Abacus Sues Leasing News et al--Up Date

 

Mathew Burke of Abacus Leasing, Buffalo, New York, asked for another continuance. He filed the suit after Leasing News posted a complaint about his company ( the applicant states Burke did not return the $50,000 deposit as per the terms and conditions of a signed commitment letter by both parties.) Burke refused to comment on the matter to Leasing News, and instead brought a suit charging $5 million in slander.)

 

In regards to the Bulletin Board Complaint, Leasing News requested many times to hear his side of the story, and print any comments he might have, which he refused to comment on several occasions by telephone and e-mail. A copy

of the signed commitment letter was posted with the complaint.

 

Oral arguments regarding jurisdiction were originally scheduled for May 8, 2003 in the County of Erie before Judge Donna Siwek, and a postponed was granted until June 5,2003, where Mr. Burke has again asked for an additional 30 day postponement.

Equipment Leasing Industry Implements Taxability Tool Spearheaded by Sales Tax Compliance Leader Tax Partners

Centralized sales tax matrix helps untangle complex state and

 

local statutes

 

Tax professionals in the $208 billion U.S. equipment leasing industry are gaining a critical decision making tool through the Equipment Leasing Association's (ELA) Sales Tax Matrix Project.

 

Developed in collaborative partnership with Tax Partners, LLC, the largest sales and use tax compliance service provider in the U.S., the Sales Tax Matrix is a web-based resource providing ELA members easy access to updated taxability information applicable to their lease portfolios. The tool, unveiled today at the ELA Tax Executive Roundtable, will be launched for member use in July 2003.

 

Approximately 7,500 separate state and local government entities levy sales and use tax (also known as consumption or transaction tax). State governments obtain up to 45 percent of their revenue from transaction taxes and many are seeking to soften shortfalls caused by the economic slowdown through sales tax audits.

 

"Equipment leasing professionals are interested in a quick and easy starting point for determining the sales taxability of the leasing portfolios they manage," said Jim Musselwhite, Marketing and Alliance Manager for the Leasing Market for Tax Partners. "This matrix helps lessors wade through the ever-changing state and local sales taxability rules, speeding decision making by concentrating sales taxability information in one place."

 

Lessors using the sales tax matrix tool can also access more in-depth support resources via its links to relevant state sites, as well as to the ELA, Musselwhite added.

 

Prior to the development of its Sales Tax Matrix, the ELA had provided its members an online manual and community discussion group that lacked the ease of use and knowledge-sharing components found in this new matrix. According to the ELA, lessors typically develop "home grown" sales tax matrices for which there is no industry model and which do not contribute to the standardization that the industry requires.

 

"Confusion around the applicability of sales tax statutes seems to benefit the taxing entities and penalize the businesses that are required to collect and remit taxes on their behalf," said Dennis Brown, Vice President State Government Relations, Equipment Leasing Association. "This matrix will complement information in the ELA State Tax Manual and further assist industry members with conforming to the myriad and ever-changing rules issued by taxing authorities."

The UPS Uniform Hoax Fools the Military

 

The U.S. military is the latest victim of an Internet hoax warning Americans

to be on the alert for terrorists posing as United Parcel Service drivers.

 

Others who have fallen for the canard include police, corporations and even

a major newspaper.

 

As the story goes, terrorists may have been behind a "huge" $32,000 purchase

of UPS uniforms recently on eBay and may be planning to use them to gain

access to buildings and plant bombs.

 

Only, the purchase never took place.

 

"There is nothing to that rumor," eBay spokesman Kevin Pursglove told

WorldNetDaily. "No transaction of this nature ever took place."

 

In fact, since the Sept. 11 hijackings, the San Jose, Calif.-based online

auction house has banned the listing of uniforms of any airlines or shipping

companies on its website, Pursglove notes.

 

Atlanta-based UPS is equally annoyed about the false rumor, which plays on

Americans' heightened fears about terrorist attacks during the war.

 

"It's a major hoax and a royal pain," said UPS spokesman Steve Soltis.

"We've been bombarded with calls."

 

The cybermyth, which has been circulating by e-mail since the first of the

year, has caught the attention of officers in the U.S. Air Force, who have

forwarded it to the U.S. Army, where it has been circulating unchallenged

even among intelligence personnel.

 

One of the military warnings – under the subject line "Watch Out!"– was

recently issued under the name of Air Force Master Sgt. William H.

