We do not do Evergreen leases. Although our leases do not have a provision for renewals we do offer a 6 to 12 month fixed term renewal to our lessees when they reach the end of term if they have paid well or if the P.O. is a fairly sizable amount. At the end of the renewal term they own the equipment for $1.00.

The actual end of term option is to purchase for 10% plus other taxes and assessments then due or return the equipment.

Our lessees have been very receptive to our renewal option and we always notify lessees at least 30 days in advance of lease end.

Does Subprime Leases

We do use an “evergreen clause” in our master lease, but we proactively communicate with our clients prior to the end of the lease term regarding their purchase options. Most of our leases have a fair market value purchase option with a cap and it is important for us to reach agreement with the client on a purchase price prior to the termination of the lease schedule. (All of our clients have multiple schedules under their master lease, so they are familiar with our process.)

We have had a few clients choose to extend on a moth-to-month basis and we always credit those payments to the purchase if and when they buy the equipment. We also allow clients with a good payment history to pay their buyout over 6 to 12 months if they prefer to.

In our business of leasing technology equipment which is deployed in thousands of locations, the evergreen renewal is an important tool only in the event that a client says they will not buy the equipment and they will not return it in working condition.

Bankers Capital’s policy and procedure at the end of the Lease term is to bill for the residual assuming there is no continuing default and the Lessee has satisfied its Lease Obligations. We either get paid or we will even work with them to stretch it out over a few months for cash flow reasons. We only do true Leases and do not do 1.00 out Leases. So we do notify all Lessees. We would rather have repeat business with a new Lease than a pissed off customer with renewal payments for who knows how long.

Our Lease documents do state that they either return the equipment, purchase the equipment, or if they choose neither, then the Lease will renew automatically month to month. We prefer that they exercise their purchase option and we try and make it easy for them to do that.

Side comments to Lessors who insist on Evergreen clauses and deceptively collecting on them: IF you can’t get your yield on the stream plus the intended residual, Don’t Bait and Switch to get it. That is what gives our industry and Lessors a bad reputation. If you keep it up, it won’t be long before we become regulated. When that happens, it will cost you more to stay in business under those regulations and you will make less money in the long run. And guess who will regulate you???

First we don't have a discounting program. We do however allow a broker to "own" the residual. But we only allow transactions to be documented using our document which does not contain an evergreen clause.

BSB Leasing, Inc. generally does not take a residual position in the leases we write for our own portfolio. We either write $1 purchase options or PUTS. We do not have an evergreen clause in our lease or EFA contracts. In the rare event that we do take a residual position we do notify the client when the agreement is coming to term and a residual is due.

We do not discount with anyone so that's not an issue; everything is on our docs.

We do indeed have a thorough notification process that includes layman, written notices on FMV style leases at 90 days before expiration, at expiration and post expiration to all of our lessees.  I'd add that any renewal payments contractually are at 50% of the regular payment and is month-to-month.  We are cognizant of the negative ramifications that "evergreen" brings to our firm, our brokers and industry and do our best to avoid any and all abuses.  We think our processes are tilted to the benefit of our customers as they should be.

It was only a couple of weeks ago when I spoke to Jeff Taylor in the hospital. He and I had been friends for years and I have a couple of the remarkable books he has written. On the phone at the hospital, he talked so much about wanting to go home and do his gardening, and plant flowers, and get his hands dirty. He loves working in the yard. He was so very focused on getting out of that hospital and coming home. He had such a passion for his yard and I felt that his attitude was so great & full of hope that he would be home soon. I never figured we would lose him, especially this soon. He sounded so tired on the phone, yet he wanted to keep talking. I feel so privileged that I got to speak to my long time friend before he passed on. We even had a couple of laughs. He gave me encouragement to keep fighting with my own battle against Cancer. We talked about each other's treatments and it seemed to help both of us to have each other to talk to. He seemed more worried about me than himself. Incredible. We were good therapy for each other. I hope I helped his remaining time in some small way. I know he sure inspired me to tough it out and get through the treatments. He is now with God and in no more pain. Perhaps there are even flowers up in heaven that Jeff can enjoy. He was truly a remarkable man who touched many lives and I will remember him always. God bless you Jeff and may you have eternal peace and happiness.

