News did print the e-mail from Rick
without names in the “Weekly Complaint Bulletin Board Report,” and subsequently
received this: “Thank you for publishing
my recent email. I have since
received several calls and emails
regarding the same individual I wrote about.
It appears that this guy has
taken at least two other leasing companies for many tens of thousands of dollars
and at least two computers. Furthermore
I'm told he is a ‘’credit
criminal’ and has a federal warrant in effect due to some alleged leasing fraud.
I don't know exactly what that means but I'm sure it isn't good. I was also told that Leasing News did an article
on this guy two years ago. I’m aware of your
concern at potential litigation but I think exposing a person like this
is certainly in the best interest of the entire leasing community. Since I am now aware of several respected individuals
that know this guy and at least
two that have hired this him in the past I encourage you to explore some
way to safely expose him and therefore protect your readers. “If you decide to
proceed with this matter I will be delighted to share everything that I

in the same geographic area from the alert posted.

Employee Cries Out Loud We
need your help! The employees of
ORIX Financial Services, Inc. (Kennesaw, GA) are in turmoil! We read and follow
the leasing news and have for some time. I'm unsure who your contact(s) are,
but the info so far has been right on the money! Many of the events
that have transpired in the company for the past year were news to the employees.
Well, all that "didn't" follow the Leasing News. The employees are
not being told "ANYTHING." So many are jumping ship out of
the pure "fear"
of the unknown. We've heard everything
from "Today's the day" (the day the majority of us get our walking papers);
Feb. 28th's the day; It will happen in March; etc......... We all read the Leasing
News "Every Day." Looking for some small tidbit of conforming info to
support the rumors flooding the office. This is a fact: TownPark,
the landlord of our office building, has been quoted as telling
the other tenants in the same building that "ORIX has notified
TownPark that they
will be downsizing and leaving one of the three floors currently leased
by them by the end of January 2004, and will be totally out of the building by March,
2004. ORIX stated that their company had been sold to another company located
in Texas." The other tenants
in the building, we believe, were unaware that ORIX had an office in Dallas,
Texas. Therefore, we are almost certain that this info is fact. Our company has stated "Employees shouldn't
listen to office gossip." Well, true. Gossip
is not beneficial. But, ORIX has left it's employees nothing more to cling too.
They are not disputing any rumors nor confirming them. The employees are
sick. Sick, everyday. Nerves are shot. Tempers short. Yet, work must go on.
It's difficult to maintain a productive state of mind when your future is so
unstable, unsure. We have all lost
our respect for the management of this corporation. It's more like working
in the center ring while the monkey's and Lion's put on a show in the two rings
beside you. The circus is closing, that we know. We feel it. We believe that it's not just unfair that the
employees are the last to know, we feel that
it's "inhuman" the way things are being handled. We have had NO POSITIVE INFO given to us. ORIX notified it's employees in Kennesaw via a Human
Resources meeting last month that there are going to be changes. No specific
changes to the future of our company was given. But, the following was: 1.Pension Plan Frozen
with an undetermined termination date scheduled for the future. 2. Non vested employees
wouldn't have an opportunity to become vested if employment was terminated
prior to the termination date of the Pension Plan. (ORIX will save a
lot of money). 3. Upon the date
of termination, any employees remaining would become fully vested (if there's
any of us left). 4. Job opportunities
would be emailed to all employees when newly posted. (all notifications
have only been for positions in the Dallas office). 5. Severance packages
were severely cut. What was 4 weeks plus 1-2 weeks
additional pay for
every year worked has been reduced to 1 week per every year worked. A 3 year employee
let go last January received 7-8 weeks pay. Now, that same employee is going
to receive 3 weeks severance. All
points to a "HUGE" layoff. Our "gray” past
Company policy has been revamped to follow the federal laws to a tee. They are leaving
no room for a possible lawsuit. Reduced severance......No
Pension........Vacating floors......I suppose were gone! I think the truth
is probably much worse than what the employees are expecting. If the Leasing News
receives "any" info that may be informative to the little
guys (we employees),
please post it ASAP. At this
point, the Leasing News has been right on
target, we look forward to your future articles. I suppose we are
all hanging on for a miracle. But, a confirmation from someone in the know,
good or bad, would be just as helpful to us all. I'd appreciate your

