Correction: SB 197 Story
Title was corrected to:
New Legislation Seeks to
Amend SB197 to Remove Licensing of Broker
by Tom McCurnin, Leasing News Legal Editor
A sentence in the first paragraph was changed to:
Under new proposed legislation, a broker may also be called a “finder,” and thereby exempted from licensing. If this law is passed "as is," no longer will brokers be required to be licensed. Instead they will only have to be “registered.” The facts follow.
http://leasingnews.org/archives/Mar2017/03_08.htm#california
Leasing News Editor apologizes for changing Tom McCurnin’s headline
and made the online corrections when requested below by DOB Tom Dresslar:
"SB 297 (Dodd), entitled, “California Department of Business Oversight Seeks to Amend SB 197 to Remove Licensing of Brokers.” The headline and article essentially assert the DBO is sponsoring SB 297, that the bill’s language reflects our proposal. That is 100 percent false. The DBO has nothing to do with SB 297. The idea is not ours. We did not draft the language."
Tom Dresslar
Deputy Commissioner, Policy and Planning
Department of Business Oversight
State of California
From Tom McCurnin:
"The fact that the legislation was incorrectly attributed to the California Department of Business Oversight and the DOB was so adamant in its denial leads me to believe that the DOB is not endorsing this proposed legislation and might even be against it. I’m sure their opinions, if any, will be shared with the Finance Committee members when this Bill reaches the Committee stage."

Arvest Equipment Finance Announces Promotions
Volume Increases More than 25 Percent for Second Consecutive Year
LOWELL, Ark. – Arvest Equipment Finance (AEF) recorded a second consecutive year of at least 25 percent growth in volume, the division of Arvest Bank announced and identified a round of new hires and a promotion. John Bradford has been promoted to sales manager, while Omar Portillo was hired as manager of credit administration and Rick Dierks as equipment finance specialist for Missouri and Kansas.
It also was announced that Matt Crawley and John Raymond Pitre have earned the Certified Lease & Finance Professional (CLFP) designation. The CLFP designation identifies an individual as a knowledgeable professional to employers, clients, customers and peers in the equipment finance industry.
Arvest employs nine of the more than 400 CLFPs in the United States and Canada. That total ties Arvest for the sixth-highest number of CLFPs among all companies.
After seeing a jump of more than 27.9 percent in loans and leases from 2014 to 2015, Arvest Equipment Finance ended 2016 with $234.7 million in loans and leases. That’s a year-over-year increase of 25.1 percent. Additionally, AEF increased its number of contracts from 1,046 in 2015 to 1,816 in 2016.
Eric Bunnell, CLFP
President
Arvest Equipment Finance
“Our growth was a combination of increased volume from the commercial lenders and from our vendor production, which is an area we are focusing on for future growth,” said AEF president Eric Bunnell. “Our experienced operations team did a fantastic job of meeting the demands for the increased volume, while the sales team was able to increase their joint calls with lenders and vendors, which led to new opportunities.”

DBO to Hold Roundtable Discussion
with Fintech Industry Representatives
Commissioner Owen and DBO staff will meet with fintech industry representatives Mar. 22 in San Francisco to discuss the industry’s concerns with the 50-state regulatory system and how best to address those concerns.
Fintech attendees will include online platforms that have participated in the DBO’s inquiry into the online lending sector, as well as trade groups representing both lenders and electronic transaction firms. Commissioner Owen hopes to come away from the roundtable with ideas that can form the basis of discussions with her colleagues at the Conference of State Bank Supervisors about potential changes to the state regulatory system.
The meeting comes against the backdrop of the U.S. Office of the Comptroller of the Currency’s Dec. 2 decision to move forward with a national special purpose charter for FinTech companies.

