David LaDuke, CEO, Sputnik, Inc., a wireless service company, Sausalito, California, contacted Leasing News as well as the CLP Foundation, National Equipment Leasing Association and National Association of Lease Brokers regarding a complaint against Matrix Business Capital

"In summary: we signed an agreement with Brian Acosta, CLP, of Matrix Business Capital, Long Beach, California, for an equipment lease with certain terms, and paid a deposit of $3,435.60.
"After it became clear that we were not going to close the deal on those terms, and Brian offered cancellation with a full refund, in writing, we followed the cancellation procedure.
"45 days later (after numerous emails to Matrix) we were told that we would not receive a refund.
"I have provided the most relevant documents that support our complaint but have a copy of all correspondence, emails, voicemail transcripts, etc. should those be needed." (1)
Matrix appears to have received a tentative approval, pending certain requests that Sputnik was unable to return to meet the deadline of needing the lease for new servers and installation as arranged.
He was told and then received the option by telephone and then email from Rodney Rambo " We can unwind and I have attached the instructions to request to cancel. We will issue a refund of your deposit if you chose to do this." (2)
June 26, 2013 he elected to follow the procedure of asking for a refund. (3)
After numerous telephone calls and attempts to contact Matrix, he received an email basically stating "Based on the contract, your transaction is not legally entitled to a refund."
He then went on line and via Google found this Leasing News story (4), then contacted the two leasing associations, the CLP Foundation, and Leasing News. On August 18, 2013 Brian Acosta, CLP, left a message threatening breach of contract, defamation of character law suit that is “going to cost a lot of money.” (5).
Sputnik was then sent an email to contact Matrix Business Capital legal, and David LaDuke responded that he wanted a full refund.
Leasing News also contacted Mr. Acosta regarding the complaint.
It appears Brian Acosta, CLP, contacted Rosanne Wilson, President of the CLP Foundation, who is also a member of the Leasing News Advisory Board (as well as past director of NAELB and current membership chairman). Mr. Acosta reportedly received a stern chat reportedly about how many of his fellow CLP's felt--- and to clear the current complaint up, she advised he should pay David LaDuke the deposit in full.
Acosta sent the money back ACH to Sputnik, who reports receiving it in full.

While the above Sputnik Bulletin Board Complaint was "settled," it is the policy of Leasing News, as noted on the web site and in other complaints: "Should a new complaint be posted, previous complaints that have not been posted, or removed as the matter has been satisfied, may be re-instated as per policy regarding the postings."

Leasing News withdrew the complaint regarding Bryan Kastleman when it was discovered one of the addenda referred to the first addendum matched a lease approval that was not exercised, a stipulation that if an approval was met and the applicant did not exercise it, the deposit was forfeited. The dollar amount of the addendum was different from the original, as well as it was an “Equipment Finance Agreement”—not a lease, so Mr. Kastleman's believed that all the addendums needed to be signed to match the original addendum ((Brian Acosta, CLP, had suggested splitting the original requests in multi-leases that did not require a financial statement and he “had an excellent credit rating.”)(1)).
Leasing News did not see any wording that made the addendum dependent on all of the addenda being approved and therefore Leasing News rejected the complaint. The question of the four months’ time period, lack of regulation "B" letters regarding the alleged turn down of seven funders, or background and previous complaints of Ability were not considered in the withdrawal. Nor was the behavior of the individual or code of ethics, which would be perhaps under the various associations and foundation (2)
What brings the complaint back is the lawsuit of Ability Capital Solutions to Bryan Kastleman as an individual as well as his company and John Does 1-20. It was received August 23, 2013, with the name of two lease associations, the CLP Foundation, and Leasing News.
The complaint procedure of the National Association of Equipment Leasing Brokers in their complaint procedure will not consider a complaint when an attorney gets involved. This may be one of the reasons for the summons, which may include all the associations named, CLP Foundation, as well as Leasing News and other parties involved, although the John Does are not specifically named in the complaint.
The Summons by Mark M. Scott, Esq., Buchalter Nemer, Irvine, California is a request for "compensatory and punitive damages, exceeds $25,000" plus $10,000 for other alleged offenses as well as attorney fees and court costs; with venue in Los Angeles County regarding the claims for return of deposit, as well as in the "Fourth Cause of Action:"
"...that Hill, Kastleman and DOES 1 through 20 contacted one or more third parties specifically for the purpose of attempting to harm Ability's reputation and business relationship within the financing industry and among financing customers in order to extract the return of more of the Deposit than that to which Hill was entitled. Among other things, Kastleman, acting individually and on behalf of Hill, submitted unfounded and inaccurate complaints, claims and other postings to various industry associations, trade publications and others within the financing industry. These defamatory statements were made to, among others, Leasing News, the National Association of Equipment Lease Brokers, the Equipment Lease Finance Association and the National Equipment Finance Association. Page 7. (3)"
"28. Ability is informed and believes and thereon alleges that the acts of Hill, Kastleman and DOES 1 through 20 are malicious, willful and oppressive in that they are intended to cause injury to Ability or were done with a conscious disregard of Ability's rights. Accordingly, Ability is entitled to an award of punitive damages according to proof at trial." Page 9 (3)

