“I received a notice that I didn’t quite understand from GE Leasing indicating that I should contact them because the lease was expiring as of 12/28/12 according to the terms of the lease. When I called I was outsourced several times and told to be in touch with (old vendor). When I called (old vendor) I was told to contact GE Leasing. After trying to understand what I was supposed to do to finish up, I finally just faxed the request for termination on October 30, 2012.
“I followed up with a phone call to GE because **** who handles leasing at (old vendor) kept on telling me to contact GE. I still could not get any information. I called several more times and was finally put in touch with ***** from GE Leasing who indicated to me that because I faxed the request 2 days late, we were automatically hooked up for another year. When I read the fine print on the back of the lease, I saw that the request had to be in writing 60 days in advance of termination, so it would have had to be 10/28/12 for the 12/28/12 termination date.
Leasing News contacted the Collection Department at GE Capital, who looked into the situation, and resolved it to the satisfaction of their lessee:
"You are a miracle worker. I was contacted by ******** who originally had me going back and forth in circles. I received an end of lease agreement and return of equipment form.
“We are finally going ahead with our new Sharp copier lease agreement with Grant Sadowski and Anthony Catanese of Mosaic in Fort Lauderdale. We just signed the contract today and Sharp/Mosaic will be shipping the old Royal Copystar to GE's warehouse in Atlanta.
“Thank you for all of your efforts.”

KeyCorp posts 4% decline in fourth-quarter net income
Commercial lease financing continues downward
KeyCorp (NYSE:KEY) reported its earnings from continuing operations slipped 4% to $193 million from the fourth quarter of $201 million.
Key's noninterest expense was $756 million for the fourth quarter of 2012, up 5.4% from $717 million for the same period in 2011. Personnel expense increased $46 million due to several factors, the Key Press release states claiming an increase in contract labor for technology investments including credit card portfolio acquisitions (Elan Financial Services) and “related implementation of new payment systems and merchant services processing; higher employee benefits due to an increase in medical claims expense and an adjustment to the annual retirement contribution accrual; and severance expense associated with Key's Fit for Growth efficiency initiative.”

New Credit Reporting Agency Inspection Requirements
for Brokers/Funders/Lessors Working Out of their House
A popular consumer credit reporting agency is Corelogic. They are being mandated by the service providers. i.e. Trans Union, Experian', and Equifax “2. Physical Inspection: To assure FCRA compliance, companies accessing consumer credit reports are required to pass a physical inspection of their premises. ***Physical Inspections will be conducted on a yearly basis on Residential Businesses. Physical Inspections will be conducted on Commercial business, only when change of address is requested by the customer.” (1)

“We recently had an inspection of our office for this company. All went well, we thought, as we have been at this location for 20 years. Our office is in the home, 3rd floor, away from the other 2 floors of our residence, completely separate. Come to find out, because we do not have a door that can be locked to the office, we do not meet their policy.
“The office must be secure, according to the inspector. We have been pulling bureaus for 20 years, and never had a security breach. It is impossible to put a door to the office, and we cannot move the office. So now we have to find another service to pull bureaus. resolve it?

“Hey can anyone advise their thoughts on whether it will be an issue if the doors to our office are French Doors (Glass ). It has become clear I will need to add a lock to them.”
A California funder, in business many years, moved his office into his home and had an inspection, but failed because he was using a cell phone. When he moved to his residence, he got rid of the landline. He said it was not just the lower cost, but he took vacations and brokers/vendors/customers could reach him almost anywhere and with the internet, he also could conduct business anywhere. He also approved deals, and even could fund them while on vacation, so the cell phone was very important to him.
It appears cell phones and VOIP are not listed in a telephone book, one of the requirements, to have a listed phone.
There are other illustrations now facing brokers/lessors/funders, but Leasing News was unable to get their permission to print them
Credco will do a second inspection, if all the matters are newly complied, Leasing News was informed. But it is better to pass the first time.

