Correction: Not Bottom Line Leasing, Westminster, Ca
“In the (Weekly Bulletin Board Complaint) you used the name "Bottomline Leasing" as a fictitious name for an unethical leasing company. The name is essentially the same as the real name or our company "Bottom Line Leasing". Even though you made a statement in your article that this is a fictitious name, at least one reputable funding source has questioned us and believed we might be involved in this story.
“Kit, what is the best way to clarify this situation to the point where it is absolutely clear to all the readers that our company is not involved in this matter in any way?
“Thanks for publishing a fine newsletter.”

(In the last Weekly Bulletin Board Complaint about the leasing company sending “sale/leasebacks” to a vendor who put them through his “dealer” leasing source as “new equipment,” we mentioned several times that all the names were fictitious. We also noted in the article the leasing broker's company was posted in the Leasing News Complaint Bulletin Board from a previous complaint concerning money not returned.
The fictitious name we used was Bottomline Leasing. It is not Bob Mazenauers' company Bottom Line Leasing in Westminster, California. His company has never been listed, nor have we ever received a complaint, and have heard nothing but good things about him.
We apologize for any confusion that may occur from the similarities in names. Editor

Lease Broker arrested again
(Front page story of Newsday Newspaper, Long Island, yesterday, February 17, and on newsday.com.
(Postal Inspector Steve Bolz , 216-443-4028, has asked that anyone who has had dealings with Spanos – good or bad – contact him.
His web site still exists, and he was attracting brokers to send him business that he would take existing equipment for a lessee and get them cash on it.

This type of apparent scam is not new, but growing, as reported in leasing news of a broker presenting sale/leasebacks to a “vendor” who presents as “new equipment” to his equipment leasing source. editor )
Spano comeback
Con man who nearly bought the Islanders is out of prison -- but arrested in new fraud in Cleveland
Eight months after he got out of prison for fraudulently attempting to take over the New York Islanders, John Spano went back to his old ways, federal officials said yesterday.
Accused of defrauding a host of companies around the country, Spano was arrested and arraigned yesterday in federal court in Cleveland.
Spano, after serving more than 5 years in prison for the Islanders scheme, set up a firm called the Commercial Financial Group in the Cleveland suburb of Westlake, according to a court complaint filed by Steve Bolz, an inspector with the federal Postal Inspection Service in Cleveland. He used the company to scam more than a dozen companies, the complaint said.
Bolz's complaint said Spano rented a jet he claimed he owned to impress victims and began to swindle numerous firms around the country through various confidence schemes.
Spano, 41, promised to obtain loans for businesses, and then pocketed the fees they sent him without ever delivering the loans, the complaint said. In one complex variant of the scheme, Spano allegedly agreed to purchase mechanical equipment that a firm wanted and then lease it to them for a fee. Spano pocketed tens of thousands of dollars in fees but never delivered the equipment, Bolz said.
"He's the cleverest, sneakiest guy," said one of Spano's alleged victims, Sandra Beard, president of Badger Lighting and Signs in Waukesha, Wis., in a telephone interview yesterday. Spano is accused of swindling her out of $17,000 by collecting a "security deposit" on $100,000 in metal-bending machinery he agreed to purchase and lease to her firm.
When she complained, Beard said, Spano would regularly call her back with seemingly plausible excuses why the machinery had not been delivered and her money had not been returned. "I've got 147 voice mail messages from him," Beard said, adding that when she finally became suspicious and started doing research, she came across a John Spano who had been convicted in the Islanders case. Beard said she asked him whether he was that person, and he said no.
Spano's attorney, Jerome Emoff of Cleveland, said his client is not guilty and federal officials are criminalizing what is a civil dispute about payments among business people.
Magistrate William Baughman held Spano without bail on fraud charges yesterday, pending hearings next week.
Spano was on 5 years of supervised release after he was discharged from prison in June. Gary Brown, head of the U.S. attorney's office on Long Island, who was one of the prosecutors in the Islanders case, said yesterday his office will seek to have Spano charged with violating the conditions of his release. That could add an additional 2 years onto any fraud sentence.
Spano, who claimed to be a rich Dallas businessman, fraudulently inflated his net worth and contracted to buy the Islanders in 1997 for $165 million. He briefly controlled the team in what was considered one of the oddest happenings in sports history.
At his sentencing in 2000, Spano said, "I made a terrible mistake. My judgment has been incredibly poor. ... I don't know what came over me to do what I did. I'm sorry for the people I've hurt. ... I'm sorry for the people of Long Island who believed I was going to do something for the team."
Spano's attorney at the time, Nicholas Gravante Jr., added, "After he serves his sentence, he hopes to get on with his life." Unfortunately, prosecutors said yesterday, he did.
From Islanders scam until now
1997
Spano briefly takes control of Islanders, only to plead guilty that year to fraudulently inflating his wealth to buy the team, and siphoning money from it. He also pleads guilty to two other fraud counts involving other victims.
Sentenced in April 2000 to 5 years, 11 months in jail, he's ordered to pay $11.9 million in restitution, undergo counseling and serve a 5-year probation on his release.
Among the victims: the Islanders ($3.4 million); a Dallas pottery importer ($3.4 million); a Dallas loan lender ($1 million); former hockey player Mario Lemieux ($890,000).
1998
Sued by Cleveland bank for writing a $100,000 check that bounced.
1999
While awaiting sentencing in the Islanders' case, Spano's bail is revoked when he's charged and pleads guilty to writing bad checks and using invalid credit cards to pay $7,700 a month for apartment and penthouse in Philadelphia's ritzy Rittenhouse Square area.
2004
Spano's released from jail in June. While still on probation, he set up a firm that investigators now say he used to scam more than a dozen companies.
2005
Yesterday, federal officials arrested Spano and arraigned him on new fraud charges.