How Are You Doing?
This has been a good year for a lot of lessors and packagers because the economy is looking up and the pent up demand for equipment is beginning to show promise. However--- September is the month when you take a look at your successes… and failures… to fine tune your company plan. This applies not only to large operations, but also to small independents.
A broad based leasing effort works great in good times, but I can personally testify from my experience working with clients and my own active time in the business, it is the leasing company that controls a few markets that survives through the slow times. Now is the time to qualify your market and consolidate your effort to get your arms around a few markets. It takes a lot of effort to secure a strong market. If you fail to spend the required time to get control of a market then you are allowing competition to take business away from you.
The better you understand the equipment in each market, the smarter your proposals will be--- and by understanding the different uses for the equipment, your residuals will be fine-tuned, thereby giving you an advantage in that market. Your documentation will also be better as you qualify the rent based on the use and have additional rent for overuse.
A complete knowledge of the equipment’s use and future value will help you to be more competitive as well as t0 help you to become the most favored form of finance. Going to their trade shows and offering training in leasing and finance will support the vendor’s view of your ability to support their sales effort. Many vendors are afraid that leasing companies only care about getting the lease and are not interested or care which equipment is chosen. Once you gain the confidence of the vendor, a steady source of business will follow.
I know that any business seems to be good business but survival depends on years of business through good times and poor times. You must use the good times to reorganize your markets and get deeper into a few markets instead of being a generalist.
Take a good look at the business you were successful with and define what markets you want to emphasis and spend the rest of the year making as many inroads as possible. Don’t wait until after Christmas, put your thinking cap on and start planning in September for 2014.

Question: Emily, I am conducing a job search while I am still employed. I want to make sure I do not raise red flags – any advice?
Answer: Most “smart” candidates conduct job searches while still employed. If you suspect a layoff, you must start looking ASAP OR get CAUGHT in the flood when your colleagues (sometimes 100s of others) hit the market at the same time!
Additionally, keep your ears and eyes open if company changes might affect your compensation, geography, etc… are imminent.
Personally, I think you should let your employer know you are not satisfied where you are, as they may offer you something to make sure you are “happy.” If that is not possible where you work, then:
-
Make sure you use your home rather than your work office to conduct your search – request recruiters contact you before / after work hours / lunch hours or weekends
-
Even better, take some unused vacation to take a few days to reach out to your recruiter, have them work your resume and provide advice
-
Designated a line for employers / recruiters to reach you (e.g. cell phone)
-
Dedicate some time (e.g. 30 min upon getting home) every day towards your job search and stick to this schedule
-
The best way you can stretch your job search hours is to utilize a recruiter, make sure you stay loyal to your recruiter and do not “back door” them; they can wind up being your BEST ally in the job market!
Make Sure You …

Keep your intentions to yourself – do not share with anyone in the industry that you are searching for a new career opportunity
-
Keep your office items at the office – don’t start packing your belongings
-
Keep everything the same - e.g. keep the same hours, do not show a loss of interest in your current job, taking a lot of time off, etc…

Are strategic in planning chunks of time to interview - some employers will meet after hours and/or over the weekend

The 15 branches of Community South Bank, Parsons, Tennessee, are closing and CB&S Bank, Inc. Russellville, Alabama, is assuming all of the deposits.
Founded August 31, 1968 as Citizens State Bank , in 2000 the bank was merged with two other local banks: Bank of Adamsville and Lewis County Bank, changing its name to Community South Bank. As of March 31, 2013, the bank had 123 full time employees at their two offices each in Hohenwalk, Knoxville, Parsons, Savannah, and single offices in Adamsville, Counce, Lexington, and Scotts Hill. In 2007, the bank had 295 full time employees.

