Conseco Finance plan scheduled for ruling today

Judge Carol A. Doyle of the US Bankruptcy Northern District of

Illinois Court in Chicago say yesterday she needed additional time to process the ''troubling'' issues involved and would make a ruling today.

Conseco Finance is a unit of Conseco Inc., a Carmel, Ind., insurance company which is also working through bankruptcy proceedings in the same court.

Large debt, a legacy of risky acquisitions and mobile home loan foreclosures in its consumer finance unit led Conseco in December to become the third-largest U.S. company to file for bankruptcy.

Under Conseco's reorganization plan, St. Paul, Minn.-based Conseco Finance Corp. is being sold for about $1 billion. Once also a leader in small-to-mid size leasing, Conseco is not

what it used to be.

Allegiant Partners Incorporated Secures Additional Funding

Allegiant Partners Incorporated, a direct funding source for brokers and other leasing companies on transactions ranging from $30,000 to $250,000, has signed a new term financing agreement with a bank affiliate based in New York. Allegiant has negotiated financing facilities exceeding $11 million in the last 6 months and is favorably positioned to continue growing its well performing portfolio.

"We have been pleasantly surprised at our ability to raise funds both as a relatively young leasing company and during tough economic conditions. We've worked very closely with our banking partners to help them understand our business and we are

beginning to garner the benefits. Having strong funding relationships will allow us to focus our energies more keenly on our network of brokers, learning how to serve them more efficiently and effectively" stated Doug Houlahan, Director, Finance &

Marketing.

Despite the sluggish spending environment Allegiant is seeing a surge in application volume and credit quality. "We've gotten more aggressive in our rate structure throughout the second quarter and have been impressed with the quality of transactions received. We've made a conscious decision to maintain the credit quality of our portfolio and are willing to structure our transactions accordingly." Added Houlahan.

Thursday----Odds and Ends----

Bob Bell e-Vendor Program

“I was surprised to read the press release on Independent Leasing's e-Vendor

Program. It sounded as if Bob was now in the e-commerce software business.

More to my astonishment was that his e-vendor solution sounded much like our

alaQuote program (which in fact it is). I'm sure that Bob's intention of

the press release was to drum-up new vendor business, rather than promote

his arsenal to other Brokers. I'm very pleased to see a customer of ours

aggressively using an excellent marketing tool for what it was intended for,

to establish more vendor relationships.

“Good work, Bob.

“For those of your readers that wish to take a closer look at what Bob is

promoting to his vendors, they can find more information at

United Association Equipment Leasing Sausalito, California Conference

Host Bob Teichman did his usual excellent job. It goes to show you

that you don’t need a speaker, but a chance for those in the equipment

leasing business to get together and talk with each other.

It started at 5pm and most everyone was there on time. Many stayed

an hour past the closing time as the food and ambiance was great. Steve

Reid of Santa Barbara Savings and Loan Leasing drove up; however,

he was also on his way to Vacaville to see his son who plays for

the UCLA baseball team that weekend. He was going to see

some clients along the way, and his boss, Paul Menzel knew

the real reason he was attending. Seriously, it was very

good to see Steve again as he is very well respected in the

industry.

Warren Capital had about seven of their crew in attendance, including

Hy Bren. When I said he “retired,” I meant he was “semi-retired.” Matsco

gave him a very big going away party, but how could Hy miss out going

to an office near where he lived, and staying involved in medical sales.

He had run it for Interlease, SHW Capital, his own company, and

then at Matsco with his super sales wife. Greater Bay Bank bought

Matsco and they have rules about the age of retirement, but Hy

doesn’t have those and Clay Stevens is lucky to have him as

a “consultant,” even if “part-time.” Now if he can get Hy’s

wife involved, Clay can be the one to retire. ( By the way,

Clay put together almost 50 winery leases---so you can

say he knows his wine companies. As a side note, he wakes

up every day at 4:30am, does his exercises, and then goes

into work. He’ll live to a hundred.)

Karen Weaver of Phoenix American Financial was there ( hope I have

the name of the company right.) She helped coordinate the event

with Teichman. They do “back office” for many companies.

Dynamic Paul Weiss was there. While his office is in San Francisco,

he lives in Mill Valley, nearby. He had just gotten back from

his New York office. His business is very strong, and it appears

he is not afraid of the airline industry. Dick Leask of Belvedere

was there ( he was a UAEL regional chairman for many years.)

Bill Grohe of UAEL says membership is going well, despite

the economy. I was personally surprised to learn some law

firms had not rejoined, including a San Francisco major

firm that had a board direction almost every year---but

maybe their business is not that good. Grohe was promoting

the UAEL Portland conference for this fall. He has over

30 exhibitors signed up, hopes to have over 50, plus

some funders no one has met before---quite a feat.

Ken Greene the musician was there, who makes his living

as an attorney, appears to be getting more active at ELA.

While I can’t name them all, I stayed until after 8pm,

and Bill Grohe talked me into having a UAEL regional

meeting in Silicon Valley in October.

In the old days at UAEL, there were many regional meetings,

as there appear today. Bette Kerhoulas was the person

in charge of the regional meetings and is evidently

trying to bring them back again. I think they are

great, even if like the one in Sausalito, just to

get together is definitely worth the time.