--“As a professional mediator and attorney who has worked with parties to successfully settle many thorny disputes in leasing and finance, I wholeheartedly endorse your editorial opinion on NorVergence; it\'s the right approach.
”Although I am sympathetic to the concern that these cases are being used to advance broader agendas (and certainly are being used for political purposes by certain AGs), I strongly share your view that the best course of action both for the lessees and the leasing companies involved is still to concentrate on the creative mutual resolution of these disputes before ending up in court.

“We won a motion to dismiss in Federal Court in Illinois today (Wednesday,February 16,2005) Judge Darrah refused to enforce the forum selection clause, stating as follows:
"The purported forum selection clause does not designate a specific
state to which the parties will litigate any issues one the lease is
assigned and confers upon the lessor the right to assign to any
creditor in any state. Defendants have no way of knowing, at the
time the lease was executed, what state in the union they would be
required to litigate. As such, Defendants cannot be found to have
consented to jurisdiction in Illinois. The cases cited by Plaintiff
all contain clauses which designate a specific forum at the time of
execution of the agreement."

(Our article mentioned the “ERA”contracts had several provisions
that will be difficult to enforce, especially the venue provision,
which other courts in other states have made similar rulings
as now made in Federal Court in Illinois. Companies located
in Illinois, such as IFC Credit, will now have to conduct venue
in the county where the lessee is located, unless mutually
agreed somewhere else. editor )

“From your story: ‘Dell reports that they sell direct, not to dealers'
”As an authorized reseller, you are given a password to enter the Dell system and configure quotes based on the discounted re-seller pricing. Our sister company is also an authorized re-seller, so we can help in the future if you need information.
”Of course, the exact pricing was not needed as the point of your story was abundantly clear.
”Which makes me want to say to these underwriters who only work direct – Are you kidding me?
”One final thing that I would like to add, but please don't use my name if you ever re-print as I don't want to worry anyone who was speaking in confidence to me. We have been approached on many occasions by sales reps from national underwriters who only work direct with vendors to set up a "dummy vendor" operation to submit deals. They have gone so far as to offer a complete diagram of how to set it up or, “if we chose not to do it on our own, the names of other such vendors who we could choose to send business to. So what you have is the crime being perpetrated by the "victim". It is my impression from the conversations I have had that these situations are not few and far between, but rather very widespread and established.
”Thank you for your work.”

