Fed Expected to raise rate today

The Federal Reserve Board is expected to raise interest rates to 2.5 percent while the European Central Bank is seen leaving rates unchanged at 2 percent at its policy meeting on Thursday.

The Fed statement is due after the meeting of the policy setting committee, the first of a series of closely watched events this week that includes U.S. jobs data and a meeting of the Group of Seven (G7) economic powers.

The next Beige report is not due until March 9, 2005. The Beige Book summarizes this information by District and sector. An overall summary of the twelve district reports is prepared by a designated Federal Reserve Bank on a rotating basis.

Allegiant funded a $250,000 sale-leaseback for a start-up fitness center in the southeast. An experienced hotel owner/operator purchased an under performing national franchise near O'Hare Airport in Chicago, IL. This operator has been successful buying and selling hotels and used the proceeds from a recent project to acquire this property. NorVergence BK Trustee Pleads for More Time

U.S. Bankruptcy Court Chief Judge Rosemary Gambardella has agreed to grant a deadline extension request from NorVergence's liquidating trustee, who says he needs more time to act on about 1,500 unexpired leases before they are automatically cancelled.

The ruling marks the second deadline extension for trustee Charles Forman, the fourth since the proceedings started. The new deadline is Feb. 28, 2005.

"The liquidating trustee needs more time to act on the leases because lawsuits over the leases that name the debtor are all over the place," says Forman's counsel, Michael Holt of Forman Holt & Eliades.

The Federal Trade Commission, various federal and state agencies, including eight state attorneys general have launched lawsuits against NorVergence, claiming that the failed company defrauded its customers. It is reported that the California Attorney General staff has been negotiating with Wells Fargo and others, and is about to launch a suit.

Several states are also suing or settling with the leasing companies that bought leases from NorVergence.

Thirty-six of those companies are being sued by 1,100 of NorVergence's former customers, according to the bankruptcy court. Telecomagents.com places their Weir law suit number at over 2,500, while the Michael Green Class Action Suit is encompassing all those who do not “settle” and qualify to partake in any potential award. There is five other state similar group actions, clients represented are not known.

Many leases companies have written off over $50 million in leases, as is required by their accountants or regulating agencies, although they continue to seek remedy in court.

An equal amount are in litigation, but it is not known if they have been written off the books at this time, most likely carried in another financial category.

In the bankruptcy filings, it was reported that NorVergence had placed over 11,000 leases into effect.

CIT Poised to Launch Equipment ABS in 05"

The CIT Group is expected to lead the asset-backed securities (ABS) market this year by continuing the strong origination pace it sustained last year. The ABS sector has faced a number of setbacks in recent years, including industry consolidation and fraud allegations at DVI Inc., but CIT gave the sector a boost by tapping the ABS market three times last year. CIT recently renewed its S3 Securities and Exchange Commission (SEC) shelf filing, which is valued at $1 billion in notes backed by receivables and collateral from construction, transportation, manufacturing, and other industries.

The company's specialty finance unit, with $15.7 billion in assets, made up about 35 percent of CIT's total financing and leasing assets in fiscal 2004. The specialty finance unit also represented about 40 percent of CIT's $52.4 billion in managed assets as of Sept. 30, 2004.

Unlike some analysts who are expecting the equipment sector to remain flat this year, analysts at Moody's Investors Service predict public issuances of equipment ABS will rise modestly in 2005. "If the economy continues growing in 2005, investment in industrial equipment is likely to increase, contributing to a higher issuance volume from existing players and the emergence of new issuers," Moody's analysts wrote in a recent report.

Moody's also notes that the improving construction and manufacturing sectors, which had been weak, are a positive sign for equipment ABS in the new year

MBA Economic Forecast: Long Term Rates Should Remain Low,
Support Real Estate Finance Activity

The Mortgage Bankers Association (MBA) is projecting strong economic growth through 2007, with gross domestic product (GDP) growing at a trend rate of about 3.5 percent in real terms annually.

"The year 2005 looks to be a strong one, with GDP growing slightly above trend at 3.6 percent, down somewhat from the 4.4 percent growth rate of 2004. This will result in continued strength in employment and a strong but modestly slowing housing market. …There will likely be a slight up-tick in the inflation rate in 2005…," says Doug Duncan, MBA chief economist and senior vice president, research and business development.

"Long-term rates will therefore remain quite low and thus supportive of real estate finance activity, whether residential or commercial." Long-term rates should increase from current levels by 50 to 65 basis points by the end of 2005, and another 25 to 35 basis points during 2006, Duncan says finally reaching about 7 percent for a 30-year, fixed-rate mortgage by the end of 2007. "Coming off a fairly steady rate environment in 2004, these are very modest interest rate increases for the level of economic growth we are expecting," he says.

Existing-home sales will come off record levels and fall by 7.2 percent in 2005, another 7 percent in 2006 and a bit more than 1 percent in 2007.

