7. We will deal with our funders in a manner which respects the value of their time and financial commitment. We will use our best efforts to submit proper and complete applications in accordance with the requirements of a funding source.
8. Funding source members agree that they will not circumvent the broker in any transaction in which a broker refers a transaction which would otherwise entitle the broker to a commission.

9. We will strive to enhance our professional education and keep ourselves informed of new developments in our industry.
10. The use of the terms "American Association of Commercial Finance Brokers", "AACFB" and the AACFB "Logo" shall be used only by members in good standing on their letterhead and business cards in accordance with rules promulgated by the AACFB Board of Directors from time to time. In the event that any member becomes aware of the use of the aforesaid by a non-member, then such member shall immediately bring the usage by the non-member to the attention of the Board of Directors for further action.
All members of the American Association of Commercial Finance Brokers agree to abide by and submit to the arbitration dispute resolution program administered by the AACFB and in effect as necessary.

Appendix 2: Association Code of Ethics Formal Complaint Procedures
This Appendix 2 provides a procedure for administering formal complaints by a "Complainant" (as herein defined) that a Member has violated the Code.
Complaints will be reviewed by the Association Ethics Committee (the "Committee"), the composition of which is described above.
The following provisions set forth the procedures to be followed in proceedings involving alleged violations of the Code.
1. A proceeding alleging that an Association Member violated the Code may be initiated by a Member of Association (other than any Association Member who has a representative on the Committee), by the Executive Committee of the Association or by a non-member of Association which has suffered injury as a participant in an equipment lease or finance transaction with a Member ("Complainant"). The proceeding shall be initiated by filing a written complaint (the "Complaint") with General Counsel at Association Headquarters. The Complaint must identify the section(s) and standard(s) of the Code alleged to be violated, set forth in detail the facts claimed to support the charges of Code violation, and include documents in the possession of the Complainant which are pertinent to the Complaint. In addition, the Complainant may submit affidavits from the Complainant and others in support of the Complaint.
2. Any complaint against an Association Member who is or has a representative on the Committee shall be sent directly to the Board, which will then follow the procedural guidelines below in determining whether an ethics violation has transpired and the appropriate action, if any.
3. Copies of the Complaint and supporting documents, if any, shall be sent by General Counsel to the members of the Committee. If the Committee deems the Complaint to be insufficient, it may request the Complainant to provide more information, documents or affidavits in support of the Complaint. General Counsel will ensure that the Complainant has a copy of the Code including these Formal Complaint Procedures.
4. At any time during the formal complaint process, the Committee may consult with specific resources within the Association such as legal, asset management, accounting, etc., which the Committee deems necessary based on the nature of the Complaint. The Committee will maintain a formal written record of all findings and proceedings of the Committee involving the Complaint.

6. If the Committee determines by majority vote that the Complaint and supporting documents, on their face, do not satisfy the requirements of Paragraph 1 or do not state facts constituting a violation of the Code, the Complainant shall be so notified by the Chairman of the Committee, and no further action shall be taken.
7. If the Committee determines by majority vote that the Complaint and supporting documents meet the requirements of Paragraph 1 and allege facts which, if true, could constitute a Code violation, the Chairman of the Committee shall request that General Counsel send a copy of the Complaint and supporting documents to the party complained against (the "Respondent"). General Counsel shall also provide the Respondent with a copy of the Code.
8. The Respondent shall be afforded an opportunity to answer the Complaint (the "Answer"). The Respondent's Answer shall respond to the specific allegations contained in the Complaint. The Answer shall also notify the Committee whether or not the Respondent requests a hearing on the allegations in the Complaint and provide the Committee with documents or affidavits from Respondent or others supporting the Answer. The Answer, supporting documents and affidavits shall be sent to General Counsel within 30 days of Respondent's receipt of the Complaint.
9. General Counsel shall promptly forward the Answer and supporting documents to the Committee and to the Complainant, and shall notify Complainant of the right to request, within 30 days of receipt of the Respondent's Answer, a hearing on the Complaint before the Committee.
10. Irrespective of whether either or both of the parties request a hearing on the Complaint, the Committee shall have the authority by majority vote to dismiss the Complaint if it determines, based upon the submissions made, that it is clear there is no violation of the Code. Should the Committee dismiss the Complaint, the parties shall be notified and no further action on the Complaint shall be taken.
11. In the event the Complaint is not dismissed, and a party has requested a hearing or the Committee determines a hearing is necessary, then the Committee shall notify Complainant and Respondent of the date, time and location of the hearing and their right to be represented by counsel at the hearing. During the hearing, the parties shall be afforded a reasonable opportunity to present evidence, cross-examine witnesses and be heard on matters alleged in the Complaint and Answer. The Committee may also permit others to testify at the hearing.