Business Leasing News edition is out----

Here is the June 2003 edition of Business Leasing News. It is available

now at the new firm site: http://www.pattonboggs.com/newsletters/bln

This edition features a description of the President's $350 billion tax

cut, including its impact on capital investment. In addition, for the

international community, a story appears on the new Basel Capital Accord

which will probably change reserve requirements for at least 20 of the

largest U.S. banks that are actively involved in internationally lending.

For those involved in off-balance sheet transactions, one of the articles

discusses the transactional impact of FASB's new consolidation rules in

leasing. If you have an interest in the Boeing tanker transaction with the

Air Force, check out the article on the terms of that $16 billion dollar

proposed lease. Other stories cover the new SEC off-balance sheet disclosure

rules, tax, aviation and other current issues.

Please feel free to refer to the new web site. Thanks for your newsletter.

It's a very interesting and helpful resource.

Highlights This Day in American History

1754-the first Colonial congress met at Albany, NY, from this date to July 11, to form a plan of union and to negotiate a treaty with the Six Nations of the Iroquois. Seven colonies attended. Massachusetts Bay sent four delegates, New Hampshire four, New York four, Pennsylvania four, Connecticut three, Maryland two, and Rhode Island tow.

1778-Learning that the British have left Philadelphia, Washington's troops start to move from Valley Forge where raw recruits had spent almost nine months of training, which has turned them into a formidable force. They also joined by

General Lafayette, who had narrowly escaped a British counter-attack

http://www.ushistory.org/valleyforge/served/lafayette.html

1841- In a letter to President John Tyler from Samuel Colt of Hartford CT, Colt claimed he had invented an “underwater torpedo” and could sink ships by mines. He sank the gunboat Boxer in New York Harbor on July 4, 1842, and the 300-ton brig Volta on October 18, 1842. On April 13,     1843, in the presence of President Tyler, his Cabinet, General Winfield Scott, and other officials, Colt blew up a schooner on the Potomac River by an electric mind from a distance of five miles. His invention was a combination of Robert Fulton’s stationary torpedo and Professor Robert Hare’s galvanic current. It’s claim was that it would protect all US harbors from foreign invasion.

http://www.colt.com/colt/html/i_historicalservices.html

1846- the first baseball game to be played as part of an organized sport took place at Elysian Fields, Hoboken, NJ, when the Knickbocker Baseball Club of New York, the first organized baseball team, was defeated by an informal team called the New York Nine. The score was 23-1 in four innings. The umpire was Alexander Joy Cartwright, a member of the Knickerbocker team. Cartwright was the author of the first set of formal rules for baseball. He also laid out the sport’s diamond-shaped field and established its nine playing positions. The widespread legend that attributes the founding of baseball to Abner Doubleday, a West Point cadet ( later a general ), at Cooperstown, NY, is false. Early versions of baseball, based on the English games of rounders and cricket, were played in the English colonies of America as far back as the early 1700’s.

1856- Elbert Hubbard, born at Bloomington, IL, famous turn of the century American author and craftsman, founded the Roycroft Press at East Aurora, NY. Best known of his writings were A Message to Garcia and a series of essays titled Little Journeys. He also became famous for his furniture designs. Hubbard lost his life with the sinking of the Lusitania, May 7,1915.

1860-Birthday of Lizzie Andrew Borden, suspected but acquitted of the double murders of her father and her step- mother. There was a great deal of circumstantial evidence, but lack of a murder weapon or blood on her clothes stymied prosecutors. The women of the city of Fall River, Massachusetts, supported her by crowding the courtroom - and then after the acquittal ostracized her. Their attitude plus other factors indicate that she was an abused child/woman.

If she committed the murders, she had to have help from people outside the home to cover up the evidence. Contrary to some rumors, the murder hatchet was never found.

http://www.lizzieandrewborden.com/

1862-After fifty years of controversy, Congress outlawed slavery in US territories http://docsouth.unc.edu/neh/long/long.html

1864-The Confederate Cruiser Alabama was sunk by the U.S. S. Kearsarge off Cherbourg, France, while trying to escape into the Atlantic. fifteen thousand Frenchmen watched the battle from shoreline cliffs. In two years of roaming the Atlantic, the Alabama had destroyed or captured 69 vessels.

http://www.angelfire.com/wi2/cvs33/sow.html

1865-“Emancipation Day:” celebrated in Texas to commemorate the day in 1865 when Union General Granger proclaimed the slaves of Texas free. Also proclaimed as Emancipation Day by the Florida legislature. Juneteenth has become an occasion for commemoration by African Americans in many parts of the US.

1867-The first running of the Belmont Stakes took place at Jerome Park, NY. The team of jockey J. Gilpartic and his horse, Thuless, finished first in a time of 3:05. The Belmont Stakes continued at Jerome Park until 1889, then moved to Morris Park, NYU, during 1890-95, and in 1906 settled at Belmont Park, NY, where it has continued to the present day. The Belmont Stakes is the oldest event of horse racing’s Triple Crown.

1885-The Statue of Liberty arrived in New York, a present from France to

the people of the United States. http://memory.loc.gov/ammem/today/jun19.html