I was born and raised in Chicago.
In 1974, I attended Colorado State University before dropping out without graduating in 1977. I returned to Chicago and was hired for my first job selling copiers and office equipment downtown Chicago. After 2 years of excellent sales training, I made the decision that I liked Colorado much better than Chicago and I relocated to the Denver area in 1980.
In Denver I was hired for my second and last job again selling copiers and office equipment. At this job, I continued my sales education and was introduced to leasing as a sales tool for selling copiers. After 1 year selling copiers in Denver, it became apparent to me that I wasn’t very good at taking direction or working for someone else. In 1981, with $2,000 in savings I started my first company, Business Systems Brokers. I was selling used copiers and office equipment out of my converted garage.
With only $2,000 to acquire inventory, I was forced to be a little creative. I contacted a few leasing companies in Denver to see if I could buy their repossessed copiers and office equipment. I struck gold when I was able to buy 3 full self storage lockers full of copiers and office equipment for the $2,000 (In 1981 leasing companies didn’t have full time asset departments). This inventory kept me in business for the first year.
With my experiences selling copiers, I knew I needed to offer some type of financing to help me sell my used copiers. In contacting additional leasing companies to buy equipment I learned of a company in Florida named Denrich Leasing. Denrich Leasing was a small ticket leasing company working with brokers nationwide. I started to offer Denrich’s leasing product to my copier customers in 1982 under the company name Business Systems Brokers dba; BSB Leasing (You think I could make up a name like that?).
After about a year, I was making more profit brokering leases to Denrich then I was selling used copiers. And I didn’t have to worry about providing service on the lease like I did with the copiers.
In 1983, I sold my last copier and became BSB Leasing exclusively. I moved out of my garage (It was very cold in winter), moved into a real office and hired my first employee. The next twelve years were spent building a nice profitable little business working with equipment vendors in the Denver area.
In 1995, BSB Leasing was selected by Colonial Pacific Leasing to become a service center for brokers in the Western United States under a program they developed named Pegasus. That year BSB Leasing began working with lease brokers.
In 1998, after growing to 40 employees, offices in Denver and Cherry Hill, New Jersey and $75M in annual funding BSB Leasing was sold to UniCapital Corporation, a public company in Miami. I became a unit President reporting to Bruce Kropschot, then a Vice-Chairman of UniCapital.
After 2 years under the ownership of UniCapital in 2000, I re-acquired BSB Leasing along with my management team of Bruce Zwillinger and Ron Gonzales.
I continue to serve as President of BSB Leasing, Inc., working primarily out of my home on Kauai while Ron Gonzales runs the day to day from our headquarters in Denver. Bruce Zwillinger semi-retired in October, 2012 but continues to work with a select group of brokers.
In 2013 BSB Leasing, Inc. continues to work with lease brokers nationwide. We offer both direct funding under ( BSB Leasing, Inc. name ) BSB Direct Finance name and complete syndication services through our Syndication Desk.
I also serve on the board of Orion First Financial, LLC and Mintaka Financial, LLC in Gig Harbor, WA. In addition, I have been Chief Credit Officer of Mintaka Financial, LLC since 2008.
Other companies started include: The Cruise Director, Inc. started in 1985 and sold in 1992; Info Marketing, Inc. started 1987 and sold 1990.

