City Bank, Sacramento( state capital of California,) is suing a New
York company that sold it $1.3 million in medical equipment leases,
some of which turned out to be bogus. The
company that supposedly owned the equipment is at the center of what
investigators call an elaborate ruse that scammed banks across the country
out of perhaps $200 million. Federal
agents last year raided the New York offices of RW Professional Leasing
Corp., which they accuse of using a string of mailboxes, fake documents
and fraudulent financial histories to further a scheme to defraud banks
on brokered leases. River
City Bank bought some of that company's leases two years ago through
an intermediary, Crawford & Sons Ltd., and it is suing Crawford
and other unnamed defendants for fraud, negligence and breach of duty.
It accuses Crawford of making representations about the quality and
safety of the investments that were either outright false or had never
been verified. In
its complaint, filed in Sacramento Superior Court late last month, River
City Bank asked for reimbursement and punitive damages from Crawford
& Sons, a Fayetteville, N.Y.-based company that brokers secondary-market
financial transactions. When companies that lease medical equipment,
finance auto or mortgage loans, or provide other financial services
need to unload some of their notes to free up cash, Crawford finds investors
such as River City Bank to buy the paper. No
one from Crawford & Sons was available for comment. The bank's attorney,
Stephen Johanson, also declined to discuss the suit. (Note: Crawford has a suit along
with several other community banks against RW Professional and also
has named Bank of New York, as reported in Leasing News in earlier editions.

of New York Co., which according to River City's lawsuit was supposed
to have set up an escrow account for payments on the leases but never
did so, is also under investigation in connection with the alleged fraud.
The New York bank said in regulatory filings this month that it and
some of its employees are being investigated, and that two civil lawsuits
have been filed against the bank seeking a total of $46 million. Guarantees
and forgeries: According to River City Bank's complaint, filed April
23, Crawford solicited River City Bank in March 2001 to fund RW's medical
equipment leases. Crawford allegedly said all its leases were with licensed
medical professionals who put a personal guarantee on any lease. Crawford
further characterized the leases as very strong credits, rated at either
A or B, which is considered investment grade, the suit said. Crawford
also allegedly told River City that the medical equipment had been delivered
to the medical offices. Crawford's
client was Island Park, N.Y.-based RW Professional Leasing. RW Professional
did make some leases, but it also had a number of fraudulent schemes
going, according to a federal indictment in the New York Eastern District
Federal Court. In
June 2002, 40 federal agents raided the headquarters of RW Professional.
Prosecutors were investigating a nationwide bank fraud with total losses
estimated at $200 million. The indictment states RW Professional created
a number of elaborate schemes -- and used perhaps 100 rented mailboxes
coast to coast -- to send phony checks, fake leases and bogus invoices
to banks in various states. Based
on those documents and verifications, banks and brokers were persuaded
to lend RW Professional millions of dollars, investigators said. The
four principals of RW Professional Leasing were arrested last June.

City Bank funded five leases made by RW Professional totaling nearly
$1.3 million; the largest was for $412,638 and the smallest for $187,318.
Old
reliable ... usually: Equipment leases are generally seen as a good
buy for a bank because the equipment itself often helps generate income
for a medical office, so the doctor has incentive to keep the equipment
and stay current on payments. But
even the best underwriting flies out the window when there's fraud involved.
If the leasing company is cooking the books and creating leases and
customers, all of its leases can look good on paper. The
schemes used by RW Professional included multiple loans from different
banks for a single piece of medical equipment, loans for equipment that
was never purchased or leased, and even loans to doctors who don't exist,
River City and investigators allege. The
indictment includes some forfeiture allegations where the government
sought to impound assets of RW Professional. The investigation continues,
as does the search for other assets of RW Professional, said sources
with the FBI and the U.S. attorney's office. River
City's executives didn't comment on the suit against Crawford or the
circumstances of the fraud. The
bank did write off nearly $1 million at the end of last year, according
to the bank's filings with the Federal Deposit Insurance Corp., but
the reason for the write-off wasn't stated. That amount could represent
most of the money lost in the scam. River
City could get recovery from Crawford, from Crawford's insurance company
or even from the money recovered by the government. Neither RW Professional
nor Bank of New York was listed as a defendant in the lawsuit, but the
complaint includes "John Doe" defendants, a move which allows
changes if new evidence identifies other responsible parties. (Crawford
& Sons along with many community banks are also suing RW Professional,
as is American Express Business Finance, and it is reported there are

