Ernie Reinhardt Reportedly Guilty 13 Counts

Readers may remember one of the original “alerts” being Tech Com in 2001, where allegedly Ernie Reinhardt had a leasing

company in Southern California with investors, where he reportedly he set up a phony computer vendor called "Tech-Com" (aka Universal Equipment – circa 1999) with multiple lessee's (conspirators) in California and Maryland. Once paid, would kick back a portion of the equipment cost back to the lessees. No equipment would ever be delivered. The losses are in the millions, per the government's lawyer.

Inspector Reardon from the United States Postal was the lead federal investigator, working with the United States Attorney and the FBI who originally brought down a 13 charge Federal indictment against 19 individuals. The trial was originally set for Jan. 5th, 2004 in Baltimore, Maryland, but postponed several times.

Reinhardt and others reportedly were convicted on all 13 counts; sentencing will be in March, 2005.

“The principal of this company was Ernest Robert Reinhardt ("Ernie")

and he is the ring leader of Tech Com, the current vendor being investigated for fraud. Research reveals that Universal Equipment approached at least three funding sources, all which had direct vendor programs (Advanta, Orix,ABL), in the summer of 1999 to get approved as a vendor on the respective vendor finance programs. Well, Ernie and Universal blundered when they submitted financials to one source to get approved, problem was they used the exact same financials as those that they submitted on behalf of one of their clients. So you may want to again search your database for a vendor named Universal Equipment with principal being Ernest Robert Reinhardt It was learned that one of the above 3 sources looked at a minimum of 6 deals before pulling the plug on Universal as a potential vendor. Kendra Bernal Sentencing Postponed Until March 9th

This is the fifth postponement of the sentencing of Kendra Bernal, now scheduled for March 9th in Superior Court, Riverside, California.

Steven Counelis, prosecuting attorney for the Riverside County District Attorneys office said Kendra Bernal had plead guilty to the charges, “...but there are details we are still working out” and thus the reason for the postponement.

Counelis added, “ Please tell your readers that they should be doing business with well established companies, with well established reputations, rather than with people who make promises and advertise these misleading promises...”

Many leasing brokers lost their commissions, their clients, their vendors, and one popular attorney never got paid for representing the woman with a conviction record as long as his arm. Leasing News sent out many alerts and posted complaints until she was arrested, and then later was closed by the Nevada attorney general's office.

After working with Growth 1, Bernal set up two companies in Southern California, then when the State of California Department of Corporations closed her down (she had a Chapter 11 bankruptcy, was on parole, and no Finance Lender's License.)

The company acquired a new “president,” apparently in name only, then moved the operation to Nevada. The Nevada Attorney General caught on pretty quickly, reportedly catching the company engaging in the same practices here in California: collecting advance rentals, but not funding leases. He told us off the record, “ I don't want any of these California leasing companies operating in my state. Tell your readers these type of people may operate in your state, but not ours.

Stay in California.”

Bernal's own attorney, active is several equipment leasing associations, was stiffed by her for $15,000 in non-payment for defending her. He never asked her for a retainer, as he “trusted” his client. When the well-known leasing industry attorney complained to the judge about the money owed, he instructed him to continue in her defense on this case without pay.

It should be noted that those who do not believe a California Finance Lender's license is necessary to do business in this state, here is an example of a company working without a California Finance Lender's license. All the transactions that were put lost their recourse to lessee's on transactions as they now would be considered usurious because the originator was no licensed. The California Department of Corporation also had the legal power to shut down the company with a legal “cease and desist” order.

LN in the Minority on Settlement for NorVergence Lessees

Leasing News believes settlement is the best and less costly avenue to take for both sides in the NorVergence leasing “dispute.” We have published two editorials on our position. It appears to be in the minority. Other trade publications, and associations, have taken a hard line.

The Monitor, who has a web site, www.monitordaily.com, and also a monthly magazine and newspaper, reportedly the largest printed circulation in the industry, in their February edition, 2005, includes a legal viewpoint by Stan Goldberg and Steven Karlin of the New York law firm of Platzer, Swergold, Karlin, Levine, Goldberg & Jaslow,LLP, well respected in the industry and representing "numerous companies in the equipment leasing industry.

Here is the conclusion of the article “NorVergence Calamity: Challenging “Hell or High Water” and the Enforcement of Assigned Leases:”

“In an attempt to avoid class certification issues, at least one law firm has apparently obtained hundreds — if not thousands — of individual plaintiffs as clients and brought mass lawsuits on behalf of hundreds of individually, named plaintiffs against each individual leasing company. While avoiding the class certification quandary, these individual mass actions may eventually be severed by the courts into hundreds of separate actions by individual plaintiff-lessees, thus placing them in the same posture as the single pre-emptive suits previously described.