##### Press Release ############################
2017 “What’s Hot/What’s Not” - Reveals Equipment Outlook
by Amy Vogt, Equipment Leasing and Finance Association
Construction Equipment Repeats as the Winner,
Plastic Breaks into the Top 5
What are the hottest equipment sectors in 2017? The answer is construction, medical, machine tools, high-tech/computer, plastics and trucks/trailers, according to a new survey of ELFA member asset managers and consultants.
The 2017 “What’s Hot/What’s Not” Equipment Leasing Trends Report, which reveals industry perceptions of 15 equipment markets based on a survey of ELFA members, indicates that equipment managers and leasing companies remain optimistic with some of their equipment outlooks, yet decidedly pessimistic in others.
The study’s author, Carl Chrappa of The Alta Group, LLC, notes that this year marks the seventh year in a row of positive survey results. However, he reports that survey respondents identified a number of potential threats to the secondary market this year, including a slowing economy, oversupply, over-regulation, used equipment surplus, protectionism, rising interest rates and economic instability. Overall, according to the comments received, the biggest threats to the secondary market are bloated equipment inventories and the health of domestic and global economies.
The following are the top 5 equipment types from the survey:
- Construction equipment was the big winner for the fourth year in a row. The outlook for construction remains good, pinned to the improving health of the economy and low interest rates. Sales of used equipment have been declining a bit due to sales in the primary market, weak global trade and the strong dollar discouraging exports. Proposed national infrastructure projects could be a plus.
- Medical equipment finished in second place. This high standing in rank is believed to be linked to a better understanding of the impact of the Affordable Care Act on hospitals and clinics and talk of an ACA overhaul. This industry has a preference for leased equipment, which continues unabated, driven by demographics linked to the increasing health care needs of the “baby boom” generation. However, potential Deductible Reimbursement Account (DRA) reimbursement cuts and rules aimed at the industry could weaken the new equipment market while potentially making some used equipment more desirable. The medical equipment secondary market is robust, and the refurbished equipment market is forecast to grow sharply.
- Machine tools finished in third place, due to the strong domestic automotive and allied industries, along with the now-improving oil exploration sector. This ranking is also believed to be linked to financing choices relative to smaller ticket size opportunities and to “one-off” deals, large vendor product line financings and entire manufacturing plant fundings. In addition, low interest rates and accelerated depreciation have aided this segment. In the primary market, sales for metal cutting equipment fell -4.3% in 2016, though total consumption remains high. Sales for this sector are forecast to remain high in 2017. However, the secondary market for machine tools has weakened a bit, and prices are now being discounted in both the primary and secondary markets.
- Hi-tech/computers finished in fourth place. This industry continues to operate on very low margins but has a very large secondary market. Global computer sales continued to drop in 2016. Declining primary market PC sales reflect a growing preference for phablets and wearables, but could have positive implications for the secondary market.
- Plastics equipment tied for fifth place, up from eighth place last year. Currently, this market segment continues to experience a solid turnaround in almost all categories. Sales of new injection molding machines increased again for the seventh year in a row. Used prices for plastic injection molding machines have increased by 20% to 50+% over the past five years. Much of this is thanks to the automotive industry, which requires high-capacity IMMs for its products, and auto parts suppliers, which utilize smaller capacity plastic equipment. However, used blow molding equipment prices related to PET bottling have declined due to advances in technology and industry consolidation.
- Trucks/trailers tie for fifth place. New truck sales dropped more than 22% last year and are expected to fall again this year. Competition from rail bears some of the blame. New trailer shipments were brisk, breaking the 2006 record. Sales of used trucks and trailers are good, although resale values have been declining. This sector has greatly benefited from low fuel prices and interest rates. There is continued optimism for this equipment type.