Leasing News Advisory Board Members...Leasing Conferences
( Part II ) One of the first things I did when I began my leasing business in 1995 was join a leasing association.
My involvement in the UAEL started by attending conferences, evolved to committees, task forces and eventually the board of directors. Furthermore, the decision to register and begin preparing for the Certified Leasing Professional designation was also a result of attending conferences where I met colleagues who explained the value of understanding all aspects of the industry, not only the ones I dealt with day to day, and they were right.
Attending the conferences is an affordable way to make contacts, get new ideas, brush up on the old ones, find new funding sources and brokers, trainers and mentors. It is a great way to stay exposed to current IT developments, specific to leasing, as well as tax, legal and legislative issues. If you can carve out the time, attending a conference is a worthwhile investment. Not to mention, they are often in warm sunny place, and when you live where I do, it's a fun break to end the day with a dip in the pool!

I personally attended many ELA conferences since I got into the business in 1987 and have found the principal benefit was less the agends and more the fact that a bunch of people from far flung places would be at the same locale. I learned to set up dates with folks that I wanted to see before arriving and the chance to spend 30 minutes in lieu of traveling across country just to see someone separately was invaluable.
I know that the actual forums sometimes included spirited debate on issues or revelations about trends and news. My own busy schedule and short attention span sometimes meant that I was on the phone when a juicy meeting was occurring. Still, the bringing together of industry experts and enthusiasts was and still is often a catalyst for change or talk about it.
When attendees exceed around 200, the impersonality of an event kicks in, which to me meant the smaller attended conferences compared to ELA conferences, may have had a greater opportunity for meeting some people that you saw again over 2-3 days and built mini-friendships with.
I preach that the interested conference should be as excited about the small events as the large.

For us at McCue Systems, attending equipment leasing conferences is key to our ability to stay connected, remain informed, and present our finance management solutions to prospective customers.
Notice that “stay connected” came first, because there is no better venue for renewing old acquaintances and forming new relationships. In the relaxed atmosphere of a conference, we can learn about new directions and emerging needs in our target market without the formalities of a presentation or the challenges posed by gatekeepers. While emails, phone calls, and product demos are all useful, the conference atmosphere allows for unstructured conversation that combines friendly chitchat with pointed business-related inquiry.
Of course, another significant benefit of our participation is the opportunity to attend the workshops and presentations that make up the official “program” of the event. These sessions can be useful for more than the specific content presented; much can also be learned by seeing who attends what, what questions get asked, and what topics are the biggest draws.
Typically, McCue Systems participates in these events as an exhibitor. We present a carefully crafted environment that projects the technical acumen of our company – in interactive on-screen presentations, focused product literature, and the presence of well-informed and approachable representatives of the company.
After 3 decades in the industry, McCue Systems is a mainstay of the technology provider corner of the major equipment leasing organizations and their conferences. For us to be otherwise would be an unlikely strategic choice!

You asked me why people should attend conferences, as I am the chair for UAEL's Spring Conference. Everyone has their own reason or agenda, and they are usually one or a combination of the following:
1) As a professional within the industry they want to keep up-to-
date on the industry and its' direction or trends.
2) One wants to learn or enhance their skills and knowledge, or as
a reminder of what they learned in the past, but had forgotten.
3) Reinforcing your relationships that you have developed, as
emails, faxes and phone calls are not the same as face-to-face.
4) The opportunity to meet/develop new relationships
5) The chance to interact with your competitors/peers (which I
personally gain the most from).
6) You like to play golf, or get away from the daily grind
7) A perk
Whatever ever your reasons for attending, it boils down to networking and walking away with a little more knowledgeable, while having an enjoyable time.