Stinebaugh. WorldNetDaily intercepted a copy. The text of the bogus, albeit

official-sounding, part of the e-mail he forwarded reads as follows:

 

"There has been a huge purchase, $32,000 worth, of United Parcel Service

(UPS) uniforms on eBAY over the last (30) thirty days. This would represent

a serious threat as bogus drivers can drop off anything to anyone with

deadly consequences.

 

"If you have ANY questions when a UPS driver appears at your door, they

should be able to furnish VALID I.D. Additionally, if someone in a UPS

uniform comes to make a drop off or pick up, make absolute [sic] sure they

are driving a UPS truck. UPS does not make deliveries or pick ups in

anything except a company vehicles [sic].

 

"If you have a problem, IMMEDIATELY call security or your State/local Law

enforcement."

 

Even some police have been fooled by the rumor, and newspapers have gone

along.

 

As a public service to its readers, the Fort Collins Coloradoan newspaper

last month dutifully reprinted a safety advisory issued by the Colorado

State University Police, which states: "There is evidence and reports that

unknown people have recently purchased UPS uniforms on eBay."

 

"Consider challenging anyone making a delivery to your facility and, if

necessary, ask for credentials and delivery documentation. An employee of

UPS or a similar company should not hesitate to comply with your request,"

the police advisory continued. "If you have any concerns about a delivery or

delivery person, contact police."

 

The St. Petersburg Times of Florida also bit.

 

In a March 20 story about corporate security, which appeared on the front

page of its business section, the Times quoted a local factory spokeswoman

who said corporate security warned workers by e-mail to "keep an eye out for

UPS folks," who may be posing in UPS uniforms "bought from eBay a few weeks

ago."

 

On April 1, The National Association of Equipment Leasing Brokers thought it

was Bob Bell writing a joke about UPS Leasing, which is not true,

as Bob would never do that.

 

 

Reports of an eMail Attachment

 

If you get an e-mail attachment from a return address of kitmenkin@leasingnews.org, do not open it. Delete the

e-mail. It most likely contains a virus.

    1836-Birthday of Mr. Leslie, a Woman, Wills Feminism $2 Million

After the bankruptcy and death of her husband Frank, Miriam Florence Folline Leslie rebuilt the Leslie publishing empire, changed her name officially to Mrs. Frank Leslie and willed $2 million to Carrie Chapman Catt personally to forward the cause of women's suffrage. History was advanced by the bequest.

It would cost Catt more than a million dollars in legal fees to fight the family challenge. (The family ignored the fact that Miriam helped build and then single-handedly rebuilt the publishing empire and earned the money herself). The challenges left women's suffrage with about $800,0000.Catt used the money to set up a wonderful publicity and information bureau named after Leslie. News papers, magazines, and leaflets went out to millions of people swaying them to support women's suffrage and organizing them. It was the greatest publicity blitz in the history of this nation - and perhaps the world. After MR. Frank died broke in 1880, Miriam who had personally edited several of the publications took over the management of the floundering publishing empire and gained the title of the "Joan of Arc of American publishing." The Leslie publishing empire consisted of a number of weekly and monthly magazines, the most successful and popular publications of their time. They supported the Leslies luxuriously.

Leslie became a legendary party hostess and her life was as intricate as any fiction. She started off on the stage in an act that starred the legendary Lola Montez. She married a Leslie publications editor and before her divorce shared her life and her husband's home with publisher Frank Leslie whom she eventually married in a renowned menage a trois. After Leslie's death, she was married for a short time to the brother of Oscar Wilde. In 1935, he got the role of Hopalong Cassidy in a series of popular westerns. He made 66 of these films between 1935 and 1948. Some of them were edited and shown on television; Boyd then made some episodes especially for TV.     1987- Canadian pop star Bryan Adams joined former Beatles Ringo Starr and George Harrison on stage at Wembley Arena in London for the finale to the second annual Prince's Trust rock gala. The three - along with Elton John, Boy George, Eric Clapton and Ben E. King - brought the crowd of 8,000 to their feet with a rendition of King's hit, "Stand By Me." Among the audience were Prince Charles and his wife, Diana. Charles set up the Prince's Trust fund in 1976 to help young people who are socially , economically or physically handicapped.

    1998-Just three weeks after Notah Begay III became the third professional golfer to shoot a record-low- round of 59 in a professional tournament, Doug Dunakey became the fourth golfer to do so. Dunakey carded 10 birdies and an eagle in the second round of the Miami Valley Open, a Nike Tour event, in Springboro, OH. Needing only a par on the 18th hole to finish with 58, Dunakey three-putted from25 feet for a bogey. He didn’t win the tournament, though. Craig Bowden did, shooting 16-under-par, two shots better than Dunakey.