Fernando's View
By Fernando F. Croce
Brooding action (“Logan”) and provocative frights (“Get Out”) come to theaters, while new DVDs offer Oscar wins and nominations (“Manchester by the Sea,” “Loving”) as well as a re-released classic (“Mildred Pierce”).
In theaters:
Logan (Twentieth-Century Fox): The superhero blockbuster genre gets serious with this brooding action thriller, which delves into the darker sides of its mutant warrior. Set in the future, the plot zeroes in on Wolverine (played once again with laconic intensity by Hugh Jackman), once a member of the uncanny X-Men but now reduced to a limo chauffeur in the wake of a harsh plague. Hiding in the south border and caring for aging, ailing Professor X (Patrick Stewart), he is reluctantly pulled back into the avenging business by a group of younger mutants led by Laura (Dafne Keen). When he uncovers a nefarious project equipped with killers, Wolverine finds himself back in claw-slashing action. Directed with meaty gravity by James Mangold, this is a moody and visceral riposte to anyone complaining about the lack of substance in superhero movies.
Get Out (Universal Pictures): Better known for his late-night sketch skills, comedian Jordan Peele takes a most impressive leap into feature direction with this original, unnerving mixture of horror and humor. Unfolding in deceptively placid suburbia, the movie charts the increasingly bizarre events in the weekend in which black photographer Chris (Daniel Kaluuya) goes with his white girlfriend Rose (Allison Williams) to meet her parents (Bradley Whitford, Catherine Keener). What begins as a merely nervous getaway quickly escalates for Chris into a race for his life, with each new discovery bringing a fresh fright to the surface. Blending quick and entertaining genre tropes with genuinely provocative insights about race in America, Peele serves up crackerjack tension and dark laughter. One of the year’s most explosive releases.
Netflix Tip: A beloved cult figure who brought gusto to his every role, Bill Paxton (1955-2017) was a welcome presence in blockbusters and indies alike. So check out Netflix for some of his best roles, which include “Aliens” (1986), “Near Dark” (1997), “One False Move” (1991), “Twister” (1996), and “Frailty” (2001). |
On DVD:
Manchester by the Sea (Lions Gate): Having established himself in “You Can Count on Me” and “Margaret” as a poet of thorny emotions, writer-director Kenneth Lonergan serves up another rich and intense portrait of people at difficult crossroads with this acclaimed drama. In a performance that won his the Best Actor Oscar, Casey Affleck stars as Lee Chandler, a Massachusetts janitor whose quiet demeanor hides depths of pain. His life takes a sharp turn with the death of his older brother Joe (Kyle Chandler), which leads him back to the seaside town of Manchester. While coming to terms with being the new guardian of his nephew Patrick (Lucas Hedges), Lee must also face a tragic past involving his ex-wife Randi (Michelle Williams). With tender compassion for its wounded characters, Lonergan’s film is a textured, poignant snapshot of heartbreak.
Loving (Focus Features): A specialist in naturalistic, absorbing tales set in the American South, filmmaker Jeff Nichols (“Mud,” “Midnight Special”) offers another intimate and poignant slice of life with this drama set during the Civil Rights movement, which earned Ruth Negga a well-deserved Best Actress Oscar nomination. Negga plays Mildred Loving, whose marriage to Richard (Joel Hedgerton) brings scandalous reactions in their small Virginian hometown. With interracial relationships still deemed illegal in the 1950s, the couple must endure prejudice that threatens to tear the budding apart family. Can their love stand stronger than fear? The plot sounds like a textbook example of big, preachy prestige releases, yet Nichols and his talented cast instead transform it into a delicate, dignified and deeply human account of emotional struggle and perseverance.
Mildred Pierce (Criterion): Joan Crawford won a Best Actress Oscar for her performance in this robust tale of maternal dedication, adapted from James M. Cain’s book and directed with more than a tinge of film noir by Warner Bros. studio stalwart Michael Curtiz ("Casablanca"). Crawford stars as the titular heroine, a struggling housewife whose crumbling marriage leaves her to take care of her two young daughters by herself. With dreams of opening her own restaurant, Mildred begins a romance with a smooth-talking playboy (Zachary Scott), leading up to a startling discovery with her snobbish, spoiled daughter Veda (Ann Blyth). Packing enough powerhouse intrigue for three features into its running time, this compulsively watchable classic would be impressively remade into a cable miniseries decades later—though there's no substitute for Crawford's intensity in the 1945 original.

Winter Poem
Winter’s Embrace
By Joanna Fuchs
When winter blows its cold breath everywhere,
And throws a chill white blanket on the ground,
The sun makes sparkling diamonds on the snow,
And trees with icy diadems are crowned.
It’s time to snuggle in for winter fun
In cozy places, maybe by a fire.
A good book and some cocoa feel just right
In flannels, sweaters, winter’s warm attire.
Winter’s gloom is comforting somehow,
As life retreats from its rushed and frantic pace.
We’re ready now to stay indoors awhile,
As we settle into winter’s calm embrace.