The six branches of Sunrise Bank of Arizona, Phoenix, were closed with First Fidelity Bank, National Association, Oklahoma City, Oklahoma, to assume all the deposits. Founded May 20, 1998 as Camelback Community Bank, the bank had 69 full time employees. December 14, 2009 as Sunrise Bank of Arizona acquired offices in Mesa, Glendale, Phoenix, and Scottsdale and had 113 full time employees are year end. The Nogales office was acquired January 24, 2011.

As reported in previous Bank Beat reports, this is one of Capitol Bancorp. problem banks. Since May 10, 2013, four other banks owned by Capitol Bancorp have collapsed – Pisgah Community Bank, Sunrise Bank (Georgia), Central Arizona Bank, and 1st Commerce Bank. In 2012, Capital Bancorp had 11 affiliated banks in Arizona.
The funny numbers starting in 2009 below reflect the merger of Mesa Bank and Arrowhead Community Bank, two of Capital Bancorp’s banks, under the Sunrise Bank of Arizona.

QSRmagazine.com
10,000 U.S. consumers were surveyed by Empathica, a global provider of Customer Experience Management (CEM) solutions to multi-unit enterprises.
American burger-brand guests were asked to rate their recent visit to a burger chain on a number of factors, and a “percent delighted” score was calculated by averaging ratings of overall satisfaction, likelihood of revisiting, value for money paid, and likelihood of recommending.
The Benchmark then ranked America’s top quick-service burger brands from highest percent delighted to lowest, with the ranks as follows:
In-N-Out Burger: 66 percent
Five Guys: 57 percent
Whataburger: 49 percent
Culver’s: 48 percent
Steak ‘n Shake: 46 percent
Krystal: 43 percent
Sonic Drive-In: 43 percent
Dairy Queen: 40 percent
Jack in the Box: 36 percent
White Castle: 36 percent
Carl’s Jr.: 35 percent
Hardee’s: 34 percent
Wendy’s: 34 percent
McDonald’s: 32 percent
Checkers: 30 percent
Burger King: 29 percent
Findings show that the top three burger brands by sales—McDonald’s, Burger King, and Wendy’s—are ranked at or near the bottom of guest satisfaction in almost all categories including food, staff, menu, and atmosphere.

Old Cowboy On His Horse
Followed by his faithful dog
An old cowboy was riding his trusty horse followed by his faithful dog along an unfamiliar road. The cowboy was enjoying the new scenery, when he suddenly remembered dying, and realized the dog beside him had been dead for years, as had his horse. Confused, he wondered what was happening, and where the trail was leading them.
After a while, they came to a high, white stone wall that looked like fine marble. At the top of a long hill, it was broken by a tall arch topped by a golden letter "H" that glowed in the sunlight.
Standing before it, he saw a magnificent gate in the arch that looked like mother-of-pearl, and the street that led to the gate looked like gold.
He rode toward the gate, and as he got closer, he saw a man at a desk to one side. Parched and tired out by his journey, he called out, 'Excuse me, where are we?'
'This is Heaven, sir,' the man answered.
'Wow! Would you happen to have some water?' the man asked.
'Of course, sir. Come right in, and I'll have some ice water brought right up.'
As the gate began to open, the cowboy asked, 'Can I bring my partners, too?'
'I'm sorry, sir, but we don't accept pets"
The cowboy thought for a moment, then turned back to the road and continued riding, his dog trotting by his side.
After another long ride, at the top of another hill, he came to a dirt road leading through a ranch gate that looked as if it had never been closed. As he approached the gate, he saw a man inside, leaning against a tree and reading a book.
'Excuse me,' he called to the man. 'Do you have any water?'
'Sure, there's a pump right over there. Help yourself.'
'How about my friends here?' the traveler gestured to the dog and his horse.
'Of course! They look thirsty, too,' said the man.
The trio went through the gate, and sure enough, there was an old-fashioned hand pump with buckets beside it. The traveler filled a cup and the buckets with wonderfully cool water and took a long drink, as did his horse and dog.
When they were full, he walked back to the man who was still standing by the tree. 'What do you call this place?' the traveler asked.
'This is Heaven,' he answered.
'That's confusing,' the traveler said. 'The man down the road said that was Heaven, too.'
'Oh, you mean the place with the glitzy, gold street and fake pearly gates? That's hell.'
'Doesn't it make you angry when they use your name like that?'
'Not at all. Actually, we're happy they screen out the folks who would leave their best friends behind.'