the Bush Tax Bills Means for Equipment Leasing GROWTH INCENTIVES Bonus Depreciation - The 30% bonus depreciation increases to 50% for property: a) Acquired by the
taxpayer after May 5, 2003 and before January 1, 2005, as long as there
was not a written binding contract in effect before May 6, 2003, b) The original use
is with the taxpayer, c) The property is
placed in service by the taxpayer before January 1, 2005, (property
found in §168(k)(2(B) has a January 1, 2006 date), and d) The taxpayer makes
an election to use this 50% instead of the 30%. The 30% bonus depreciation still exists
for those taxpayers that prefer to use it instead of the 50%. Taxpayers
may elect on a class-by-class basis to claim 30% instead of 50% bonus
first-year depreciation for qualifying property, or elect not to claim
bonus first-year depreciation at all. Automobiles have a first year depreciation/§179
limitation of $7,650 plus the normal limitation if the taxpayer elects
the 50% bonus depreciation. (This limitation remains at $4,600 plus
the normal limitation if the taxpayer uses the 30% bonus depreciation
and at the normal limitation if the taxpayer elects out of the bonus
depreciation entirely.) The 30% bonus depreciation rules are changed
by replacing the September 11, 2004 deadline with January 1, 2005. This provision is effective for tax years
ending after May 5, 2003. Increased §179 Expense Limits - The expensing limit is increased to $100,000 for tax years beginning
after 2002 and before 2006. The maximum purchases before the phase-out
increases to $400,000 for these same years. These amounts are indexed
for inflation in $1,000 increments. Off-the-shelf computer software is now
eligible for the §179 expensing election starting with tax years beginning
after December 31, 2002. The §179 election can now be irrevocably
revoked for any tax year beginning after 2002 and before 2006. In other
words an election to use §179 can be revoked to not use it, but the
taxpayer can not elect back in after making the election and revoking
it. Once you are using §179, you can undo it but can't redo it. There is no sunset provision for this
portion. REDUCTION IN TAXES ON DIVIDENDS AND CAPITAL GAINS Under current law, an individual's adjusted
net capital gain generally is taxed at a maximum rate of 20% (10% if
it would otherwise be taxed at 10% or 15%) for regular tax and AMT purposes. Adjusted net capital gain is net capital gain (net long-term capital
gains exceeding net short-term capital losses) less 28% rate gain (affecting
collectibles and certain small business stock) and less 25% rate gain
(generally, gain representing depreciation claimed on MACRS realty). Gain from property held more than five years that would otherwise
be taxed at 10% is taxed at 8%, and gain from property held more than
five years and the holding period for which begins after 2000, which
would otherwise be taxed at 20%, is taxed at 18%. Dividends received by an individual currently
are taxed as ordinary income at rates up to 38.6% (for 2003). Under
the new law . . . Individual Capital Gains Tax Rate Decreases
- The 10% rate decreases to 5% (0% in tax
years beginning after 2007). The 20% rate decreases to 15%. The tax
computation for years that include May 6, 2003 will be similar to the
1997 computation. Gains prior to May 6, 2003 will normally
be taxed at the then existing rates and only new gains will be taxed
at the new lower rates. The Alternative Minimum Tax adjustment
for the §1202 exclusion decreases from 42% to 7%, effective with dispositions
after May 5, 2003. These rules are effective for taxable
years ending after May 5, 2003. Dividends Tax Rate Decreased - Dividends will be combined with the taxpayer's net capital gain
and will be taxed at the rates described above for capital gains. Qualified
dividends include those received during the current year from domestic
corporations and certain qualified foreign corporations. There are special provisions and exceptions.
Dividends that are
not eligible include: a) Dividends paid
from a corporation that was exemption under §§501 or 521 for the payment
year or the preceding year, b) Dividends described
in §404(k), c) Dividends allowed
as a deduction under §591 (dividends paid by mutual savings banks),
and d) §246(C) with some
modifications. There are other restrictions that apply
to REITs and RICs. Dividends will not be considered investment income
for investment interest expense deductions unless the taxpayer elects
to treat them as such (similar to the old capital gains provision). Sunset Provision: These provisions sunset for tax years beginning after December 31,
2008. The accounting, and in fact, the entire business community
is waiting for the final print out from the tax bill. We hope to give you

a great time we had earlier this month at the United Association of Equipment
Leasing Spring Educational Conference (SEC) in the beautiful California
desert at the Marriott Rancho Las Palmas Resort!
The weather was wonderful, the venue was first class, and the
food was fabulous. Most
important, however, was the spirit of those who were in attendance. Our
theme for the Conference was "Survival" - and there was evidence
all around
us of exactly that. The participants
were upbeat, ready to learn, ready
to share their experiences and their expertise, and ready to take on whatever
challenges these next few months and years in our industry will bring. Our members are now better equipped because

This Day in American History 1736-Birthday
of Patrick Henry, American revolutionary leader and orator, born at
Studley, VA, and died near Brookneal, VA, June 6, 1799. Especially remembered
for his speech (Mar 23, 1775) for arming the Virginia militia, at St.
Johns Church, Richmond, VA, when he declared: “I know not what course
others may take, but as for me, give me liberty or give me death.”
It is not known if Patrick
Henry ever spoke these words. His
biographer William Wirt made
up so
many facts, the phrase is it “it is fact or is it Wirt” became a popular
saying among
American historians. There is
nothing recorded in Virginia or by contemporaries
who were there who make mention of this statement by Patrick Henry. That also does not disapprove it, either, some
historians note, as even his painting done sixteen years after he died
by an artist who based the picture on a painting of Captain James Cook,
whom Henry was said to resemble. Only later, when a genuine real-life
miniature of Henry suddenly surfaced, was it discovered that Henry looked
nothing like Cook, although that is the painting reproduced in