This Day in American History
1496 - Christopher Columbus concluded his second visit to the Western Hemisphere as he left Hispaniola for Spain.
1656 - In the colony of Virginia, suffrage was extended to all free men regardless of their religion.
1681 - English Quaker William Penn received a charter from Charles II, making him sole proprietor of colonial American territory of Pennsylvania.
1769 - Philadelphia merchants finally agree among themselves to support an inter-colonial no importation movement. Effective 1 April, they ban the import of nearly all British trade goods until the Townshend Acts are repealed.
1775 - The Transylvania Company sends Daniel Boone and 30 woodchoppers to cut the Wilderness Road from Fort Wautauga to the mouth of the Kentucky River.
1776 - "Common Sense" by Thomas Paine was published.
1776 - Charleston, SC set up an independent government under a temporary local constitution that was to be in effect until an agreement with England could be reached. John Rutledge was chosen president. This government, said to be the first independent government within the recognized borders of the colonies, successfully defended Charleston against the British army and fleet on June 28, 1776, thus freeing the South from attack for nearly three years. Culture was also flourishing here and New York City, Philadelphia, Boston, but most of all in Charleston. In the mid-eighteenth century, musical concerts were flourishing in the colonial centers, and musical societies, music dealers, and instrument makers all benefited. The first music society in America was founded in Charleston, the St. Cecilia Society, in 1762. In Europe, Charleston was considered the chief cultural center of the colonies, and many artists, actors and musicians chose to settle there when they immigrated to America. Other cities could boast of cultural achievements as well. In Boston, a group of gentlemen sponsored a concert in Faneuil Hall as early as 1744, and in 1754, the first concern hall in Boston was opened by Gilbert Dubois. Philadelphia boasted four organ makers who produced spinets and virginals as well as organs. “In 1762, the women of Charleston founded the St. Cecilia Society as a musical organization; however, by the 1840's, the society had become more of a cotillion club than an organization to provide quality music to the socially refined. The society held their largest ball annually during February (just before lent) in Hibernian Hall on Meeting Street. A contemporary remarked, "The membership remains exclusive and its affairs somewhat secret." Even today, the club remains secretive and its historical records and membership lists remain off-limits to non-members.”

1783 - USS Alliance under Captain Barry won the last naval battle of the Revolutionary War off Cape Canaveral
1785 - Thomas Jefferson was appointed minister to France, succeeding Benjamin Franklin.

1848 – The Mexican-American War ended with the ratification by the Senate of the Treaty of Guadalupe Hidalgo.
1849 - Besides being an attorney, Abraham Lincoln was an inventor, receiving a patent for a device for “buoying vessels over shoals” by means of inflated cylinders. He remains the only US President to do so.
1854 - Hallie Quinn Brown (d. 1949), women's right activist, was born Pittsburgh, PA.
1857 – The National Association of Base Ball Players was formed at a meeting in NYC. Twenty-two teams were represented and William Van Cott of the Gothams was elected president. The Association was the first formal governing body for baseball prior to which the development of baseball rules had largely been controlled by the prestigious New York Knickerbockers club. Despite the new Association's title, the members of the Association were clubs, not individual players, and it was in no way a national organization as all of the founding members were from the 5 boroughs that currently make up New York City. While the NABBP never became an organization of players, it managed to grow into its claims of being a national organization. By the end of the Civil War, it had grown to over 100 clubs hailing from all over the Union, and to over 300 by 1867.
1862 - The first paper money was issued in the US. The denominations were $5 (Hamilton), $10 (Lincoln) and $20 (Liberty).
1864 - Gen. Ulysses S. Grant was made general-in-chief by Pres. Lincoln, replacing Gen. Henry W. Halleck.