12. The Committee shall vote on whether or not the Respondent has violated the Code based upon the record, and, if so, what disciplinary action, if any, should be taken against the Respondent as a consequence of such violation. A majority vote of the Committee members is required to censure, suspend, not renew the membership of, or expel a Respondent.
13. The Committee's decision must be in writing and shall be sent to the Respondent and Complainant. The Committee shall notify the Respondent of the right to appeal an adverse decision within 30 days of receipt of the decision. The Respondent's appeal, if any, shall be sent to General Counsel and shall set forth the reasons why the Committee's decision should be set aside. General Counsel shall promptly forward the Respondent's appeal, if any, to the Complainant. If the Respondent does not timely appeal the Committee's decision, the decision shall be final and binding upon Respondent.
14. If the Respondent elects to appeal the Committee's decision, then the matter shall be transmitted for a hearing on the existing record before the Association Board of Directors (the "Board"). The Board shall notify the parties of the date, time and location of the hearing, and the schedule for filing written submissions with the Board. The Respondent and the Complainant may be represented by counsel and shall be permitted to provide written submissions and present oral argument to the Board. No additional documents may be filed, or any testimony taken, unless ordered or requested by the Board. The Board shall vote on whether the Committee's decision should be affirmed, modified or reversed. A decision by the Board which censures, suspends, or expels the Respondent, or which decides not to renew Respondent’s membership, must be by two- thirds vote of the members present and voting. No member of the Committee, and no Director that is a representative of an Association member that initiated the Complaint or is the Respondent, may be present during, or participate in, the voting.

The CLFP Foundation complaint procedure is very similar to the National Association of Equipment Leasing Brokers. It may be due to the involvement of Joseph Bonano, CLFP, former legal counsel for the NAELB as well when he was active on the Board of Directors of the CLFP Foundation.

The party making the complaint cannot be in litigation on the matter for the Executive Director to renew the situation. The procedure requires a response from the party making the complaint, and if none, "the charges may be deemed admitted. (If a response is received), it is up to the Board of Directors to resolve the matter…if no response received within ten calendar days, the Respondent will be held to be in violations of the Standards.” If the matter remains unresolved between the parties after the Board considers both sides, “the Board has total discretion to take whatever action it deems appropriate. The action may include, but is not limited to, dismissal of the complaint, private censure, probation, public censure, suspension of the respondent's status as a CLFP in Good Standing or removal of CLFP in Good Standing status."

Reid Raykovich, CLFP, Executive Director informs Leasing News, "the Complaint Procedure will be revisited and possibly rewritten during our Board retreat in January."

 The Equipment Leasing and Finance Association states:
"Article VII(2) of the Bylaws provides that a Member may be censured, suspended or expelled from the Association for violating the Code of Fair Business Practices of the Association. Accordingly, the disciplinary actions that the Association may take in the event of a violation of the Code include:

  1. private censure;
  2. public censure;
  3. probationary membership with such conditions as may be determined by the Association;
  4. suspension of membership for a term and on such conditions as may be determined by the Association;
  5. expulsion from membership; and (f) non-renewal of the membership of the Member." 

The Complaint Procedure is specific that the complaint is sent by the President to Members of the Association Fair Business Practices Committee. If the committee may ask for more information, documents, or affidavits in support of the complaint. If the majority thinks it is valid, the Respondent is afford 30 days to reply, which is to go before the committee and person with the complaint.  If then not dismissed, a hearing may be requested by either party, which others may testify at the hearing.  A two-thirds vote of the committee members is required to censure, suspect or expel a respondent. The Respondent may appeal to the full Association Board of Directors, where it takes two-thirds votes to overturn. No member of the Committee, and no Director that is a representative of an Association member that initiated the Complaint or is the Respondent, may be present during, or participate in, the voting.

The National Equipment Finance Association has a Standards Committee which requires a filing fee of $250, unless the Complaint is made by the board, in which case there is no fee. A certified letter is required with return receipt requested.