Wealthy Young Americans Eschew Traditional Labels,
Embrace Middle-Class Values
U.S. Bankers Weekly News
A new Visa study reveals that today's young, affluent consumers reject traditional views of wealth, aligning their perceptions and values more with their parents' middle-class approach to living. They trade prestige and luxury for value, pragmatism and the adventure of doing more with what they have. Visa is targeting this “New Affluent” segment — individuals ages 35 to 54 whose household income is at least $125,000 — with its new Signature card. It comprises seven percent of the U.S. population, representing 15 percent of total U.S. spending. The survey shows these consumers clip coupons more than other Americans, report embarrassment in being identified with wealth and status, and are more concerned about passing along honesty and integrity to their children than money or status.
“As the New Affluent bring their largely middle-class values and identity to bear in the way they believe, live and shop, the rules for marketing to upper-income consumers are being rewritten,” says Michael J. Weiss, demographic expert and author of The Clustered World: How We Live, What We Buy and What It All Means to Who We Are. “Their tastes are a lot more mid-scale than their wallets.” Weiss notes that as high-achievement individuals, New Affluent consumers tend to have worked extremely hard for their wealth and overall success. With the knowledge of how hard it is to “make it,” he says, they are ultra-vigilant about spending wisely. Nine out of 10 new affluent consumers surveyed identify themselves as “middle class” or “upper middle class,” while only 7 percent—most with incomes in excess of $500,000 — describe themselves as “affluent.” Nearly three-quarters (72 percent) of new affluent consumers surveyed say they are embarrassed by or dislike being identified by terms such as “wealthy” or “well off,” while acknowledging these terms accurately describe their situation. Almost three-quarters (72 percent) of new affluent consumers surveyed clip coupons, significantly higher than the national average of 65 percent. More than a third (34 percent) of upscale consumers surveyed have hunted for bargains at garage sales in the past year, and about the same number say they shopped for deals at going-out-of-business sales. Two-thirds of new affluent consumers surveyed say they regularly shop at club-discount or warehouse stores. This compares to less than half of the general population sample doing the same.

This Day in American History
1571- A group of Spanish Jesuits in the Chesapeake Bay area, led by Fray Batista Segura, were murdered by the Indians they had come six months earlier to convert. The massacre led ultimately to the withdrawal of all Jesuits living in Florida as well. On September 8, 1565, the first white colony in what is now the US was founded At. St. Augstine, FLA, by the Spanish under Pedro Menendez de Aviles. The first Catholic parish was founded by Fr. Don Martin Francisco Lopez de Mendozo Grajales, chaplain of the Spanish expeditionary forces. The first introduction of European livestock such as black cattle, horses, sheep and swine, into America was made by the Spanish in Florida. The Spanish began to settle the area, including fighting all those who had laid claim to the land. On September 20 th , Mendendez destroyed Fort Caroline, and massacred most of its inhabitants. He renamed it San Mateo and in the next two years built a strong of Forts to Tampa Bay while looking for a water passage across Florida. The once “peaceful” Indians were either converted to Christianity or tortured and killed by the Spanish on their quest in the New World.
1668-Protest against slavery of importance was made by the German Friends, or Quakers, at a meeting in Germantown, PA. They protested against the “traffic in the bodies of men” and considered the question of the “lawfulness and unlawfulness of buying an keeping Negroes.” Some of the protesters were Francis Daniel Pastorius, Dirck opden Graeff, Abrahama op de Graeff, and Gerhard Hendricks. 1678- John Bunyan's "Pilgrim's Progress" was first published, in England. Bunyan was frequently imprisoned for preaching without a license. During these sequestered times, between 1660-72, Bunyan collected the ideas enabling him to pen this masterpiece of Christian literature. It was the most popular book in the new colonies.

Winter Poem Cool Tombs
by Carl Sandburg
When Abraham Lincoln was shoveled into the tombs, he forgot
the copperheads and the assassin . . . in the dust, in the cool
tombs.
And Ulysses Grant lost all thought of con men and Wall Street,
cash and collateral turned ashes . . . in the dust, in the cool
tombs.
Pocahontas' body, lovely as a poplar, sweet as a red haw in
Novem-
ber or a pawpaw in May, did she wonder? Does she
remember?
. . . in the dust, in the cool tombs? Take any streetful of people buying clothes and groceries,
cheering
a hero or throwing confetti and blowing tin horns . . . tell me
if the lovers are losers . . . tell me if any get more than the
lovers . . . in the dust . . . in the cool tombs.