1874 – Purdue University admitted its first student.
1876 - Alexander Graham Bell transmitted the first telephone message to his assistant in the next room: “Mr. Watson, come here, I want you,” at Cambridge, Massachusetts. Born at Edinburgh, Scotland, Bell acquired his interest in the transmission of sound from his father, Melville Bell, a teacher of the deaf. Bell’s use of visual devices to teach articulation to the deaf contributed to the theory from which he derived the principle of the vibrating membrane used in the telephone. Bell’s other accomplishments include a refinement of Edison’s phonograph, the first successful phonograph record and the audiometer.

1902 - A United States court of appeals ruled that Edison did not invent the movie camera.
1903 - Playwright and politician Clare Booth Luce (d. 1987) was born at New York City. Luce wrote for and edited Vogue and Vanity Fair and wrote plays, three of which were later adapted into motion pictures, “The Women” (1936), “Kiss the Boys Goodbye” (1938) and “Margin of Error” (1939). She served in the US House of Representatives (1943-47) and Ambassador to Italy (1953-56), the first woman to be appointed ambassador to a major country.
1903 – Birthday of legendary trumpet player Bix Beiderbecke (d. 1931), born Leon Bismarck Beiderbecke in Davenport, Iowa. With Louis Armstrong and Muggsy Spanier, Beiderbecke was one of the most influential jazz soloists of the 1920s. His turns on "Singin' the Blues" and "I'm Coming, Virginia" (both 1927), in particular, demonstrated an unusual purity of tone and a gift for improvisation. With these two recordings, especially, he helped to invent the jazz ballad style and hinted at what, in the 1950s, would become cool jazz. "In a Mist" (1927), one of a handful of his piano compositions and one of only two he recorded, mixed classical (Impressionist) influences with jazz syncopation.

1938 – “Jezebel”, directed by William Wyler, opened in United States theaters. The film starred Bette Davis, Henry Fonda, George Brent, and Fay Bainter. Davis won her second Oscar as a ruthless Southern belle who goes too far to make fiancé Fonda jealous. Bainter received a Best Supporting Actress Oscar, and the film was nominated for a Best Picture Oscar. Bette Davis starred in a series of acclaimed films that won her Best Actress nominations for five consecutive years: “Jezebel” (1938), “Dark Victory” (1939), “The Letter” (1940), “The Little Foxes” (1941), and “Now, Voyager” (1942). In 1950, she won the New York Film Critics' Best Actress Award for her stunning performance as actress Margo Channing in “All About Eve”. Her career tapered off in the late 1950s but revived in 1962 with her leading role in “Whatever Happened to Baby Jane?” She spent most of the 1970s doing television work until cancer forced her to slow down. In 1977, she became the first woman to receive the American Film Institute's Life Achievement Award, and her filmography includes more than 80 works. She wrote two autobiographies, “The Lonely Life” in 1962 and “This 'N' That” in 1987, and has been the subject of many biographies. On top of all this, she became a song title in 1981. "Bette Davis Eyes" was written by Donna Weiss and Jackie DeShannon, and was made popular by Kim Carnes. It spent nine weeks at No. 1 on the Billboard Hot 100 and was Billboard’s biggest hit of the entire year for 1981. The recording won the 1982 Grammy Awards for both Record of the Year and Song of the Year. She died of cancer in 1989.
1938 - The day: the 10th of the month. The movies being celebrated were for the year 1937, whose numbers add up to 10 (1+9, 3+7); and it was the 10th Annual Academy Awards. We wonder if these winners were superstitious or had some reason to think that the number 10 was lucky. Two awards were won by "The Life of Emile Zola," a Warner Bros. movie, produced by Henry Blanke, Best Picture honors and Best Actor in a Supporting Role to Joseph Schildkraut. Other lucky recipients of the coveted prize awarded by the Academy of Motion Picture Arts and Sciences at Los Angeles’ Biltmore Hotel were Leo McCarey as Best Director for "The Awful Truth;" Spencer Tracy for his Best Actor role (Manuel) in "Captains Courageous;" Luise Rainer for her Best Actress role (O-Lan) in "The Good Earth;" Alice Brady as the Best Actress in a Supporting Role (Molly O’Leary "In Old Chicago") and Harry Owens for his Best Music/Song, "Sweet Leilani" from "Waikiki Wedding."
1939 – “The Little Princess,” starring Shirley Temple and based on Frances Hodgson Burnett's novel, opened in United States theaters.
1940 - Dean Torrance of the surfing music duo of Jan and Dean was born in Los Angeles. He went to the same high school I did, University High School in Los Angeles. He really was a “surfer.” In 1959, Dean and Jan Berry had their first top-ten hit, "Baby Talk," which was arranged by the then-unknown Herb Alpert. Their biggest success came in 1963 with the number-one song "Surf City," written by Brian Wilson of the Beach Boys. In 1966, Jan Berry suffered brain damage when his car rammed into a parked truck in Los Angeles. That ended Jan and Dean's career, although they have performed together occasionally since Berry's recovery in 1973. Dean Torrance turned to designing album covers as head of Kitty Hawk Graphics in Hollywood.