“Finally, the NorVergence bankruptcy has brought forth numerous actions by the attorneys general of several states. These are probably the actions of greatest concern to the leasing industry. This is not because the AGs have better facts or claims under the law; they don't. But the AGs are not constrained by litigation budgets and, often, are motivated by an internal agenda to champion the rights of the "consumer" against perceived offending business or financial institutions. (1) Thus, the AGs appear to be seeking not only relief under the NorVergence leases but to effect a fundamental change in the way leasing companies operate in the future.

“The AGs are, in essence, seeking to change laws governing lease financing, not through elected representatives of the state legislatures, but by the threat of costly and protracted — even if unwarranted and legally unsupported — litigation.

“Conclusion “As each day passes, there are practical and procedural developments emanating from the various pending legal actions, each of which has an impact, profound or subtle, on the broad challenge to the leasing industry posed by NorVergence. The NorVergence situation remains dynamic and fluid, and the leasing industry is advised to follow all developments carefully as the ultimate impact of NorVergence has not yet been determined. It is imperative that the leasing industry protect and defend the basic principles that it has thrived under, including "hell or high water" provisions and the safeguard of waiver of defenses remaining enforceable by assignees.

•  “The equipment leasing industry accurately and steadfastly maintains that the rental agreements are not “consumer” leases since the Matrix Boxes are clearly intended for business usage and since, among other factors, the form rental agreement states clearly on its face that the lessee agrees that the equipment “...will not be used for personal, family or household purposes.” Nonetheless, the AGs and private plaintiffs contend otherwise.”

ORIX Announces Net Income Up 48% in the Nine Months
Ended December 31, 2004

TOKYO--( ---ORIX Corporation (TSE:8591) (NYSE:IX), a leading integrated financial services group, today announced that revenues in the first nine months of the fiscal year ending March 31, 2005 increased 19% year on year to 611,903 million yen, income before income taxes(a) rose 40% to 113,458 million yen, and net income grew 48% to 67,718 million yen.

Revenues for "direct financing leases," "residential condominium sales," and "gains on sales of real estate under operating leases" were down compared to the same period of the previous fiscal year. However, revenues from "operating leases," "interest on loans and investment securities," "brokerage commissions and net gains on investment securities," "life insurance premiums and related investment income" and "other operating revenues" grew during the period. On the other hand, expenses for "interest expense," "costs of residential condominium sales" and "provision for doubtful receivables and probable loan losses" decreased while "depreciation-operating leases," "life insurance costs," "other operating expenses" and "write-downs of long-lived assets" increased in the same period. Furthermore, "equity in net income of affiliates" and "gains on sales of affiliates" contributed to the higher earnings.

    1517- Francisco Hernandez de Cordova sailed from Cuba with three ships to procure slaves for the mines as Columbus was bringing many slaves back to Europe. He landed on the Isla de las Mujeres, to which he gave this name because the idols he found . He and his crew became the first Spaniards to purposefully reach the mainland of what is now Mexico . He died after an encounter with Mayan Indians. Some say he landed in Florida, where he actually passed away from the wounds from the battle.

    1865- Martin Robinson Delany, received his commission and became the first Army major who was African-American. He was stationed in Charleston, South Carolina.
    1881- Frederic Ives, a photographer at Cornell University, Ithaca, NY received a patent for a halftone printing plate for reproducing photographs in books, magazines, and newspapers. In 1878 he converted negative into a screen gelatin relief from which he made a printing plate with good fidelity. He further developed this, which revolutionized the printing industry.
    1885-- The City of Tokio arrived in Honolulu carrying the first 944 official migrants from Japan to Hawaii.
    1887- President Cleveland signs the Dawes Land Allotment Act, dissolving Indian tribes as legal entities. It distributes territory held in common by American Indian nations to individual families. Each family is to get 160 acres. All other land will be sold, with proceeds going to an educational trust fund.
The Dawes Land Allotment Act entitled each family on the Great Sioux Reservation to own 160 acres. Since the reservation contained twice the land needed for allotments, the law dispossessed the Sioux of half their rightful territory. The Act ultimately results in the loss of tens of millions of acres of treaty land. "The commune shall give way to the dignity and rights of American citizens . . . the heathen idols shall give place to the Christian altars, and . . . the tribal organization shall be broken up and the individuality of the Indian encouraged and developed, and the lands unnecessarily reserved for them opened to the pioneer [so that] intelligence and thrift may find lodging there."

