“I am the CFO for Poly-Pacific Technologies Inc., a small plastic manufacturer located in Ontario CA. We were looking for equipment financing and paid a $4,000.00 refundable deposit to Avalon Southwest, located at 3502 McFarlin Blvd, #10, Dallas Texas 75205-1830, Tel: 214-559-9807, for the purpose of securing financing. The Managing Director is Ken Hartley.


“Since we sent the check on June 18, 2003, little was done

and no financing has been secured for us. Many request to return our refund had been ignored. We are quite sure this company is set up to deceive companies desperate for financing and we want companies out there to be aware of this

dishonest company. I also welcome whatever help or advice you can offer.”


Leasing News telephoned, sent faxes, and e-mails to Mr. Ken Hartley at Avalon SouthWest beginning on October 9th when the complaint was made by Mr. Cheung. We did this three days in a row, then every other day for a week,

and then off and on. The other parties also tried to reach him.


On November 12th, Leasing News received this e-mail:


“Sorry about the late reply but have been on vacation. Anyway the subject $400,000 transaction was conditionally approved under two scenarios.

1) A partial letter of credit to offset the move from Canada to US. This was to be reviewed upon first full year in US and the claimed profitability. The level was to be determined on updated statements. This offer was never responded to.

2) An approval based on a asset based line for term debt was offered. Again a response was not forthcoming.


“I do not know if Al turned down the offer or his representative, Dennis advised him. We did not have direct access most of the time due to vacations and his representatives. We would be more than happy to redo the approvals or refund a portion of the deposit less expenses and time.


“Please let me know your thoughts.”

(The broker involved was Dennis Grant of Premier Leasing Services

9650 Business Center Dr., #126 Rancho Cucamonga, California 91730.

He had been trying to obtain the advance rental back, and had originally

wanted the money held in an escrow account, and that was his advice

to Mr. Cheung.


(After speaking with Mr. Cheung, he confirmed that Dennis Grant was

trying to help him get the money back and said they both had been trying to obtain his deposit back for almost five months, that he had a small company,

and this money meant a lot to him. He also had tried many more times

to reach Mr. Hartley.


Seven business days later, Mr. Hartley responded:


“I maintain that two commitments was forwarded as agreed. The additional collateral was due to the poor performance based on the move. Additionally they wanted financing for 40% costs that included moving and reinstallation.

We will probably agree on a small refund but will not agree with the assessment that a total refund is due. As you will note, their options to take the financing are still open”

Leasing News has not seen a second agreement, and asked him to provide it.

Again, all three of us asked for the money back. Mr. Cheung said this

has been going on for six months and in several new e-mails, asked

him to return the money and did not want Mr. Hartley to consider trying to place his lease. He sent an e-mail every day with a copy to us.


As of December 1, there has been no response from Mr. Hartley. Maybe he is on vacation again?

"Leasing Company Name With Held"



Due to the nature of the controversy of this complaint, it is being printed

without names. Several of the Leasing News Advisory Board members do not

want it printed with names as “Mr. Leasing Company Name With Held” is their friend, several believe it should be printed with names as it is a “legitimate complaint,” some don’t want to get involved “at all, and others say it is the “editor’s job” to make these decisions.


“Mr. Leasing Company Name With Held” believes “Leasing News” is trying to “smear” him and appears to have started such a campaign against us in his circles.


As editor, it appears to be a question of “ethics; despite the popularity

of the person, it is a legitimate complaint for the Leasing News Bulletin Board.


Please read it and let me know your opinion by e-mail (I will not use

any that makes this a “popularity” contest, as the issue is “ethics,” not

whether “Mr. Leasing Company Name With Held” is a nice guy.

The Applicant signed two separate lease contract with “ Leasing Company Name With Held” on April 23,2003, including acceptance of equipment, along with a check for “first months rent” and “security deposit” for $5,949.72 with two separate checks, one for $3,683.16 and the other, $,2266.56.


 **** (The Adobe Acrobat copy of both leases would normally be here, but

it has the parties names on it, plus the signature of the applicant, including

the delivery and acceptance form.)


 Mr. Applicant states he sent his application and financial statements in early April for $94,500 in CD replication equipment less the $40,000 he had given the vendor as a “down” with the remainder to be “financed.” It also was submitted as “corporate only” (no personal guarantee) as he had put $40,000 down, $20,000 on each machine, as understood by both parties.


