Why You Should Not Ignore Disclosure Laws

They say that ignorance is bliss. Maybe that is true when it comes to how laws or sausages are made, but it is patently false when it comes to state commercial finance disclosure laws. Here are the top reasons why this is so.

Some possible penalties for violating the disclosure laws are:

1. California: Revocation or suspension of CFL license; fine of up to $10,000 or imprisonment for up to one year or both (for willful violation).
2. New York: Fine of up to $2000 per violation or $, injunctive relief.
3. Utah: Civil penalties of $500 per violation of up to $20,000; $1000/$50,000 for violations after written notice of prior violation.
4. Florida: Civil penalties of $500 per violation of up to $20,000; $1000/$50,000 for violations after written notice of prior violation.
5. Kansas: Civil penalties of $500 per violation of up to $20,000; $1,000/$50,000 for violations after written notice of prior violation.
6. Connecticut: Civil penalties up to $100,000; restitution; injunctive relie
7. Virginia: Injunctive relief, restitution, damages.
8. Georgia: Civil penalties of $500 per violation of up to $20,000; $1,000/$50,000 for violations after written notice of prior violation.

Several other states, including Texas, Louisiana, Mississippi, Missouri, Pennsylvania, North Carolina, New Jersey, and Maryland, have introduced disclosure legislation. Each state has its own laws and regulations.

It is extremely difficult to keep up with the growing trend of mandating disclosure laws. Accordingly, it is of paramount importance that anyone considering undertaking a commercial finance transaction in any state consults a professional to ascertain whether commercial financing laws apply to the transaction.

Finance still is the industry that offered the most hybrid-friendly job postings in 2023. This is according to data by the WFH Map project and the connected study Remote Work across Jobs, Companies, and Space from the National Bureau of Economic Research, which shows that out of all the job postings in the U.S. from the Finance & Insurance industry, 25 percent offered the possibility for remote or hybrid work, down 1.3 percentage points compared to 2022. Coming in second and third are the Professional & Scientific sector, which includes lawyers, architects, engineers and advertisers, and the Utilities sector, with 23 and 21.6 percent, respectively.

Academy for Certified Lease & Finance Professionals
Six Scheduled to Date

According to CLFP staff, the next announcement of members will not be until mid-August. It is noted
there are several who have studied, but have not taken the test yet.

The Academy for Lease and Finance Professionals (ALFP) is a three-day event designed to fully prepare an individual to sit for the CLFP exam assuming the attendee has already self-studied. A trend has begun in having virtual online sessions.

During the first two days, all of the required sections of the CLFP exam are covered in-depth. On the third day, the exam is offered but is not mandatory and may be taken on another day.

Students are strongly advised to have read and studied The Certified Lease & Finance Professionals' Handbook prior to attending the class in order to ensure success

WASHINGTON, D.C. – Registration is now open for the Equipment Leasing and Finance Association’s 63rd ELFA Annual Convention, scheduled Oct. 27-79, at the JW Marriott Downtown in Austin, Texas. The Convention is the largest annual gathering of professionals from across the $1 trillion equipment finance industry. The early-bird registration deadline is Aug.  19.

ELFA President and CEO Leigh Lytle,  said, “The upcoming ELFA Annual Convention is all about taking your business, your career and our entire industry to the next level, in keeping with our theme ‘Next Level Success,

“We've got some exciting new experiences lined up—all designed to help you learn, connect, do business and have a bit of fun along the way."

The agenda will cover a range of critical industry issues. Highlights include:

• Dynamic keynotes from geopolitical strategist Peter Zeihan, business leader and former CEO of United Airlines Oscar Munoz and political analyst Amy Walter.

ELFA Launches Equity Fund for Professional Education
Educational Opportunities for Underrepresented Leaders

WASHINGTON, D.C. – The Equipment Leasing and Finance Association launched the ELFA Equity Fund for Professional Education aimed at enhancing educational opportunities for underrepresented leaders within the equipment finance sector. In 2024, the Fund will award six grants, each covering the registration fee for attendance at the ELFA Annual Convention, scheduled Oct. 27-29 in Austin, Texas. The deadline to apply for a grant is Aug. 5.

Eligibility Criteria:
Applicants must meet the following criteria to be considered for a grant:

• Current ELFA member employed full-time in the equipment finance industry.
• First-time Annual Convention attendee.
• Identify as a member of an underrepresented or marginalized group within the equipment finance sector, including but not limited to race, ethnicity, gender identity, sexual orientation, neurodiversity, socioeconomic status, ability or other aspects of diversity.
• Must have attended one of ELFA’s “people power” events in 2024 (Emergence2024, Equity Forum or Women’s Leadership Forum).
• Demonstrate a passion for the mission and goals of the fund, emphasizing commitment to diversity, access, empowerment, leadership and education.
• Must submit a completed application, letter of recommendation and statement outlining how their participation at ELFA’s Annual Convention will contribute to their professional development and advancement within the industry.