P.s. - I feel sad for you Kit. I know he was a long time friend of yours. Don't beat yourself up for not calling him each week. You did a damn good job of reaching out to him. He slept so much of the time too Kit. (just like me) There were many times you probably tried to call but he was not awake and his wife and/or the nurses didn't want to wake him up. Thanks to you for telling Jeff that I also wanted to call and talk to him. I thank God I had at least the one nice chat with Jeff. I really did not expect him to die this quick. In fact, I thought there was still a possibility they could get him turned around. Perhaps that was wishful thinking. Agility Ventures Announces Third Investment Fund;
First Two Funds Provide Healthy Returns on Broadband Financing

Lease Fund III Widens Net of Investment Opportunities to Include Solar, Data Services, GPS and Web Services


(Prescott, Ariz.)– Agility Ventures, a leader in the leasing and financing of early-stage technology and broadband companies, is pleased to announce the closing of their third investment fund. The Agility Fund lll will participate in a broad range of technology, investing in opportunities from broadband to medical devices. All of the investments that the third fund will take part in show a promising future of rapid growth and recurring revenue. The funding has been raised from accredited investors located all across the United States.

“Our success has been due to cautious investments in early stage companies with recurring revenue for mission-critical services,” said Hal Hayden, managing partner of Agility Ventures. “Because our investment model mitigates much of the risk associated with rapidly growing early-stage technology companies, we will stick closely to it as we expand our footprint.”

Agility launched its first fund in 2004 with a three-year investment window to finance capital equipment for the wireless broadband industry. All capital was returned to investors by the end of 2009 and income is still being distributed. Funds two and three have been larger than the first fund; however, both have followed the proven path of the previous funds. The Agility Lease Fund III was organized and raised by Hal Hayden and Bill MacNamara over the course of four months. All Agility funds are characterized as venture debt funds, designed to provide funding for early stage companies that need capital for immediate growth. Typically, Agility comes in alongside funding from angels or VC’s, leveraging the equity already invested in a company. Funding support of this nature is attractive to both the client company itself as well as the equity investor due to the fact that it provides the needed capital without having to organize an additional equity round.

Ernie Strauch, an Agility investor, goes on to say, “Over the years Agility has proven to deliver on their investments, often going far beyond traditional yields. Their portfolio is dynamic and their service and transparency is unmatched. I was excited to be a part of this third fund.”

Agility will widen its reach with this fund to include data centers, solar, Software-as-a-Service (SaaS) and GPS among other technologies. Agility’s approach to investing is a fully managed, monitored process, earning them a reputation of integrity and trust over the past seven years. Virtually all of Agility’s investors in the first two funds elected to participate in the third. To date, Agility has made six investments from their third fund, providing commitments of $4.3 million.

"Spencer is a 2 year old Bichon Frise poodle mix. He is short and compact and is a healthy, happy young 11 pound boy. Spencer has very soft white fur with light tan ears. His coat is hypoallergenic and non-shedding. He has short little legs and he trots around very busily, investigating everything around him. Spencer is loving and friendly and seems able to adjust easily to his surroundings. Spencer was a victim of pet overpopulation - brought into a very overcrowded shelter where he was subsequently placed on the euthanasia list due to lack of space. He was rescued on his last day and we are so happy to give him a second chance. There is no question he deserves it. He is a first class dog and we are amazed that he was even in the shelter in the first place. Spencer is eager to please, smart and very willing. He loves to go for walks and should fit in to pretty much any household. He needs someone to show him what love and loyalty are all about and we are sure he would be thrilled to return the favor."

Spencer’s adoption donation is $350. He has been NEUTERED, MICROCHIPPED, VACCINATED, DEWORMED, DEFLEAED and PROFESSIONALLY GROOMED. Also included is his collar with ID, harness, leash, folder with all of his records, a great PETCO coupon book, and a fun goodie bag with toys, etc.

Spencer is being fostered by Pet Match Rescue Foster Volunteer, Amanda and is ready for his forever home.