This Day in History
1791-John Fitch granted a patent for a steamboat after a dispute on the invention, but it wasn't until 1814 that Fulton and Livingston started
steam boating when they began to offer regular steamboat service between New Orleans , Louisiana and Natchez , Mississippi . The boats traveled at the rates of eight miles per hour downstream and three miles per hour upstream. It revolutionized commerce in the area, eventually spreading up the entire Mississippi and other tributaries.

1839 - The slave ship Amistad was captured off Long Island. The U.S.S. Washington, a U.S. Navy brig, seized the Amistad York, and escorted it to New London, Connecticut.
1847 - Liberia was proclaimed an independent republic. Freed American slaves founded Liberia. They modeled their constitution after that of the US, copied the US flag, and named their capital Monrovia, after James Monroe, who financed early settlers. Over the decades 16,400 former slaves made the voyage. They assumed that the 16 native tribes were there to be exploited.
1862 - The stage is set for the Second Battle of Bull Run on this day when Confederate cavalry under General Fitzhugh Lee enter Manassas Junction and capture the rail center. From August 26 until the beginning of Second Bull Run on August 29, Pope's men searched for Jackson, who had hidden his army in the trees along Bull Run. On August 29, Jackson surprised Pope and the battle was on. The rest of Lee's army showed up, and the result was a major victory for the Confederacy.
1865 - Civil War ends with naval strength over 58,500 men and 600 ships.
1867-The National Teachers Association was organized at a national convention attended by representatives of state teachers' association, who met in the Hall of the Controllers of the Public Schools in Philadelphia, PA. the organization was intended “ to elevate the character and advance the interest of the profession of teaching and to promote the cause of popular education in the United Sates. John L. Enos was chairman. At the conventional held in Cleveland , OH , on August 15, 1870, the name was change dot the National Education Association.
1873-The birthday of DeForest Lee, a brilliant inventor, who's inventions include the electron tube, radio knife for surgery and the photoelectric cell and a pioneer in the creation of talking pictures and television. Born at Council Bluff, IA, DeForest was holder of hundreds of patents but perhaps best remembered by the moniker he gave himself in the title of his autobiography, “Father of Radio,” published in 1950. So unbelievable was the idea of wireless radio broadcasting that De Forest was accused of fraud and arrested for selling stock to underwrite his invention that late was to become an essential part of daily life. DeForest died at Hollywood , CA , June 30, 1961.
1873-The first public school kindergarten class started this day by the Board of Education of St. Louis, MO, and officially opened September, 1873 in the Des Peres School, with an enrollment of 42. Susan Elizabeth Blow was the teacher. Dr. William Torrey Harris was the superintendent of schools. The
concept first started in Germany , thus the name of this organized and public “pre-school” class.
1874--Birthday of Zona Gale was the first woman to have a play on Broadway and the first woman to win the Pulitzer (1921) for drama. An ardent feminist and activist. Her writing style evolved throughout her life and her later works appear to be the works of a different writer.
1883-The biggest explosion in historic time, the eruption of the Indonesian volcanic island, Karakatoa(Krakatau) was heard 3,000 miles away, created tidal waves 120 feet high ( killing 36,000 people), hurled five cubic miles of earth fragments into the air ( some to a height of 50 miles ) and effected the oceans and the atmosphere for years.
1901- The New Testament of the ASV (American Standard Version) Bible was first published. This U.S. edition of the 1881 English Revised Version (ERV) comprised the first major American Bible translation since the King James Version of 1611.