SBA Announces Restart of Suspended 7(a) Loan
Program There was an opportunity
for the leasing industry, and perhaps it still exists, in the over $750,000
category, when the U.S. Small Business Administration suspended its loan
guarantee program last week due to lack of funding. The restart, described
by a person familiar with the matter as a short-term they did not know
how long the program would be open, as they only received an additional $470
million in lending authority, so
they put a loan cap of $750,000 per recipient, the SBA said. Those in the SBA
lending industry said the amount was not adequate to even get by ten days,
depending on several factors. Last year, the SBA 7a loan program allowed 70,000 small businesses
nationwide to borrow up to $2 million from banks, which in turn received
a federal guarantee on the loans. It appears the current
administration is reacting to recent economic events by restricting former
tax benefits and lending benefits, such as this popular program where the
government basically guarantees a great portion of the loan, leaving the
“original” lender managing the cash flow account and/or using other collateral
to protect their “investment.” The SBA has been
functioning on a string of temporary budgets since October because Congress
has yet to pass an appropriations bill that would fund the loan program
through the end of this year. The bill calls for $9.5 billion in lending
authority for the SBA. Last year, the federal agency gave out $8.8 billion
in 7a loans. Many small businesses
rely on the loans because of the federal guarantee, which lowers their

Fleming, president of the Equipment Leasing Association (ELA) declared
the assertions made by members of Congress and the Treasury Department
“strange” and “inaccurate” about lease transactions used by tax-exempt

On the call, Fleming
shared how tax-exempt entities currently use lease financing and its
benefits, the tax exposure in the transactions, various scenarios in
which tax-exempt entities may find themselves without lease financing
available to them, and the consequences of continued incorrect characterization
of lease financing. “The mischaracterization
of leasing transactions— widely used by tax exempt entities with major
financial institutions — has been extreme,” said Michael Fleming. “Labeling
these transactions as ‘tax avoidance’ is just plain wrong. In fact,
these transactions and the parties involved do have tax exposure.” Tax exempt entity
lease transactions are based upon well-recognized legal principles,
followed closely for decades, he noted. By oversimplifying and unfairly
maligning these transactions, with little serious consideration for
the consequences of their being disallowed in the future, the future
of public-private partnership is in danger, warned Fleming. Lease transactions
provide much needed capital to entities as diverse as hospitals, charities,
educational institutions, municipal services, such as sewer systems,
mass transportation and other projects, and other organizations. The proposed changes
to existing U.S. law under Section 476 of the Senate Finance Committee’s
JOBS bill (S.B. 1637) — recently proposed by Senator Grassley to take
effect, retroactively, as of November 18, 2003 — would impose broad
and far reaching limitations on deductions allowable to property leased
to or used in connection with the provision of services to state and
local governments and other tax exempt entities. The elimination of
the critical financial support these leasing transactions provide has
not been replaced in either Sen. Grassley’s or the President’s budget
with a plan for alternative financial support. “Has anyone talked
to these organizations to see how they are going to finance their projects?
That side of the story that isn’t being told,” said Fleming. The Equipment Leasing
Association is encouraging the very groups that stand to lose essential
financial support that these leasing transactions provide, to object
to the bill and budget proposals. “Declarations in
Congress have brought many pending agreements to a standstill without
consideration of alternative sources of financing for hospitals, cities,
schools and fire departments. They are the ones that are really going
to be the losers in this,” said Fleming. About the Equipment