This Day in American History

      1585 - A group of 108 English colonists, led by Sir Richard Grenville, reached Roanoke Island, North Carolina. Roanoke Island near North Carolina became England's first foothold in the New World. Sir Walter Raleigh sent a detachment of 108 men to build a fort on the island. The detachment included two scientists, Thomas Hariot, a surveyor, mathematician, astronomer and oceanographer, and Joachim Gans, a metallurgist.
    1729—Birthday of Minuteman John Parker. “Stand your ground. Don't fire unless fired upon, but if they mean to have a war, let it begin here.” Captain John Parker to the company assembled on Lexington Green.http://memory.loc.gov/ammem/today/jul13.html 
    1787- the Continental Congress enacted a slavery ban for a territory of the United States. The law prohibited slavery forever within the borders of the Northwest Territory, a region east of the Mississippi River, north of the Ohio River, south and west of the Great Lakes, and west of Pennsylvania.     1821--I am sorry to report this is an official holiday in the State of Tennessee, where they celebrate the birthday ( 1821) of Forrest Nathan Bedford. He is a Confederate cavalry commander who was also one of the founders of the original Klu Klux Klan. The KKK was composed of many ex-Southern Civil War soldiers, almost as if it were a “veterans organization.”
    1832 - Ethnologist Henry R. Schoolcraft was the first white person to arrive at the source of the Mississippi River at Lake Itasca, Minnesota. A pioneer in Native American studies, Schoolcraft conducted ethnological research among the Ojibwa in the Great Lakes region.
    1863-starting today and lasting until July 16, antidraft riots broke out in New York City. Modern history's bloodiest riot began when a mob of 50,000 Civil War draft protesters burn buildings (including an orphan asylum), stores and draft offices, attack police. Some club, lynch and shoot large numbers of blacks, who they blamed for the war. Rioters were protesting the provision allowing true red-blooded flag-waving Americans to make cash payment in place of serving in the army. When troops returning from Gettysburg finally restored order, 1,200 were dead.
    1863-- Mary Emma Woolley birthday, president of Mt. Holyoke College (1900- 1937) who under strong leadership expanded it to a major learning institution.
   She was voted one of the 12 most influential women in America.
    1865 Horace Greeley advises his readers to "Go west young man.”
    1868 --Oscar J Dunn, former slave, installed as lieutenant governor of Louisiana.

    1973 - During a concert at the John Wayne Theatre in Buena Park, California, the Everly Brothers broke up. Right in the middle of the concert Phil Everly walked off the stage, brother Don said, “The Everly Brothers died ten years ago.”  They recently joined together to sing with the “Simon and Garfunkle” Tour, as both Paul Simon and Art Garfunkle have acknowledged they started singing together to become just like their idols, the Everly Brothers.

    1984 - When sportscaster Howard Cosell asked to leave "Monday Night Football," saying he was “tired of being tied to the football mentality." Roone Arledge gave him what he wanted, and a year later, Cosell was removed from television altogether. 
    1985 - Simultaneously, the "Live Aid" concert, for African famine relief, occurred in Philadelphia, Pennsylvania and London, England. Performances from JFK Stadium in Philadelphia, London's Wembley Stadium and other venues were broadcast world-wide and raising over $70 million. The all-day and most-of-the-night concert showcased some of rock 'n' roll's biggest names including Mick Jagger, Tina Turner, Madonna, Bob Dylan and Paul McCartney. The concert was attended by 162,000 people, while 1.5 billion people watched the show from their televisions. Bob Geldorf, singer for Boomtown Rats organized the "Live Aid" concert and was responsible for gathering the big name stars, all of agreed to perform without pay. 
    1985 - "A View to a Kill," from the James Bond movie of the same name, performed by Duran Duran, went to the top of the record charts, staying on top for two weeks. Both themes from James Bond movies, "Live and Let Die" by Wings and "Nobody Does It Better" by Carly Simon only reached number two on the record charts.

    1987-Representatives of fifty of America's largest record retailers are guests at Michael Jackson's home in Encino, California to preview his new album, "Bad". The LP, which includes the singles, "I Just Can't Stop Loving You", "Bad", "The Way You Make Me Feel", "Man in the Mirror" and "Dirty Diana", would go on to reach number one on the Billboard Hot 200 chart and sell over 30 million copies worldwide.
    1989 - A thunderstorm at Albany, GA, produced 1.40 inches of rain in forty minutes, along with wind gusts to 82 mph. Afternoon highs of 98 degrees at Corpus Christi, TX, 110 degrees at Tucson, AZ, and 114 degrees at Phoenix, AZ, equaled records for the date. Greenwood, MS, reported 55.65 inches of precipitation for the year, twice the amount normally received by mid July.
    1995-Rush vocalist Geddy Lee sings "Oh Canada" before the All-Star Game at Baltimore's Camden Yards. 
    1995 - The temperature in Chicago, Illinois reached its all-time high -- 106 degrees (Fahrenheit) -- recorded at Midway Airport.