Make sure the office, wherever it is located in the home, is a separate room with a locked door limiting access for non-workers. If the office is a converted bedroom, the bed and dressers should not be in the room now. The furnishings should only reflect the business items (i.e. desk, locked file cabinets, PC workstations, etc.) Remember that an office is not shared living space. If you work in a living room, kitchen. etc., you will not pass the qualification inspection. (They also recommend having a shredder. editor)

For purposes of identification, you may want to place a small sign on the door showing this is a business office.

For any business, it is important to have a published phone listing. Until you have this set up, you may find it beneficial to register your business profile with an online business profile service such as www.superpages.com. They have a FREE Business profile listing that may be very helpful to small companies that are awaiting the set up a primary business phone number. It may, at times, be needed for verification purposes as well. (VOIP phones will qualify, and perhaps a cell or digital phone, too. Editor)

If you went to the effort to get a business license or registration for a Federal ID or related document, it would be good to post this somewhere in the office for review, if needed.

Most small offices use a shedder for confidential document destructions.

Most offices use desktop PCs with password entry to access their credit reporting services. Some offices have notebook PC’s for basic business’s needs. Although portable, these specific business units remain in the office for inside use. Logically the use of a desktop to access bureaus makes the most sense. It is understood that, in all cases, access is always restricted and non-employees never view the information.
In addition, there is a section on Internet Security, which may be a good list for all businesses to follow; “Only Authorized Employees shall have computer network or terminal or any other access to any CREDCO Information.” (4)

ELFA Recognizes Dennis Brown 20 Years of Service
Dennis Brown, CAE, Vice-President of State Government Relations, Equipment Leasing and Finance Association (ELFA), Washington, D.C. was recognized for his 20 years of service to the association.

Mr. Brown joined ELFA in 1993 as Vice President of State Government Relations to implement a proactive program. He monitors state legislative and regulatory issues that will affect the equipment leasing industry, and develops and promotes ELFA positions and policy.
Among many accomplishments, he served as national President of the State Government Affairs Council and as President of the Washington Area State Relations Group. He has won the Award of Excellence in Government Relations from the American Society of Association Executives on several occasions.
Dennis Brown has also served as a liaison to tax committees of the National Conference of State Legislatures.
Prior to joining ELFA, he was Executive Director of the State Advertising Coalition.
A veteran of the U.S. Army having reached the rank of Sergeant, Mr. Brown is a graduate in political science from the University of Maryland , attended law school before leaving to begin a career in government Relations and is a Certified Association Executive (CAE).

"Overall, loan demand was largely unchanged in the Philadelphia, Cleveland, Richmond, Kansas City, and San Francisco Districts, with most of these Districts reporting a continuation of slight to moderate growth in total volume. The New York, Atlanta, Chicago, and Dallas Districts reported stronger demand than previously, while the St. Louis District reported a slight decline. Some increased lending in Philadelphia, Chicago, and Dallas was driven by businesses taking out loans for special year-end purposes such as tax planning and dividend payments. Cleveland, Atlanta, Chicago, Dallas, and San Francisco all reported strong auto lending. Demand for residential mortgages improved in Cleveland, Atlanta, Chicago, Kansas City, Dallas, and San Francisco. Commercial real estate lending was cited as a particular bright spot by New York, Cleveland, Kansas City, and Dallas. However, lenders in San Francisco remained reluctant to lend to real estate investors outside of the multifamily residential sector. San Francisco also reported a slight slowdown in IPO, venture capital, and private equity activity in that District's technology sector.
"Banks in the New York, Philadelphia, Cleveland, Chicago, Kansas City, and San Francisco Districts reported improvements in asset quality. Lenders were described as competing aggressively for highly qualified borrowers in Philadelphia, Richmond, Atlanta, and San Francisco. In Atlanta, this stiff competition may be leading to loosening credit standards, as there was some indication that banks were more willing to increase their tolerance for risk. Chicago banks also reported some loosening of standards. On the other hand, lending standards remained largely unchanged in New York, Cleveland, and Kansas City."