At that pace, sales in 2007 will be at the then record level of 2002. New-home sales will fall by 6.1 percent in 2005, by 10 percent in 2006 and another 3 percent in 2007, again at the record level of 2002. In addition, home-price growth is expected to be less rapid, with existing-home prices increasing 4.7 percent during 2005 and new-home prices increasing 3.7 percent.

Price increases in 2006 and 2007 are expected to be in the 3 percent to 4 percent range. Residential mortgage originations for both purchase and refinance loans will be down modestly from the second biggest year on record in 2004.

Purchase loans will total $1.559 trillion in 2005, decline slightly to $1.517 trillion in 2006 and then rise to $1.556 trillion in 2007. Residential refinance loans will total $983 billion in 2005, $689 billion in 2006 and $559 billion in 2007.

Total residential mortgage production in 2005 will be $2.542 trillion, basically tied with 2002 for the third-biggest year ever. The 2005 multifamily market will be similar in volume to 2004's market.

Brisk property sales and refinancings are the underlying themes. This will be the front of an elevation of refinance activity due to the maturing of a significant volume of loans made a decade ago. It appears from preliminary data that mortgage bankers originated a record volume of commercial loans in 2004. Commercial mortgage activity should be similarly strong in 2005 as rates remain low, yield-maintenance clauses expire and loans get refinanced, and the strengthening economy improves underlying commercial property economics.

NACM Credit Manager's Index for January

MANUFACTURING SECTOR RESULTS

The manufacturing sector index has declined for seven consecutive months and is now in neutral territory. The favorable factors, with one exception, realized steep declines in January.

The index of favorable factors is down 580 basis points relative to January 2004. The significant decline in sales activity over the past two months needs to turn around if the manufacturing index is to remain above 50 in February.

The sales index for January is at its lowest level since December 2002, whereas the credit extended index is at its lowest level since January 2003.

The one positive factor in the survey is that filings for bankruptcies are not increasing as activity slows.

Kenneth Addeo's practice focuses on commercial real estate law and asset-based finance. He represents commercial banks, saving banks and capital companies in a variety of transactions, including commercial fee and leasehold mortgages, commercial real estate leasing, construction and development loans, and commercial asset-based loan facilities. He also represents wireless communications companies in wireless communications site leasing and development matters.

Ken received his JD cum laude from the Albany Law School of Union University in 1990 where he was a member of The Justinian Society. He received his BS from Siena College in 1986.

    1848-Treaty of Guadalupe Hildalgo: The war between Mexico and the US formally ended with the signing of the Treaty of Guadalupe Hidalgo, signed in the village for which it was named. The treaty provided for Mexico's cession to the US of the territory that became the states of California, Nevada, Utah, most of Arizona, and parts of New Mexico, Colorado and Wyoming, in exchange for $15 million from the US.     1870-The first Justice of a state supreme court who was African-American was Jonathan Jasper Wright of Beaufort, South Carolina, who served as one of the three members of the court from February 2 to December 1, 1877. He resigned due to a move to oust him by white society. After leaving the Court, Wright moved to Charleston and set up a law practice. He established Claflin College's law department and conducted classes at his office in Charleston. He served a number of years as a Claflin College trustee and was active in the Republican Party. This day the city appropriated $100 to the Brush Electric Light Company of Cleveland, OH, to install a light on the dome of the courthouse.     1922 - Film director William Desmond Taylor was found in his Hollywood, California, bungalow, shot through the heart. His murder involved the most prominent female stars in Hollywood: Mary Pickford, Mabel Normand, and Mary Miles Minter. When detectives investigated Taylor's home, they found many keepsakes, including a photograph of Pickford, a collection of women's underwear with initials and the date of conquest, and perfumed love letters from Minter. While Pickford knew nothing of the killing, her name was linked to the case for months. Normand was the last person to report seeing Taylor alive. The beautiful comedic star told police she dropped by to see Taylor that evening and stayed for two hours, discussing movies and books. It was suspected that she went for more than conversation. Although she was later exonerated, her character was tarnished by the press. Normand never again rose to the stardom she once had, and her latest film, Susanna, was pulled from circulation by Mack Sennett after "Good Housekeeping" magazine pronounced Normand too "adulterated" for the screen. Minter's career, too, was ruined. The young actress had loved Taylor deeply. During his funeral, Minter rushed hysterically to Taylor's open coffin and kissed his corpse. The media had a vindictive heyday with Minter's affair with the director. Taylor's killer was never found.

    1925-Sled Dogs Save Nome. When a diphtheria outbreak was diagnosed in Nome, Alaska ( Popular 1,500) on January 21, the nearest large amount of antitoxin serum was in Anchorage. bitter winter temperatures made air delivery impossible, so a heroic dog sled relay was set up, 300,000 unites of serum were delivered by train to Nenana, Alaska, and on January 27-in temperatures of 40-50 degrees below zero—20 mushers drove scores of dogs on a 674-mile journey to Nome in 127 hours. Togo was the lead dog for the first 350 miles, and Balto was the lead dog on the final 53miles. The frozen serum arrived at 5:30am and once thawed and administered, there were no more diphtheria deaths. Balto became a national hero, and a statue was erected in his honor in New York City's Central Park.