There are stipulation as to the process and involvement of Committee members, but at this point the committee may dismiss or move forward. Perhaps the vote is by majority, as it appears the only necessary matter is a quorum must be at least five members present. If moved forward, a member is appointed as a "Facilitator," who may be able to resolve the matter, and should not, a hearing is the next step. "Every party has the right to present witnesses, pertinent evidence, and submit questions for the Committee to examine witnesses. There will be no cross examination; the Committee shall conduct all questioning of witnesses. Evidence shall be oral testimony, declarations, authenticated documents, or other papers verified to the Committee’s satisfaction. "

"The Complainant and Respondent(s) have the option to agree to have an authorized Complaint be resolved by a single decision maker, with this option operating as (specifically spelled out in the NEFA Bylaws).
"Any party to a case not satisfied with the Committee’s decision, may file a written appeal to the Board by filing same within sixty (60) days after the Committee’s decision is filed. A filing fee of $100 must accompany the appeal."

"At the hearing before the Board, the Committee Chairperson shall present a summary of the case. Each party shall be heard to correct the summary, if he/she wishes to do so. Each party may present to the Board his/her reasons why the Committee’s decision should be followed or not, but no new evidence shall be presented."

Cox Automotive Update: August Sales Pace
Forecast to be Year's Slowest

U.S. auto sales are projected to be markedly slower in August due to low supply, according to the latest Cox Automotive Forecast.

The seasonally adjusted annual rate (SAAR) of auto sales is expected to finish near 14.3 million, which is the slowest sales pace this year.

The August pace will be down from July’s 14.8 million pace. It is also down from August 2020’s 15.2 million level. The auto sales pace was averaging nearly 17.0 million a month through May.

Sales volume is expected to finish down 9% from last year and down nearly 7% from last month. This month’s finish would be the fourth consecutive monthly decline of 500,000 units or more since April’s post-pandemic peak pace of 18.3 million, according to the forecast.

“Available inventory on dealer lots has been falling for months and sales have been constrained further and further as a result,” said Cox Automotive Senior Economist Charlie Chesbrough. “And soon the market will enter the Labor Day holiday weekend, usually one of the highest sales periods of the entire year, but with half the supply they had last year.”

Other notes from the forecast include new light-vehicle sales in the U.S. are projected to fall to 1.20 million units. That's down 118,000 units, or 9%, from last year.

Additionally, the SAAR in August 2021 is estimated to be 14.3 million, down from last August’s early COVID-19 recovery pace of 15.2 million.

Compact cars are forecast to see a year-over-year increase in August, but still lower than 2019.

DLL CEO, William F. Stephenson
Announces Retirement

Eindhoven, Netherlands – DLL, a global provider of asset-based financial solutions, reported that CEO and Chairman of the Executive Board, William F. Stephenson will retire effective December 31, 2021. A search for his successor will begin immediately.

In his announcement to DLL’s global workforce, Stephenson noted his near term focus will be on, “Ensuring the company has a strong finish to the 2021 business year and is positioned for continued growth and success in 2022 and beyond.”  Additionally, he will play a role in finding his successor and ensuring a smooth transition for the new leader.

Stephenson has enjoyed a 35 year career with DLL and its predecessor companies.  From humble beginnings as a local District Sales Manager, his career has followed a trajectory of advancement and growth with roles in regional and national sales management and subsequently business line general management. In 2008, he was first appointed to the Executive Board of DLL as the Chief Commercial Officer for Vendor Finance, prior to ascending to the role of Global Head of Vendor Finance in 2011. He was subsequently appointed as CEO and Chairman of the Executive Board in 2014.  

During this time, Stephenson played an integral role in the emergence of DLL as a global market leader within the vendor finance and equipment leasing industry. Today, the company is active in nine industry sectors, with operations in more than 30 countries and a managed portfolio exceeding EUR 35 (USD 41) billion.   

DLL has been ranked as the number one vendor finance company in the USA for twelve straight years by the Monitordaily.com. DLL reports Strong Interim Results
Net Profit $359 Million US Dollars


Eindhoven, Netherlands - DLL, global provider of asset-based financial solutions, delivered a strong first half performance, highlighted by exceptional net profit growth.  The company recorded both portfolio and income growth during the first six months of the year, while risk costs improved significantly due to more favorable economic conditions.

The company’s portfolio balance increased by almost 2% over the prior year’s interim results and totaled EUR 36.0 (USD 42.7) billion. During this same period, new business volume was EUR 13.5 (USD 16.0) billion, representing 9.5% growth over the prior year, which was $. This strong commercial performance was realized despite product shortages in certain industry sectors beginning to impact equipment availability and potentially delaying the activation of lease and finance contracts.

The company recorded net profit of EUR 298 (USD 359) million in the first six months of 2021, an increase of 520% from the prior year which was $205 Million US. This result was positively impacted by a significant improvement in risk costs as economic conditions improved in many key markets.  The underlying financial performance of the portfolio continued to trend positively, with net income totaling EUR 751 (USD 905) million, which represented 4% growth over the prior year when adjusted for currency movements.