1904-Birthday of Christopher Ishherwood, who lived in the Pacific Palisades when I was growing up and we ran into him often in coffee shops with his close male companion. Isherwood was an author of short stories, plays and novels, born at High Lane Cheshire , England . The play and motion picture “I am a Camera” and the musical “Cabaret” were based on the short story, “Sally Bowles” in his collection from the 1930's titled “ Goodbye to Berlin,” which contained the line, “ I am a camera with its shutter open, quite passive, recording not thinking. “ Isherwood died at Santa Monica , CA , Jan 4, 1986.
1904-Birthday of alto sax player Buster Smith, born Ellis County, Texas.
1906-Birthday of American medical researcher Albert Bruce Sabin, born at Bialystok , Poland . He is most noted for his oral vaccine for polio, which replaced Jonas
Salk's injected vaccine because Sabin's provided lifetime protection. He was awarded the US National a Medal of Science in 1971. Sabin died March 3, 1993, at Washington , DC .
1920-The 19 th amendment was certified and became part of the US Constitution. Known as the Woman's Equality Act, it prohibits discrimination on the basis of sex with regard to voting. It was a long time coming, actually submitted in 1868 to Congress and at intervals thereafter without much success. It actually passed the Congress on May 21, 1919, and by the Senate on June 4. It was ratified by Illinois , Wisconsin , and Michigan on June 10. Tennessee was the 36 th state to ratify, on August 18, thus completing the necessary three-quarters of the states to put the amendment into effect. (not all the states ratified this amendment, by the way, while there were states that allowed women to vote in state and local elections, but not national elections ).
1924-Birthday of singer Frances Wayne, born Boston , MA .
1937- Pumping to build Treasure Island in San Francisco Bay is finished. The

1927--Birthday of 1827 Annie Turner Wittenmeyer who spent at least $130,000 of her own money and personally carried food and supplies to the front as well as to wounded soldiers in hospitals during the Civil War. She developed special diet kitchens for army hospitals because the food was so bad.
1939-The first major league baseball game to be shown on television was a double-header played at Ebbets Field, Brooklyn New York City between the Cincinnati Reds and the Brooklyn Dodges. Both games were televised by station W2XBS, New York City , using two cameras that alternated , according to the play. During the intermission, there were appearances by Leo Durocher, manager of the Dodges, William McKenchie, manager of the Reds, and several players. Walter Lanier “Red” Barber was the announcer.

Handrich, Company C, distinguished himself by conspicuous gallantry and intrepidity above and beyond the call of duty in action. His company was engaged in repulsing an estimated 150 enemy who were threatening to overrun its position. Near midnight on 25 August, a hostile group over 100 strong attempted to infiltrate the company perimeter. M/Sgt. Handrich, despite the heavy enemy fire, voluntarily left the comparative safety of the defensive area and moved to a forward position where he could direct mortar and artillery fire upon the advancing enemy. He remained at this post for 8 hours directing fire against the enemy who often approached to within 50 feet of his position. Again, on the morning of 26 August, another strong hostile force made an attempt to overrun the company's position. With complete disregard for his safety, M/Sgt. Handrich rose to his feet and from this exposed position fired his rifle and directed mortar and artillery fire on the attackers. At the peak of this action he observed elements of his company preparing to withdraw. He perilously made his way across fire-swept terrain to the defense area where, by example and forceful leadership, he reorganized the men to continue the fight. During the action M/Sgt. Handrich was severely wounded. Refusing to take cover or be evacuated, he returned to his forward position and continued to direct the company's fire. Later a determined enemy attack overran M/Sgt. Handrich's position and he was mortally wounded. When the position was retaken, over 70 enemy dead were counted in the area he had so intrepidly defended. M/Sgt. Handrich's position and he was mortally wounded. When the position was retaken, over 70 enemy dead were counted in the area he had so intrepidly defended. M/Sgt. Handrich's sustained personal bravery, consummate courage, and gallant self-sacrifice reflect untold glory upon himself and the heroic traditions of the military service.