His puppy years were spent behind metal bars. He never had the chance to play, to be goofy, to get into all the puppy trouble that pups do; the kind of trouble that helps teach puppies to become dogs.Day after day, month after month, year after long year, Trigga waited. After a while, he probably didn't know what he was waiting for.
“When volunteers sprung him from his cement kennel, he 'gave them everything he had' - all the love & affection he had stored up inside him. What a tragic life for such a loving creature. Hard-hitting action ("Broken City") and nostalgic drama ("Not Fade Away") light up the box-office, while new DVD releases go from the gritty ("End of Watch") to the steamy ("The Paperboy") to the classic ("The Quiet Man").
In Theaters:
Broken City (Twentieth-Century Fox): After tackling period pieces ("From Hell") and post-apocalyptic gloom ("The Book of Eli"), director Allen Hughes returns to his gritty urban roots with this well-made, muscular drama with modern noir elements. Mark Wahlberg stars as Billy Taggart, a New York City police officer who takes up private practice and is hired by the corrupt Mayor (Russell Crowe) to trail his wife (Catherine Zeta-Jones). With election approaching, the case gradually becomes about more than only marital suspicion, revealing a wide-ranging conspiracy. The more Taggart uncovers, the closer he becomes to the dangerous corners of a shady system. With a sense of hardboiled suspense and moral ambiguity reminiscent of vintage gumshoe mysteries, the movie is a punchy, involving thriller.
Not Fade Away (Paramount Vantage): A musical from the man behind "The Sopranos"?! That's the premise of this criminally underseen drama, written and directed by David Chase, which weaves a wondrous 1960s soundtrack into its nostalgic plot to evoke memories both fond and bittersweet. Unfurling in a working-class New Jersey neighborhood, the story centers on Douglas (John Magaro), a young dreamer who plays the drums for a garage-rock band. With eyes on making it to Hollywood, he locks horns with his father (James Gandolfini) and his girlfriend (Bella Heathcote). Focusing less on straightforward narrative than on richly impressionist bits of the characters' lives as they float through a turbulent decade, this is a deeply personal study of the effect of sublime art on people, and a gem that's worth tracking down.

On DVD:
End of Watch (Universal): Director David Ayer further cements his reputation as a maker of gritty urban dramas with this intense look at the friendship between a pair of Los Angeles police officers. Brian Taylor (Jake Gyllenhaal) and Mike Zavata (Michael Pena) are close pals who together cruise the most dangerous corners of the city, often coming in contact with brutal criminals. But their bond is tested when a routine traffic stops leads to a massive drug bust, and suddenly they find themselves (and their families) targeted by a vicious international cartel. At times making startling use of the you-are-there camera made famous by the TV show "Cops," this is a visceral, suspenseful, and often disarmingly funny account of everyday heroism with excellent performances by Gyllenhaal and Pena.
The Paperboy (Millennium): Panned by several critics, this uninhibited drama from Oscar-nominated filmmaker Lee Daniels ("Precious") deserves a second look. Set in Florida during the height of the Civil Rights movement in the 1960s, the plot conflates film noir and coming-of-age elements into a punchy mystery, detailing how a small-town murder affects the lives of a batch of colorful characters. There's Charlotte (Nicole Kidman), a damaged beauty who becomes obsessed with a death-row criminal (John Cusack). There's Ward (Matthew McConaughey), a big-city journalist who returns to his hometown to investigate the crime. And then there's Jack (Zac Efron), the impressionable young athlete witnessing it all. Though it may be too heavy for some, Daniels' movie is a worthy trip for its fearless performances and steamy atmosphere.
The Quiet Man (Olive Films): Known for his legendary Westerns, the great director John Ford scored one of his greatest successes with this marvelously sentimental, profoundly personal 1952 comedy-drama. John Wayne stars as Sean Thornton, an American boxer who retires from the ring and visits the rural Irish village where he was born. Trying to reconnected with his roots and escape a troubled past, he falls in love with Mary Kate Danaher (Maureen O'Hara), a radiant local maiden. Their romance is a rocky one, however, complicated by their headstrong temperaments and by Mary Kate's bellicose older brother Will (Victor McLaglen), who's determined to keep them apart. Featuring gorgeous cinematography, robust humor and a roster of zesty performances from a great cast, this is one of Ford's most beloved works.