Due to improved macro-economic conditions in the first half of 2021, DLL was able to reverse previously booked loss provisions, which shifted total risk costs to a net positive result of EUR 58 million.  This exceptional result corresponds to minus 33 basis points of the average loan portfolio and is well below DLL's historical long term average of plus 52 basis points.

Sounder (Martin Ritt, 1972): Tyson received a Best Actress Oscar nomination for this poignant, Depression-set drama, which charts the ups and downs in the lives of a sharecropping Louisiana family. She stars as Rebecca Morgan, the matriarch of a clan that struggles to stay together in the face of poverty. When her husbandNathan (Paul Winfield, also Oscar-nominated) is arrested for stealing food, Rebecca must watch over their son David Lee (Kevin Hooks), who’s determined to find the family’s runaway dog, Sounder.While searching for the labor camp where his father was sent, David Lee stumbles upon a school for black students—education becomes the source for the boy’s hope and pride, and perhaps a means for escaping the family’s dire situation. Directed by conscientious veteran Martin Ritt, the film remains a heartening story.

The Autobiography of Miss Jane Pittman (John Korty, 1974): Tyson gives a magnificent performance in this powerful TV drama, for which she won a richly deserved Best Actress Emmy. As she eponymous protagonist, she portrays a woman’s tribulations from ages 20 to 110, from slavery to the Civil Rights movement in the 1960s. Telling her story to a journalist (Michael Murphy), Miss Jane Pittman remembers the cruelties of a time when she was considered property, when loved ones would inevitably meet horrible deaths at the plantation where she worked. A tough survivor, sherelates how her remarkable life experience has prepared her to finally speak her mind during the current era of necessary changes. Often performing under thick layers of old-age makeup, Tyson glows with intelligence and dignity.

Fried Green Tomatoes (Jon Avnet, 1991): A popular screen adaptation of Fannie Flagg’s novel, this folksy drama paints a portrait of female friendship across different generations. Evelyn (Kathy Bates) is a shy, unhappy housewife who grows fascinated by the stories told by Ninny (Jessica Tandy), a vibrant elderly woman she meets while visiting a nursing home. Among the tales is the bond between a pair of young women during the 1920s, Idgie (Mary Stuart Masterson) and Ruth (Mary-Louise Parker). While listening about their alternately lively and tragic escapades, Evelyn herself becomes more confident. Tyson appears in the supporting but pivotal role of Sipsey, a cook who helps Idgie and Ruth open their own café and helps them deal with Ruth’s abusive husband. A flavorful ride elevated by its splendid cast.

The Trip to Bountiful (Michael Wilson, 2014): This leisurely version of Horton Foote’s classic Broadway play gives Tyson one of her meatiest later turns. Reprising her Tony-award winning role, she stars as Carrie Watts, a widow living in rural Georgia with her busy son, Ludie (Blair Underwood), and his bossy wife, Jessie Mae (Vanessa Williams). Forbidden from traveling by her overprotective family, she yearns to travel to her hometown of Bountiful for one last visit. So she sneaks off to the bus station and hops a Greyhound without her son’s permission, along the way befriending a young woman named Thelma (Keke Palmer).Portraying a character previously made famous by such legendary actresses as Lillian Gish and Geraldine Page, Tyson brings her own personal mix of vitality and melancholy to the screen.

Last Flag Flying (Richard Linklater, 2017): Oscar-nominated director Richard Linklater (“Boyhood”) brings his own brand of intimate humanism to this semi-sequel to Hal Ashby’sbeloved 1970s classic “The Last Detail.” Catching up with that movie’s three characters decades later, the story follows the former military men on a thorny newjourney. Feisty, hard-drinking Sal (Bryan Cranston), hellraiser-turned-preacherMueller (Laurence Fishburne) and introvertedLarry (Steve Carrell) meet again to go on the harrowing mission of burying Larry’s son, a soldier killed in action. Meet Striker!! Striker was rescued by a Good Samaritan when his previous owners abandoned him. He is a very sweet dog who is crate trained and house broken. Outside noises make him very nervous (cars, motorcycles, etc.) so he would prefer to be an indoor dog, and be right by your side. When you take him out, even if you are in your yard, he needs to be on a leash because that is his security blanket. Striker would not do well with cats, other small animals, or young children. He would however love another dog as a pal, especially one that can handle a bit rougher play. Striker does have anxiety but is showing improvement since coming to the Orphanage. He would need a patient person to work with him and give him time to learn to trust. He is an amazing dog and will win you over if you give him the chance. Come fall in love!