According to Mr. Applicant, the lease was approved, he was told, so he

signed the two leasing contracts and sent in the two checks. He waited

until funding and then was finally told by “ Mr. Name With Held” that he had made “misleading statements” and therefore “ Leasing Company Name With Held” would not proceed with funding nor return the “first months rent” and “security deposit” on either of the two leases.


There was no bilateral agreement on terms and conditions for “Leasing Company Name With Held” to retain the monies if the lease did not fund, according to both parties. In addition, Mr. Applicant specifically points out the leases were not “funded” and the vendor was not paid: the lease did not commence. He also

said he never received a call for a verbal acceptance nor was any insurance certificate issued . Mr. Applicant states he has not received a signed copy of the two lease contracts to date from “Leasing Company Name With Held “, and his main point: the two leases never commenced, and therefore the terms

do not apply ( in addition, there is no provision regarding the disposition

of the money if the lease does not commence.) “Mr. Applicant” categorically

denies that he made any intentional misrepresentations and was “up-front”

on all aspects of the application.


The probable funder involved (as it appears to be their contract via the insurance provision where liability names the funder with his address) would make no comment as to whether the leases were approved, documents and money received or returned, or whether there was any provision for the lessor to keep any funds, whether the leases were funded or were not funded.


There is a law in the State of New York concerning “security deposits” and

advance rentals, requiring that they be held in escrow and returned if

the transaction does not move ahead. Here is one reference to it:

State of New York Security Deposit Law Section 7-101 Money deposited or advanced for use of personal property. Leasing News is not giving any

legal advice or interpretation, but bringing the fact of the law existing

in New York State. There were several opinions regarding this law

and it does appear a common practice to “co-mingle” security deposits

into a general account by many leasing entities, although the disbursement requires both parties and the law requires a separate account.


“ Mr. Name With Held” claims to have many hours into the transaction, and due to this fact, and the alleged misleading statements, he states he is entitled to

keep the money.


Mr. Applicant is willing to negotiate a settlement due to the actual time “ Mr. Name With Held” spent on the transaction. He is also willing to accept terms of repayment, if it is a “cash flow” situation. Neither offer was acceptable by” Leasing Company Name With Held.”


In the meantime, Mr. Applicant has spoken with “customer service” of the probable funder, and says that he will file a complaint with the leasing

associations that are advertised of “Leasing Company Name With Held”

website.


“ Mr. Name With Held” submitted a statement, but due to derogatory and libelous comments, in this editor’s opinion, the remarks were removed (as per our written policy .*) “ Mr. Name With Held” then asked us not to print anything that he has sent.


“Please do not publish anything over my signature if you are going to edit it

in any fashion.”

18 Month High: NACM Credit Manager's Index for November 2003

 

COLUMBIA, MD--The National Association of Credit Management (NACM) has released its Credit Manager's Index (CMI) for November 2003. The CMI, a monthly survey of the business economy from the standpoint of credit and collections, was launched in January 2003 to provide financial analysts with another strong economic indicator.



The combined NACM Credit Manager's Index of 58.0 is at an 18-month high. Although the rate of growth in the manufacturing sector slowed this month, growth in the service sector increased. Overall, both sectors show considerable strength and have for several months. Based on the results of managing and extending unsecured trade credit, there aren't any indications of the economy stalling in the near future.

The CMI survey asks credit managers to rate favorable and unfavorable factors in their monthly business cycle. Favorable factors include sales, new credit applications, dollar collections and amount of credit extended. Unfavorable factors include rejections of credit applications, accounts placed for collections, dollar amounts of receivables beyond terms and filings for bankruptcies.

The entity is expected to be combined with the CitiFinancial branch network expanding CitiFinancial assets by $4.0 billion. At September 30, 2003, Washington Mutual Finance Corp had short-term debt in the form of commercial paper of $1 billion and senior unsecured debt of approximately $2.3 billion. This debt will be guaranteed by Citicorp Holdings Inc. and thus debt ratings will be equalized with Citicorp and Citigroup ratings upon consummation of the transaction. The corporate entity ratings will then be withdrawn. Ratings are listed at the conclusion of this press release.