    1889- the first production of steam tractors were loaded on a car at San Leandro, California, designed and made by Daniel Best. They were called the Best Tractor. Until gasoline powered engines came along, the steam tractor was the Best.
    1899- blues guitarist and singer Lonnie Johnson was born in New Orleans. More respected for his playing than his singing, Johnson developed his distinctive style as early as 1927 when he recorded with Louis Armstrong's Hot Five. Johnson's 1948 recording of "Tomorrow Night" was very popular, spending seven weeks on Billboard's rhythm-and-blues chart, and even making the top 20 of the pop chart. From the mid-1960's, he spent much of his time in Toronto. Lonnie Johnson suffered a stroke after a serious accident in 1969, and died the following year.
    1906- Birthday of Henry Roth, American author who gained first international fame with his novel Call It Sleep (1934). Originally seen as an important proletarian novel of the 1930s, it was soon out of print and forgotten, but in the 1960s it was hailed as the finest Jewish-American novel of the first half of the century and one of the richest modernist novels to appear in America. Roth published no other novels until 1994, working several jobs, among others as a precision metal grinder, mental nurse, poultry farmer, and teacher. Died 1995.

    1952- Webb Pierce entered the Billboard country chart for the first time with "Wondering." Pierce dominated the country charts in the 1950's with his pure honky-tonk sound.     1954 – Beat author Jack Kerouac, hitchhiking from NY on the 27th of January, visits Neale and Carolyn Cassady in Los Gatos, California, not too far from where I live. .     1960- the US Congress opened hearings on payola, whereby a radio station or its employees, usually a disc jockey, accept payment for broadcasting records. Among those accused were DJs Alan Freed and Dick Clark. Clark was called the most influential person in the popular music industry because of his interests in music publishing and record companies. But he denied any wrongdoing and escaped the inquiry virtually unscathed. Alan Freed was not so fortunate. He had few friends in the music business because of his practice of playing records by black artists rather than white cover versions. When the investigation started, Freed was blackballed. And when he finally came to trial in 1962, he was a broken man. Freed pleaded guilty to two counts of commercial bribery, was fined $300 and received a suspended sentence. He never worked in radio again and died in January 1965. Congress eventually outlawed payola, and the offence was punishable by a maximum $10,000 fine. But the significance of payola was greatly diminished by this time because of the growth of Top-40 radio. Disc jockeys were governed by a rigid play list and were not allowed to choose their own music.
    1963- less than two months after defeating the Houston Oilers in the second championship game of the American Football League, the Dallas Texans, owned by Lamar Hunt, moved to Kansas City and were renamed the Chiefs.
    1964- during the congressional debate over the 1964 Civil Rights Act, Representative Martha Griffiths delivered a memorable speech advocating the prohibition of discrimination based on sex. Her efforts resulted in adding civil rights protection for women to the 1964 Act. She later successfully led the campaign for the Equal Rights Amendment in the House of Representatives.
    1964-Songs released today include the Temptations' "The Way You Do the Things You Do" on Motown, the Beach Boys' "Fun, Fun Fun" is out on Capitol and the album "Beatlemania in the USA!" by the Liverpools is released on Wyngate Records.
    1964- Billy Kidd and Jim Heuga became the first American men to Win Olympic medals in Alpine skiing when they captured the silver and bronze medals respectively, in the slalom at the IXth Winter Olympics at Innsbruck, Austria.

    1986- The musical "Evita" ended its eight-year run in London. The show earned 32-million dollars and was performed 2,913 times during its run at the Prince Edward Theatre.     1987 - A powerful storm produced blizzard conditions in the Great Lakes Region. Winds gusted to 86 mph at Janesville WI and Cleveland OH received 12 inches of snow. North winds of 50 to 70 mph raised the water level of southern Lake Michigan two feet, and produced waves 12 to 18 feet high, causing seven million dollars damage along the Chicago area shoreline. It was the most damage caused by shoreline flooding and erosion in the history of the city of Chicago
    1987- Nancy Lopez won the 35 th LPGA tournament of her career, the $200,000 Sarasota Classic, and earned induction into the LPGA Hall of Fame.
    1989 - A winter storm over California produced snow from the beaches of Malibu to the desert canyons around Palm Springs, and the snow created mammoth traffic jams in the Los Angeles Basin. Sixteen cities in the western U.S. reported record low temperatures for the date. Marysville CA reported an all-time record low reading of 21 degrees above zero.
    1990 - Unseasonably mild weather prevailed across the south central and eastern U.S. Twenty-two cities, including five in Michigan, reported record high temperatures for the date. The afternoon high of 53 degrees at Flint MI surpassed their previous record by ten degrees, and the high of 66 degrees at Burlington IA exceeded their old record by eight degrees.

Stopping by Woods on a Snowy Evening

Whose woods these are I think I know.
His house is in the village, though;
He will not see me stopping here
To watch his woods fill up with snow.

My little horse must think it queer
To stop without a farmhouse near
Between the woods and frozen lake
The darkest evening of the year.

He gives his harness bells a shake
To ask if there is some mistake.
The only other sound's the sweep
Of easy wind and downy flake.
The woods are lovely, dark, and deep,
But I have promises to keep,
And miles to go before I sleep,