     1633 - Irish Catholic Cecil Calvert, 27, sent two ships, the Ark and the Dove, from Ireland to establish a colony in America as a refuge for fellow Catholics. His work later earned Lord Calvert the nickname, "Colonizer of Maryland."
    1637 – Coincidentally, Charles Calvert, 3d Baron Baltimore, English politician, 2nd Proprietor of Maryland was born.  It is unknown if they were related.  Charles died in 1715.
    1650 - History records the first expedition, led by Englishman, who crossed the Allegheny Mountains at Fort Henry, at the falls of the Appomattox River, VA, and returned on September 4. The party consisted of Captain Abraham Wood and his servant, Henry Newcombe; Edward Bland, merchant, and his servant, Robert Farmer, Elias Pennant and Sackford Brewster, and two guides, Oyeocker, a Nottaway chief, and Pyancha, an Appamattuck war captain.
    1655 - Accomac, VA, was the site of the first play presented in the North American col­onies. The play was “Ye Bare and Ye Cubb,” by Phillip Alexander Bruce. Three local residents were arrested and fined for acting in the play. At the time, most colonies had laws prohibiting public performances; Virginia, however, had no such ordinance. The actors, Cornelius Watkinson, Philip Howard, and William Darby, were accused of sedition and were summoned to appear in court on November 16, 1665, “in those habiliments that they then acted in and give a draught of such verses or other speeches and passages which were then acted by them.“ They were found not guilty and Edward Martin, who had informed on them, was ordered, “to pay all the expenses of the presentment.”
    1655 - New Amsterdam and Peter Stuyvesant bar Jews from military service. The first Jew to settle in North America, Jacob Barsimson, arrived on Manhattan Island, first of 24 Jewish immigrants, in 1654. In September, three Jews fleeing the Spanish Inquisition in Brazil, arrived in New Amsterdam, and more followed. Their right to stay was upheld by the Dutch West India Company, against the wishes of Governor Peter Stuyvesant. They founded Congregation Shearith Israel, with Saul Brown as first rabbi.
    1776 - In the Battle of Long Island, NY, in what is now Brooklyn, American forces commanded by Gen. Israel Putnam and Gen. John Sullivan were defeated by the British under Gen. Sir William Howe and Gen. Sir Henry Clinton. Howe took Gen. Sullivan prisoner. On August 30, the Americans evacuated Long Island and crossed to Manhattan. The British recognized the strategic importance of New York as the focal point for communications between the northern and southern colonies. General George Washington also recognized this and, in April of 1776, he marched his troops from Boston to New York. He positioned his troops on the western end of Long Island in anticipation of the British arrival. When the British fleet arrived, they had 45,000 troops against Washington's 20,000. The British attacked, forcing Washington to cross the East River into Manhattan. Washington left 3,000 men to defend Fort Washington, then headed north.

    1805 - Sallie Chapman Gordon Law (d. 1894) birthday, Wilkes, NC.  She organized a 12-bed hospital in Memphis for Confederate soldiers and somehow managed to care for the wounded of the great Battle of Shiloh in 1862. When Memphis was taken by the Union forces, Law converted her assets into medicinal drugs which she smuggled into the South.
    1832 – The Black Hawk War ended when Chief Black Hawk of the Sauk nation surrenders to U.S. authorities.
    1849 - Austin College was chartered in Texas at Huntsville under Presbyterian sponsorship. In 1876, the school campus was moved to Sherman, TX.
    1859 - W.A. “Uncle Billy” Smith discovered oil in a shaft being sunk by Colonel E.L. Drake at Titusville, in western Pennsylva­nia. Drilling had reached 69 ft, 6 inches when Smith saw a dark film floating on the water below the derrick floor. Soon 20 bar­rels of crude were being pumped each day. The first oil was refined to make kerosene for lighting, replacing whale oil. Later, it was refined to make gasoline for cars. The first gas station opened in 1907.
    1862 - Confederate female spy Belle Boyd released from Old Capital Prison in Washington, DC
    1871 - Birthday of Theodore Dreiser (d. 1945), American novelist, at Terre Haute, IN. As part of the Chicago group, he was an exponent of American naturalism in literature. His first novel, “Sister Carrie,” (1900), was suppressed by his publisher on moral grounds.  Dreiser's finest achievement is widely considered to be his novel, “An American Tragedy“ (1925), a college requirement.   
    1872 - Mary Anderson (d. 1964) birthday, Lidkoping, Sweden.  Director of the Woman's Bureau of the U.S. Dept. of Labor for more than 20 years. Arrived in the U.S. at 16 not knowing a word of English, worked as a cook, stitched shoes in a factory for 18 years of ten-hour days, and with a fierce determination, educated herself in the evenings. She became active in her local of the International Boot and Shoe Union.
    1873 - American lawyer Horatio G. Spafford's four daughters drowned when their passenger ship, while crossing the Atlantic, collided with another and sank. The following month, as his own ship passed over the spot of the earlier tragedy, Spafford penned the words to the enduring hymn, "It is Well With My Soul."
    1877 - Birth of Lloyd C. Douglas, born Doya Douglas (d. 1951), Columbia City, IN.  American Lutheran clergyman and religious novelist. Douglas published his first best-seller, "Magnificent Obsession," in 1929, followed later by "The Robe" (1942) and "The Big Fisherman" (1948).