The Virginia Legislature adopted the Ordinance of Religious Freedom,
which guaranteed that no man would be forced to attend or support any
church. This mandate later became the model for the First Amendment
to the U.S. Constitution 1843-
Sara Rosetta Wakeman birthday, aka Lyons/Edwin Wakeman died while with
the 153rd NYSV, Co. G&H, as a regular soldier in the Civil War.
Her letters, a photo in uniform identifying her, and some personal belongings
were found in a trunk in the family attic almost 100 years after her
death. Her war record was found
under the name of Lyons Wakeman. Her last letter was from Brandycore
Landing, Louisiana, "Made advance up the river about 40 miles to
Pleasant Hill - had a fight. Retreated 10 miles, next day the fight
resumed at 8." While on guard duty at Cairo Prison in 1863
she had written of a female Union prisoner who had gone into battle
as a Major leading her men. The ring she wore, which was inscribed "Rosetta
Wakeman, NY Vol. Co. H, 153rd," was sent home after her death in
the Marine U.S. Army General Hospital in New Orleans. She had been hospitalized
for chronic diarrhea, a major killer of soldiers during the Civil War.
She is buried in
grave #4066, Section 52, of what is now the Chalmette National Cemetery,
Chalmette, LA. 1847-
Fremont appointed Governor of California. A leader
in the successful fight to wrest California away from Mexico, the explorer and mapmaker John C. Fremont briefly becomes
governor of the newly won American territory. Still only in his
early mid-30s at the time, Fremont had already won national acclaim
for his leadership of two important explorations of the West with the
military's Corps of Topographical Engineers. Shortly after the government
published Fremont's meticulously accurate maps of the Far West, they
became indispensable guides for the growing numbers of overland emigrants
heading for California and Oregon. In 1845, though, the lines between
military exploration and military conquest began to blur when President
James Polk sent Captain Fremont and his men on a third "scientific"
mission to explore the Rockies and Sierra Nevada-with 60 armed men accompanying
them. Polk's ambition to take California from Mexico was no secret,
and Fremont's expedition was clearly designed to place a military force
near the region in case of war. When Mexico and the
U.S. declared war in May 1846, Fremont and his men were in Oregon. Upon
hearing the news, Fremont immediately headed south, calling his return
"the first step in the conquest of California." When the Anglo-American
population of California learned of Fremont's arrival, many of them
began to rebel against their Mexican leaders. In June, a small band
of American settlers seized Sonoma and raised a flag with a bear facing
a five-pointed star-with this act, the revolutionaries declared the
independent Republic of California. The Bear Flag Republic
was short-lived. In August, Fremont and General Robert Stockton occupied
Los Angeles. By January 1847, they had put down the small number of
Californians determined to maintain a nation independent of the United
States. With California now clearly in the U.S. hands, Stockton agreed
to appoint Fremont as the territorial governor. However, a dispute broke
out within the army over the legitimacy of Fremont's appointment, and
the young captain's detractors accused him of mutiny, disobedience,
and conduct prejudicial to military discipline. Recalled to Washington
for a court martial, Fremont was found guilty of all three charges,
and his appointment to take the position of governor was revoked. Though
President Polk pardoned him and ordered him back to active duty in the
army, Fremont was deeply embittered, and he resigned from the military
and returned to California a private citizen. Although he never regained
the governorship of California, the turmoil of Fremont's early political
career did not harm his future prospects. In 1851, citizens of California
elected him a senator, and became the territorial governor of Arizona
in 1878. Today, however, Fremont's youthful accomplishments as an explorer
and mapmaker are more celebrated than his subsequent political career. 1861-The
Crittenden Compromise, the last chance to keep North and South together,
dies in the U.S. Senate. Proposed by Senator John J. Crittenden of Kentucky,
the compromise was a series of constitutional amendments. The amendments
would continue the old Missouri Compromise provisions of 1820, which
divided the west along the latitude of 36º 30". North of this line,
slavery was prohibited. The Missouri Compromise was negated by the Compromise
of 1850, which allowed a vote by territorial residents (popular sovereignty)
to decide the issue of slavery. Other amendments protected slavery in
the District of Columbia, forbade federal interference with the interstate
slave trade, and compensated owners whose slaves escaped to the free
states. Essentially, the Crittenden Compromise sought to alleviate all
concerns of the southern states. Four states had already left the Union
when it was proposed, but Crittenden hoped the compromise would lure
them back. Crittenden thought he could muster support from both South
and North and avert either a split of the nation or a civil war. The
major problem with the plan was that it called for a complete compromise
by the Republicans with virtually no concession on the part of the South.
The Republican Party formed in 1854 solely for the purpose of opposing
the expansion of slavery into the western territories, particularly
the areas north of the Missouri Compromise line. Just six years later,
the party elected a president, Abraham Lincoln, over the complete opposition
of the slave states. Crittenden was asking the Republicans to abandon
their most key issues. The vote was 25 against the compromise and 23
in favor of it. All 25 votes against it were cast by Republicans, and
six senators from states that were in the process of seceding abstained.
One Republican editorial insisted that the party "cannot be made
to surrender the fruits of its recent victory." There would be
no compromise; with the secession of states continuing, the country
marched inexorably towards civil war. 1866-
Everett Barney of Springfield, MA, obtained a patent covering his invention
of a screw-clamp skate. He marketed the first all-metal roller skate
and the country took storm over this new sport. 1871-Jefferson