This Day in History
1775 - Americans dragged cannon up hill to fight the British at Gun Hill Road, Bronx. When the British navy landed on Staten Island in 1775, New York City Patriots feared an imminent invasion. They did not want the precious cannon at the Battery to fall into enemy hands. Thus, in December, 1775, they took the cannon to the mainland and scattered them roughly along present-day Gun Hill Road from today's Jerome Avenue across the Bronx River to modern White Plains Road.
1787 - Small farmers in Springfield, Massachusetts led by Daniel Shays continued their revolt against tax laws. Federal troops broke up the protesters of what becomes known as Shay’s Rebellion. Shays' Rebellion suffered a setback when debt-ridden farmers led by Capt. Daniel Shays failed to capture an arsenal at Springfield, Mass.
1821 - The Hudson River was frozen solid during the midst of the coldest winter in forty-one years. Thousands of persons crossed the ice from New York City to New Jersey, and refreshment taverns were set up in the middle of the river to warm pedestrians.
1831-Birthday of Jane Goodwin Austin, novelist, essayist, and short story writer. Most of her novels were authentically accurate depictions of the Pilgrims which she carefully researched.
1837 - At 7 PM a display of the Northern Lights danced above Burlington, VT. Its light was equal to the full moon. Snow and other objects reflecting the light were deeply tinged with a blood red hue. Blue, yellow and white streamers were also noted.
1856 - Marines and seamen from the U.S. sloop DECATUR went ashore at the village of Seattle, Washington, to protect settlers from Indian raids. The Indians launched a seven-hour attack but were driven off later that day after suffering severe losses. Incredibly, only two civilian volunteers were killed and no Marines or sailors were lost.
1871- Unveiled in the U.S. Capitol Rotunda, Vinnie Ream's statue of Abraham Lincoln that was authorized by Congress.
1871-Birthday of 1871, Maud Wood Park, directed congressional lobbying and was one of the key women implementing Carrie Chapman Catt's winning strategy to get women's suffrage passed. Instrumental in getting congressional approval for many child labor, maternity, and child health reforms as well as the Cable Act of 1922 which granted married women US citizenship independent of their husband's status. Before the Cable Act, an American-born woman AUTOMATICALLY lost her citizenship when she married a non-American citizen.
1879 – The Arrears of Pensions Act is passed by Congress. It authorizes back-payment of military pensions beginning from the day of discharge. If the veteran is dead, payments will be made to the family.
1890- Nellie Bly circled the world in 72 days, stepping into history. Newspaper reported Nellie Bly ( pen name used by Elizabeth Cochrane Seaman) set off from Hoboken, JN., Nov. 14, 1889, to attempt to break Jules Verne's imaginary hero Phileas Foggs record of voyaging around the world in 80 days. She did beat Fogg's record, taking 72 days, 6 hours, 11 minutes and 14 seconds to make the trip, arriving back in New Jersey on January 25, 1980.