    1879 - Birthday of African-American publisher Robert Lee Van (d. 1940), Ahoskie, NC.  He was the publisher and editor of the Pittsburgh Courier from 1910 until his death.  The Courier under Vann prominently featured Vann's work as a lawyer and public figure. As editor, Vann wrote editorials encouraging readers to only patronize business that paid for advertisements in the Courier and ran contests to attempt to increase circulation.  In his Christmas editorial at the end of 1914, Vann wrote of the paper's intent to "abolish every vestige of Jim Crowism” in Pittsburgh.
    1893 - The first of three great hurricanes that year struck South Carolina, drowning more than 1000 persons in a tidal surge at Charleston.
    1900 - U.S. Army physician James Carroll allowed an infected mosquito to feed on him in an attempt to isolate the means of transmission of yellow fever. Carroll developed a severe case of yellow fever, helping his colleague, Army pathologist Walter Reed, prove that mosquitoes transmit this often-deadly disease.

    1916 – Birthday of actress/comedian Martha Raye, born Margey Reed (d. 1994) in Butte, MT.  She was honored in 1969 with an Academy Award as the Jean Hersholt Humanitarian Award recipient for her volunteer efforts and services to the troops.  During World War II, the Korean War and the Vietnam War, she travelled extensively to entertain American troops despite her lifelong fear of flying.  She was a star of the 1930s and 1940s and enjoyed a revival in television in the 1970s. 
    1918 – Battle of Ambos Nogales.  US Army, stationed at Nogales, AZ, against Mexican Carrancistas and their German advisors, stationed at Nogales, Mexico in the only battle of World War I fought on American soil.
    1918 – Christy Mathewson resigned as Reds manager to accept a commission as a captain in the chemical warfare branch of the Army.  During this service, he was accidentally exposed to chemical weapons during training. His respiratory system was weakened from the exposure, causing him to contract tuberculosis, from which he died in 1925.   
    1921 - J.E. Clair, who owned the Acme Packing Company, bought a pro football franchise for Green Bay, WI. He wanted to pay tribute to those who packed the meat at his processing plant, thus, the Green Bay Packers. (Note, they are usually not referred to as “Green Bay

    1937 – Singer Tommy Sands, Frank Sinatra’s first son-in-law, was born in Chicago, his kind of town.  His biggest hit was called "Teen-Age Crush" went over big with the young audience and went to No.2 on the Billboard Hot 100 and No. 1 on the Cashbox chart.   This led to a film contract that produced mostly forgettable movies.  In 1960, Sands married Nancy Sinatra, from whom he was divorced in 1965. His career had declined significantly by 1965, triggering speculation that Frank had him "blacklisted" in the entertainment industry after their divorce.  Such reports were denied by both Sands and Sinatra.

    1947 - Dan Bankhead becomes the Major Leagues’ first black pitcher. He doesn't do well in a relief stint, giving up ten hits and six runs in three and third innings in a 16-3 loss to the Pirates, but the Dodger rookie hits a home run in his first Major League at-bat.