1945 - ATKINS, THOMAS E., Medal of Honor
Rank and organization: Private First Class, U.S. Army, Company A, 127th Infantry, 32d Infantry Division. Place and date: Villa Verde Trail, Luzon, Philippine Islands, 10 March 1945. Entered service at: Campobello, S.C. Birth: Campobello, S.C. G.O. No.: 95, 30 October 1945. Citation: He fought gallantly on the Villa Verde Trail, Luzon, Philippine Islands. With 2 companions he occupied a position on a ridge outside the perimeter defense established by the 1st Platoon on a high hill. At about 3 a.m., 2 companies of Japanese attacked with rifle and machinegun fire, grenades, TNT charges, and land mines, severely wounding Pfc. Atkins and killing his 2 companions. Despite the intense hostile fire and pain from his deep wound, he held his ground and returned heavy fire. After the attack was repulsed, he remained in his precarious position to repel any subsequent assaults instead of returning to the American lines for medical treatment. An enemy machinegun, set up within 20 yards of his foxhole, vainly attempted to drive him off or silence his gun. The Japanese repeatedly made fierce attacks, but for 4 hours, Pfc. Atkins determinedly remained in his fox hole, bearing the brunt of each assault and maintaining steady and accurate fire until each charge was repulsed. At 7 a.m., 13 enemy dead lay in front of his position; he had fired 400 rounds, all he and his 2 dead companions possessed, and had used 3 rifles until each had jammed too badly for further operation. He withdrew during a lull to secure a rifle and more ammunition, and was persuaded to remain for medical treatment. While waiting, he saw a Japanese within the perimeter and, seizing a nearby rifle, killed him. A few minutes later, while lying on a litter, he discovered an enemy group moving up behind the platoon's lines. Despite his severe wound, he sat up, delivered heavy rifle fire against the group and forced them to withdraw. Pfc. Atkins' superb bravery and his fearless determination to hold his post against the main force of repeated enemy attacks, even though painfully wounded, were major factors in enabling his comrades to maintain their lines against a numerically superior enemy force.
1945 - 300 United States B-29 bombers devastated Japan's capital in what became known as the Great Tokyo Air Raid in World War II. The firestorm they created killed 100,000 people.

1948 - Zelda Fitzgerald and eight other women were killed in a sanitarium fire in Asheville, North Carolina. Trapped on the third story, she died at age 48. Both she and her husband were alcoholics, which affected her earlier than it did F. Scott. (Here is corroboration of the date, but go back to the beginning and read the chronological series of her life to better understand their “condition.” Simply put: Once you become a pickle, you can’t go back to being a cucumber.