1896-Birthday of the leading black American singer and dancer of the Jazz Age, and the Harlem Renaissance, Florence Winfree, born at Washington, DC. She appeared in Langston Hughes's Shuffle Along in 1921 and Plantation Review on Broadway in 1922, then at the London Pavilion in Dover Street to Dixie in 1923. Offered a spot in the Ziegfeld Follies , she turned it down and joined in creating a rival show with an all-black cast. Mills was the first black woman to appear as a headliner at the Palace Theatre. She was so revered for her efforts to create opportunities for black entertainers and to bring the unique culture of blacks to Broadway that more than 150,000 people filled the streets of Harlem to mourn her when she died at New York City, Nov 1, 1927, at age 31.
1900—birthday of tensor sax player Captain John Handy, Pass Christian, MS.
1903- (Sleepy) John Estes, an important early bluesman, was born in Ripley, Tennessee. He played on the streets of Memphis in the 1920's, supporting himself by working the night shift at a train yard. His tendency to doze off on the job earned him his nickname. He returned to Brownsville, Tennessee, in the 1940's, where he remained in obscurity for more than 15 years. Estes was rediscovered by a documentary filmmaker. He signed a recording contract and appeared at folk festivals in the U-S and Europe. One of Estes's L-P's included a guest spot by guitarist Mike Bloomfield, and Estes later appeared on an L-P by Ry Cooder. The rock group Joy of Cooking had a minor hit in 1971 with a song written by Estes, "Going to Brownsville." Sleepy John Estes died of a stroke in 1977, just as he was about to begin a tour of Europe.
1915-Alexander Bell in New York calls Thomas Watson in San Francisco.
1919 - The League of Nations, forerunner of the United Nations, was founded.
1924-The first Winter Olympic, opened in Chamonix, France, with athletes representing 16 nations. The ski jump, previously unknown, thrilled spectators The Olympics offered a boost to skiing, which would make enormous strides in the next decade.
1937- Trumpeter Buck Clayton cuts his first record, accompanying Billie Holiday, on “Why Was I Born?”

1945- the first water supply to be fluoridated in order to reduce tooth decay was the water system of Grand Rapids, MI. Fluoridation started with the addition of one part of fluoride ion to each million parts of water passing through the water treatment plant.

1945-VALDEZ, JOSE F. Medal of Honor
Rank and organization: Private First Class, U.S. Army, Company B, 7th Infantry, 3d Infantry Division. Place and date: Near Rosenkrantz, France, 25 January 1945. Entered service at: Pleasant Grove, Utah. Birth: Governador, N. Mex. G. O. No.: 16, 8 February 1946. Citation: He was on outpost duty with 5 others when the enemy counterattacked with overwhelming strength. From his position near some woods 500 yards beyond the American lines he observed a hostile tank about 75 yards away, and raked it with automatic rifle fire until it withdrew. Soon afterward he saw 3 Germans stealthily approaching through the woods. Scorning cover as the enemy soldiers opened up with heavy automatic weapons fire from a range of 30 yards, he engaged in a fire fight with the attackers until he had killed all 3. The enemy quickly launched an attack with 2 full companies of infantrymen, blasting the patrol with murderous concentrations of automatic and rifle fire and beginning an encircling movement which forced the patrol leader to order a withdrawal. Despite the terrible odds, Pfc. Valdez immediately volunteered to cover the maneuver, and as the patrol 1 by 1 plunged through a hail of bullets toward the American lines, he fired burst after burst into the swarming enemy. Three of his companions were wounded in their dash for safety and he was struck by a bullet that entered his stomach and, passing through his body, emerged from his back. Overcoming agonizing pain, he regained control of himself and resumed his firing position, delivering a protective screen of bullets until all others of the patrol were safe. By field telephone he called for artillery and mortar fire on the Germans and corrected the range until he had shells falling within 50 yards of his position. For 15 minutes he refused to be dislodged by more than 200 of the enemy; then, seeing that the barrage had broken the counter attack, he dragged himself back to his own lines. He died later as a result of his wounds. Through his valiant, intrepid stand and at the cost of his own life, Pfc. Valdez made it possible for his comrades to escape, and was directly responsible for repulsing an attack by vastly superior enemy forces.

Although never an Olympic Champion or world record holder, he set 14 US records during his career cut short by a fatal automobile accident on a road where he often trained. Died at Eugene, OR May 30, 1975.

1959- American Airlines opened the jet age in the US with the first scheduled transcontinental flight on a Boeing 707 nonstop from California to New York.