Elmer Valentine, Los Angeles, California opened the Whiskey a-Go-Go,
the first discotheque, where the music is
provided by a disk jockey playing recordings not by a live band. Valentine borrowed the discotheque concept
from a club in Paris, which was also called the Whiskey a-Go-Go. For a time, "disco"
and "go-go" were synonymous: Go-go clubs featured scantily
clad women dancing in cages to tunes pumped from a jukebox. Discos emerged in
larger cities, with disc jockeys pulling music from albums, particularly
those recorded by black musicians like Sly and the Family Stone, James
Brown, KC and the Sunshine Band, and Donna Summer. The clubs were especially
popular among the gay male and urban black subcultures. Cheaper than
live-music clubs, discos also became popular with lower-income young
people. The underground disco subculture turned into a national sensation
when the film Saturday Night Fever was released in 1977. John
Travolta starred as Tony Manero, a young man from Brooklyn who dreamed
of becoming a professional dancer and danced away his cares at Disco
2001. The movie's soundtrack, featuring the chart-topping songs "Stayin'
Alive" and "Disco Inferno," sold 20 million copies and
urged its spandex- and lamé-clad fans onto the dance floor. Older music,
even Beethoven's, gained a fresh popularity when remixed into disco
tunes. Even mainstream pop artists, including the Rolling Stones, tried
their hand at disco. But the fad didn't last long; in 1979, disco died
almost overnight. Disco albums were returned to producers by the truckload
as New Wave took over in popularity. But disco's basic structure set

War. The strike was designed to destroy Iraqi air defenses, command,
control and communication centers. As Desert Shield became Desert Storm,
the world was able to see and hear for the first time an initial engagement
of war as CNN broadcasters, stationed at Baghdad, broadcasted the attack
live. A little know historic fact, the launched was predicted by pizza orders. At 5am that
morning, the Domino’s Pizza fast-food chain put out a warning to its
franchises that war was likely later that day, based on the record order
of pizza the previous night from the Pentagon. The Pentagon is the headquarters
o the Department of Defense in Washington, DC, and as reported yesterday,

- Comedian/actor Bill Cosby's only son was shot to death, the victim

convertible along a freeway, police said. The body of Ennis William

the car of a woman passer-by. The murder occurred in a well-to-do area
near the Santa Monica Mountains not far from the exclusive Bel-Air section
of Los Angeles. The Columbia University graduate student was the son
of one of the world's richest entertainers, a man for whom fatherhood
was the source of much of his humor 1997-Microsoft
launched Office 97. It became a best-selling suite of word processing,
spreadsheet, database, graphics, and other applications, rapidly become
the leading office software suite, holding more than eighty percent