1966 - FISHER, BERNARD FRANCIS, Medal of Honor
Rank and organization: Major, U.S. Air Force, 1st Air Commandos. Place and date: Bien Hoa and Pleiku, Vietnam, 10 March 1966. Entered service at: Kuna, Idaho. Born: 11 January 1927, San Bernardino, Calif. Citation: For conspicuous gallantry and intrepidity at the risk of his life above and beyond the call of duty. On that date, the Special Forces camp at A Shau was under attack by 2,000 North Vietnamese Army regulars. Hostile troops had positioned themselves between the airstrip and the camp. Other hostile troops had surrounded the camp and were continuously raking it with automatic weapons fire from the surrounding hills. The tops of the 1,500-foot hills were obscured by an 800-foot ceiling, limiting aircraft maneuverability and forcing pilots to operate within range of hostile gun positions, which often were able to fire down on the attacking aircraft. During the battle, Maj. Fisher observed a fellow airman crash land on the battle-torn airstrip. In the belief that the downed pilot was seriously injured and in imminent danger of capture, Maj. Fisher announced his intention to land on the airstrip to effect a rescue. Although aware of the extreme danger and likely failure of such an attempt, he elected to continue. Directing his own air cover, he landed his aircraft and taxied almost the full length of the runway, which was littered with battle debris and parts of an exploded aircraft. While effecting a successful rescue of the downed pilot, heavy ground fire was observed, with 19 bullets striking his aircraft. In the face of the withering ground fire, he applied power and gained enough speed to lift-off at the overrun of the airstrip. Maj. Fisher's profound concern for his fellow airman, and at the risk of his life above and beyond the call of duty are in the highest traditions of the U.S. Air Force and reflect great credit upon himself and the Armed Forces of his country.

1967 - DETHLEFSEN, MERLYN HANS, Medal of Honor
Rank and organization: Major (then Capt.), U.S. Air Force. Place and date: In the air over North Vietnam, 10 March 1967. Entered service at: Royal, Iowa. Born: 29 June 1934, Greenville, Iowa. Citation: Maj. Dethlefsen was 1 of a flight of F-105 aircraft engaged in a fire suppression mission designed to destroy a key antiaircraft defensive complex containing surface-to-air missiles (SAM), an exceptionally heavy concentration of antiaircraft artillery, and other automatic weapons. The defensive network was situated to dominate the approach and provide protection to an important North Vietnam industrial center that was scheduled to be attacked by fighter bombers immediately after the strike by Maj. Dethlefsen's flight. In the initial attack on the defensive complex the lead aircraft was crippled, and Maj. Dethlefsen's aircraft was extensively damaged by the intense enemy fire. Realizing that the success of the impending fighter bomber attack on the center now depended on his ability to effectively suppress the defensive fire, Maj. Dethlefsen ignored the enemy's overwhelming firepower and the damage to his aircraft and pressed his attack. Despite a continuing hail of antiaircraft fire, deadly surface-to-air missiles, and counterattacks by MIG interceptors, Maj. Dethlefsen flew repeated close range strikes to silence the enemy defensive positions with bombs and cannon fire. His action in rendering ineffective the defensive SAM and antiaircraft artillery sites enabled the ensuing fighter bombers to strike successfully the important industrial target without loss or damage to their aircraft, thereby appreciably reducing the enemy's ability to provide essential war material. Maj. Dethlefsen's consummate skill and selfless dedication to this significant mission were in keeping with the highest traditions of the U.S. Air Force and reflect great credit upon himself and the Armed Forces of his country.

William Calley and other soldiers charged with murder and numerous crimes at My Lai 4 in Song My village. The My Lai massacre became the most publicized war atrocity committed by U.S. troops in Vietnam. Allegedly, a platoon had slaughtered between 200 and 500 unarmed villagers at My Lai 4, a cluster of hamlets in the coastal lowlands of I Corps Tactical Zone. Only 14, including Calley and Medina, were eventually charged with crimes. All eventually had their charges dismissed or were acquitted by courts-martial except Calley, who was found guilty of murdering 22 civilians. He was sentenced to life imprisonment, but his sentence was reduced to 20 years by the Court of Military Appeals and further reduced later to 10 years by the Secretary of the Army.