1961- Beginning a tradition that survives to this day, John F. Kennedy held the first televised presidential news conference five days after being inaugurated the 35th president.
1961- President John F. Kennedy appointed the first presidential physician who was a woman, Dr. Janet Graeme Travell of New York City. Several president prior had received treatment from a female medical practitioner. the one of most note was Dr. Susan Ann Edison, who graduated from the Cleveland Homeopathic Medical College, who treated President James Garfield from July 2, 1881, the day he was shot by an assassin, to September 19, 1881, when he died.
1961 - The Disney animated cartoon classic, One Hundred and One Dalmatians, was released to theaters. It took an animation staff of three hundred to complete the film in three years, at a cost of $4 million. It was a huge success at the box office.

1962-Sam Cooke's "Twistin' the Night Away," later done by Rod Stewart, is released on RCA Records. It will make it up to #9 on the pop chart.
1964 - The Beatles reached #1 on the music charts for the first time, with their single, "I Want to Hold Your Hand" which took the top position not only in "Cash Box" magazine, but also on the hit lists of radio stations. "Billboard" magazine listed the song at #1 on February 1. The group's second #1 hit, "She Loves You" was released on Swan Records, and not Capitol. Other Beatles songs were released on Vee Jay ("Please, Please Me"), M-G-M ("My Bonnie" with Tony Sheridan), Tollie ("Twist and Shout"), Atco ("Ain't She Sweet") and the group's own label, Apple Records, as well as Capitol.
1965 - Alta, UT, was in the midst of a storm that left the town buried under 105 inches of snow establishing a record for the state.

1971 - Charles Manson was found guilty of masterminding the killings of actress Sharon Tate and six others. He and three female members of his "family" were found guilty of one count of conspiracy to commit murder and seven counts of murder in the first degree and are sentenced to life imprisonment. During one of the most sensational trials in history, it was revealed that Manson regarded the Beatles as angels who communicated to him through their music. In particular, "Helter Skelter," "Piggies," "Revolution 9" and other songs on the "The White Album. He remains in jail today, although he asks for parole each year.
1975-The Cars win the Rolling Stone magazine annual readers' poll as the best new band of the year.

1987- the New York Giants defeated the Denver Bronco's, 39-20, to win Super Bowl XXI. The victory gave New York its first NFL title in 30 years. Giants quarterback Phil Simms completed 22 of 25 passes for 268 yards and three touchdowns to win the game's Most Valuable Player Award. Neil Diamond performs the US national anthem.
1987 - The second major storm in three days hit the Eastern Seaboard producing up to 15 inches of snow in Virginia, Maryland and Delaware. Up to 30 inches of snow covered the ground in Virginia following the two storms
1988- Guard Rickey Green of the Utah Jazz scored the 5,000,000 point in NBA history to a game against the Cleveland Cavaliers. Green made a three-point shot at the buzzer ending the third quarter. The Jazz won, 119-96.
1990 - Low pressure developed explosively over east central Missouri and moved into Lower Michigan producing high winds and heavy snow across parts of Iowa, Illinois and Wisconsin. Wind gusts to 60 mph and up to a foot of snow created near blizzard conditions in southeastern Wisconsin and northern Illinois. Wind gusts in Indiana reached 76 mph at Wabash. Thunderstorms associated with the storm produced wind gusts to 54 mph at Fort Madison IA

1999-The Rolling Stones open their No Security Tour in Oakland, CA. It is the band's first arena tour in more than two decades. Sue and I were there, four rows from the stage, center right, in the aisle as the usher could not find my site as notednon my ticket. The band was never better, full of energy, spirit, and showmanship. Afterwards, on BART going back to our car, I noted that the tickets I had shown to the usher to find our seats were from the Barry Manilow Show the previous week where we had up-front seats. They were the same color tickets and same style printing. In the dark, the usher using a small flashlight, neither I nor she usher had noticed they were not the Rolling Stone tickets ( that I had placed in my other pocket after the last ticket check and drawn the Manilow tickets out in error, basically only showing the seating numbers.)