Rank and organization: First Lieutenant, U.S. Army, Battery A, 15th Field Artillery Battalion, 2d Infantry Division. Place and date: Near Kobangsan-ni, Korea, 27 August 1951. Entered service at: Danbury, Conn. Birth: Philadelphia, Pa. G.O. No.: 16, 1 February 1952. Citation: 1st. Lt. Hartell, a member of Battery A, distinguished himself by conspicuous gallantry and intrepidity at the risk of his life above and beyond the call of duty in action against an armed enemy of the United Nations. During the darkness of early morning, the enemy launched a ruthless attack against friendly positions on a rugged mountainous ridge. 1st Lt. Hartell, attached to Company B, 9th Infantry Regiment, as forward observer, quickly moved his radio to an exposed vantage on the ridge line to adjust defensive fires. Realizing the tactical advantage of illuminating the area of approach, he called for flares and then directed crippling fire into the onrushing assailants. At this juncture a large force of hostile troops swarmed up the slope in banzai charge and came within 10 yards of 1st Lt. Hartell's position. 1st Lt. Hartell sustained a severe hand wound in the ensuing encounter but grasped the microphone with his other hand and maintained his magnificent stand until the front and left flank of the company were protected by a close-in wall of withering fire, causing the fanatical foe to disperse and fall back momentarily. After the numerically superior enemy overran an outpost and was closing on his position, 1st Lt. Hartell, in a final radio call, urged the friendly elements to fire both batteries continuously. Although mortally wounded, 1st Lt. Hartell's intrepid actions contributed significantly to stemming the onslaught and enabled his company to maintain the strategic strongpoint. His consummate valor and unwavering devotion to duty reflect lasting glory on himself and uphold the noble traditions of the military service.

    1964 - Hurricane Cleo battered Miami and the South Florida area. It was the first direct hit for Miami in fourteen years. Winds gusted to 135 mph and the hurricane caused $125 million damage.
    1965 - Elvis Presley's manager Colonel Tom Parker contacts Beatles manager Brian Epstein to let him know that Elvis will agree to meet the Beatles in his Los Angeles mansion on Perugia Way. When the group arrive, stoned on marijuana, The King is in the darkened living room, surrounded by his entourage, sitting on an L-shaped couch, looking at the TV with the sound off, fooling around on a bass guitar. "Hi, Elvis," says the group, almost all at once. "Hey, you guys want a drink?" Elvis offers.
 The four sit down to watch TV with Elvis and are taken with his early-model remote control, still a novelty. The group is also thrilled by the King's pool table, and plays a few games with the Mafia, while Presley's jukebox plays Charlie Rich's "Mohair Sam" over and over. Priscilla is presented to the group and then quickly whisked away, dressed, according to Paul, "in a purple gingham dress, with a gingham bow in her very beehive hair, with lots of makeup."
 Awed somewhat by each other's presence, conversation does not come easily, but John thinks to ask if Elvis is working on a new movie. "I sure am," he replies. "I play a country boy with a guitar who meets a few gals along the way, and I sing a few songs." "We all looked at one another," remembers John. "Finally Presley and Colonel Parker laughed and explained that the only time they departed from that formula - for Wild in the Country - they lost money."
 Paul offers to give Elvis some lessons on the bass; the group eventually falls into a very informal, brief, and anticlimactic jam session. Everyone seems pleased with the experience, however: John Lennon, upon leaving, tells Jerry Schilling to make sure Elvis knows that "if it hadn’t been for him, the Beatles would be nothing."
    1965 - Columbia Records releases Bob Dylan's second electric album, "Highway 61 Revisited." Hits include "Like a Rolling Stone" and "Ballad of a Thin Man."
    1966 - The Association's "Cherish" is released.
    1967 - While studying with the Maharishi in Bangor, North Wales, the Beatles receive news that manager Brian Epstein has been found dead in his Belgravia, London home (a death later attributed to an accidental overdose of the sleeping pill Carbitrol, taken with brandy). The Maharishi puzzles the Beatles somewhat by counseling them that Brian's death is cosmically unimportant; nevertheless, they immediately return to London. On the same day, London's Sunday Express newspaper reports that former band drummer Pete Best now works in a bakery, where he pulls down a weekly salary of eighteen pounds.
    1968 - Police and anti-war demonstrators clash at Chicago's Democratic National Convention, polarizing all sides to the issue of the war in Viet Nam.  Hubert Humphrey, President Lyndon Johnson's vice-president, is chosen as the presidential nominee. Protesting the riot, members of the convention's Wisconsin delegation attempt to march to the convention, but police turn them back. Julian Bond, denied his seat in the Georgia state legislature, seconds the nomination of Eugene McCarthy, adding that he has seen such police behavior only in Mississippi, Alabama and Georgia. Some say the fight about Viet Nam is still going on today with bitterness remaining in many veterans’ hearts against those who did not support the war or their country: right or wrong.

    1970 - The Troubadour in Los Angeles, CA was the venue of singer Elton John's first concert appearance in America and a record company executive for UNI records (a division of MCA) signed Elton to a recording contract. There were many singers who got their start here, including Neil Diamond.