1964-Lyndon Baines Johnson was nominated at Democratic convention in Atlantic City , NJ , after assuming the presidency from the death of John F. Kennedy in 1968; Senator Hubert Humphrey of Minnesota was nominated for the vice-presidency. The Gulf of Tonkin Resolution , a joint resolution approving U>S. action in Southeast Asia , was passed by Congress less than twenty days earlier. In September, the Warren Commission would report the assassination of John F. Kennedy was by one lone person, Harvey Oswald, and that Jack Ruby, convicted murdered of Oswald, had had no prior contact with Oswald. In November, Johnson would gain 486 electoral votes over Sen. Barry M. Goldwater, 52, with a popular vote split of 43,126,506 to 27, 176,799. The Democrats would gain one senate seat for a 68-32 majority, and 37 House seats for a 296-140 majority. Johnson would think it was his “hawk” stand and being a “leader” that got him the position, not the television ads of the atomic bomb explosions that told this would happen if Goldwater were chosen. The death of JFK was still in everyone's mind, and Johnson being sworn in with Jackie Kennedy on the airplane was vivid.

1967--- The Beatles follow their favorite new lecturer, the Maharishi Mahesh Yogi, to University College in Bangor, North Wales, along with Mick Jagger and his girlfriend Marianne Faithfull. After his lecture the group holds a press conference to announce that they've become his disciples in the "Spiritual Regeneration Movement" and officially renounced the use of all drugs.
1967-DAY, GEORGE E. Medal of Honor Rank and organization: Colonel (then Major), U.S. Air Force, Forward Air Controller Pilot of an F-100 aircraft. Place and date: North Vietnam, 26 August 1967. Entered service at: Sioux City, Iowa. Born: 24 February 1925, Sioux City, Iowa. Citation: On 26 August 1967, Col. Day was forced to eject from his aircraft over North Vietnam when it was hit by ground fire. His right arm was broken in 3 places, and his left knee was badly sprained. He was immediately captured by hostile forces and taken to a prison camp where he was interrogated and severely tortured. After causing the guards to relax their vigilance, Col. Day escaped into the jungle and began the trek toward South Vietnam. Despite injuries inflicted by fragments of a bomb or rocket, he continued southward surviving only on a few berries and uncooked frogs. He successfully evaded enemy patrols and reached the Ben Hai River, where he encountered U.S. artillery barrages. With the aid of a bamboo log float, Col. Day swam across the river and entered the demilitarized zone. Due to delirium, he lost his sense of direction and wandered aimlessly for several days. After several unsuccessful attempts to signal U.S. aircraft, he was ambushed and recaptured by the Viet Cong, sustaining gunshot wounds to his left hand and thigh. He was returned to the prison from which he had escaped and later was moved to Hanoi after giving his captors false information to questions put before him. Physically, Col. Day was totally debilitated and unable to perform even the simplest task for himself. Despite his many injuries, he continued to offer maximum resistance. His personal bravery in the face of deadly enemy pressure was significant in saving the lives of fellow aviators who were still flying against the enemy. Col. Day's conspicuous gallantry and intrepidity at the risk of his life above and beyond the call of duty are in keeping with the highest traditions of the U.S. Air Force and reflect great credit upon himself and the U.S. Armed Forces.

1968-Democratic Party Convention in Chicago: Yippie activist Abbie Hoffman protested a decision to forcibly drive people out of the park. Tom Hayden was arrested in the afternoon for a certain squad car incident. Hoffman and Jerry Rubin allegedly urged demonstrators to hold Lincoln Park. Rennie Davis urged demonstrators "Don't let the pigs take the hill (high ground near a statue in the park)". About 3,000 demonstrators gathered chanting, singing songs, and talking and were attacked by police with clubs and tear gas after the 11 pm curfew.Meanwhile Mayor Richard Daley opened the Democratic National Convention.

1969--Although Elvis Presley has written a soprano part for backup singer Cissy Houston during "Are You Lonesome Tonight?" her actual live performance of it tonight at the International Hotel in Vegas strikes Elvis as amazingly funny for some reason, leading to a collector's classic: a performance where the King cannot stop laughing. "That's it, man, fourteen years right down the drain," he jokes as the song ends.

1987 - The Fuller Brush Company announced plans to open two retail stores in Dallas , TX . This was a first for the company that had sold its products door to door for 81 years.
1987-Sonny Bono, who once said that he never voted until age 53, announced that he was running for mayor of Palm Springs, California. Sonny said he was frustrated over the red tape he faced for a remodeling project at his Italian restaurant. He would win the election in 1988 and serve until 1992. He failed in a Senate race later that year, but won a seat in Congress in 1996. Bono died in a skiing accident on January 6th, 1998, at the age of 62.