    1977 - Jimmy Buffett marries his second wife, Jane Slagsvol of Columbia, SC, who had co-written two of his songs, "Something So Feminine About A Mandolin" and "Kick It In Second Wind." They remain married today.

    1981 - Divers probing the wreckage of the luxury cruise ship "Andrea Doria" recovered two safes from the purser's office. The "Andrea Doria" sank in a collision with the Swedish liner "Stockholm" on July 25, 1956, off Nantucket. What was in the safes? Despite speculation that passengers had deposited many valuables, the safe, opened on live television in 1984, yielded thousands of American silver certificates, Canadian bank notes, American Express travelers checks, and Italian bank notes, but no other valuables. This outcome apparently confirmed other speculation that most Andrea Doria passengers, in anticipation of the ship's scheduled arrival in New York City the following morning, had already retrieved their valuables prior to the collision.
    1981 - National Centers for Disease Control announces high incidence of Pneumocystis & Kaposi's sarcoma in gay men
    1982 - Oakland Athletics outfielder Rickey Henderson stole his 119th base of the season in a game against the Milwaukee Brewers, thereby breaking Lou Brock's Major League record for most stolen bases in one season set in 1974. Henderson added three more steals in the game, which Oakland lost, 5-4.
    1982 - Crosby, Stills & Nash's "Daylight Again," the group's first album since the 1977 "CSN," is certified gold. On the album is the current Top 20 tune "Wasted on the Way."
    1984 - The Menetta Lane Theatre in Greenwich Village opened. It was the first new off-Broadway theatre to be built in 50 years in New York City. The ribbon cutting was done by "America's First Lady of the Stage," Helen Hayes.
    1984 - A new face joined the group of journalists on CBS-TV's "60 Minutes." Diane Sawyer became the fifth reporter on the top-rated TV newsmagazine. Mike Wallace, Morley Safer, Harry Reasoner and Ed Bradley welcomed Sawyer to the show.

    1987 - No. 1 Billboard Pop Hit:  “La Bamba,'' Los Lobos. Ritchie Valens hit No. 22 with the song in 1959 just one day before he died in the same plane crash that killed Buddy Holly and the Big Bopper. The Los Lobos version of “La Bamba'' was recorded for the film of the same name with Lou Diamond Phillips in the lead role.
    1987 - Washington D.C. soared to a record hot 100 degrees, while clouds and rain to the north kept temperature readings in the 50s in central and southeastern New York State.
    1988 - Elton John's "I Don't Want To Go On With You Like That" peaks at #2 on the pop singles chart while Pat Benatar's "All Fired Up" peaks at #19.
    1989 - Chuck Berry performs Johnny B Goode for NASA engineers and scientists in celebration of Voyager II's encounter with the planet Neptune.
    1997 - In honor of first baseman Jim Thome's birthday, the Indians begin pulling up their socks to just below the knees. The Tribe will win 17 of 27 games en route to clinching American League East flag while sporting this new look.

    2002 - The first video streaming coverage of a Major League baseball game takes place on the internet. Approximately 30,000 fans visit MLB.com to see the Yankees defeat the Rangers, 10-3.
    2003 – Mars makes is closest pass to Earth, in nearly 60,000 years, passing 34,646,418 miles distant.
    2003 – Singer Janis Ian marries her girlfriend, Nashville defense lawyer Patricia Snyder, in Toronto, Canada where gay marriages are legal.
    2006 - Barry Manilow's TV special “Barry Manilow: Music and Passion” was presented with an Emmy Award for Best Individual Variety Performance. The following day Manilow underwent surgery to repair torn cartilage in both hips and faced a six-week recovery.
    2006 – Comair flight 5191 crashes on takeoff from Lexington, KY Blue Grass Airport, killing 49.
    2011 – Hurricane Irene struck the US east coast at Cape Lookout in NC, killing 47 and causing an estimated $15.6 billion in damage.
    2012 – Curiosity, the Mars rover, broadcasts its first audio recording of a human voice from the surface of another planet.
    2013 – Yosemite National Park continues aflame as the Rim fire has grown to 281 square miles.  It was the fourth-largest wildfire in California history and the largest on record for the Sierra Nevada range.  It was fully contained on October 24, 2013 and was declared out on November 4, 2014.
    2015 – The NLRB ruled that recycler Browning-Ferris has employer responsibility for contract workers supplied by an agency.  The ruling may imply similar liability for franchise companies such as McDonald’s.