The acquisition is consistent with Citigroup's strategy of expanding its consumer franchise within the US and is expected to be immediately accretive to earnings upon closure in the first quarter of 2004. Ratings for Citigroup Inc. and Citicorp Holdings Inc. are affirmed given 1) geographic and business line diversity, 2) disciplined risk management 3) a commitment to maintaining capital at targeted levels and 4) its strong financial performance.


Operational synergies include some branch consolidation (about 30% of branch closures), funding cost benefits and enhancements to centralized processing systems. Processing enhancements will result from a combination of both WAMU Finance and CitiFinancial practices. Citigroup expects future revenue growth from the acquisition by targeting an attractive group within nonprime markets and stronger pricing. Integration risk is low given the expertise previously demonstrated by Citigroup. Both credit quality and consolidated capital ratios are expected to remain within current ranges.

This Day in American History


        1662-An act “prohibiting the entertainment of Indians without badges” was passed by the Assembly at James City, VA. Colonial badges were issued to “friendly Native Americans, authorized in Virginia by the Act of 1661, which authorized “silver and plated plaques to be worn by the Indians when visiting the settlements.” One of these has a crude representation of a tobacco plant and scrolls, above which is “The King OF” on the obverse, while on the reverse is a similarly engraved plant and the word “Patomeck” with the “e” over lined. The surface edges were engraved to represent scrolls and foldings, while the medal was holed for suspension. It was also common in many Southern states to require slaves of all races and colors to wear “badges” or “medal tags” to donate their owner, plus giving the authority to be off the “premises.” There were also

“slave hire badges,” worn by slaves hired out by their owners.

        1763-Members of the Jewish community of Newport, Rhode Island witnessed the dedication of the Touro Synagogue, the first synagogue in what became the United States. Sephardic Jews in Jamaica, Surinam, London and Amsterdam sponsored the building of this first major center of Jewish culture in America. Designed in the Georgian style by English architect Peter Harrison, the synagogue was named for Isaac Touro, its first officiating rabbi.

There were Jewish religious meetings in New York and Atlanta, Georgia,

however this is considered the first building. It is considered an architectural masterpiece, and by the way, Touro Synagogue is the sole surviving synagogue built in colonial America.

         1777- Linda Barrington Darrah is known as “The Spay Who Saved George Washington.” History records she hid this evening in the linen closet

and listened to the British leaders discussing a surprise attack against Washington's army. The next day she walked several miles through the snow to the American army's location at Whitemarsh to alert Washington so that when the British launched its attack, Washington and his men were ready. This was considered one of the major turning points in the war as the American army, instead of forcing the British troops back to Philadelphia, would have faced almost total destruction.

        1831- Birthday of Francis N. Peloubet, American Congregational clergyman. A promoter of the Sunday School, he penned 44 annual volumes of "Select Notes on the International Sunday School Lessons" between 1875 and his death in 1920. They were known afterward as "Peloubet's Notes."

        1840-William Henry Harrison was elected president, John Tyler of Virginia was elected vice-resident in a Whig landslide, defeating incumbent President Martin

Van Buren, Democrat. In 1837 the panic began. Hundreds of banks and businesses failed. Thousands lost their lands. For about five years the United States was wracked by the worst depression thus far in its history.

Programs applied decades later to alleviate economic crisis eluded both Van Buren and his opponents. Van Buren's remedy--continuing Jackson's deflationary policies--only deepened and prolonged the depression.

Declaring that the panic was due to recklessness in business and over expansion of credit, Van Buren devoted himself to maintaining the solvency of the national Government. He opposed not only the creation of a new Bank of the United States but also the placing of Government funds in state banks. He fought for the establishment of an independent treasury system to handle Government transactions. As for Federal aid to internal improvements, he cut off expenditures so completely that the Government even sold the tools it had used on public works. The electoral vote was Harrison 234, Martin Van Buren, 60. The popular vote was Harrison, 1,275,017; Van Buren, 1,128,702; James G. Birney, Liberty Party, candidate, 7059. Unfortunately William Henry Harrison, 68, caught cold at his inauguration on March 4, and died of pneumonia on April 4,1841. For the first time a vice president succeed to the presidency. Tyler who,

although he had run on the Whig ticket, was not a Whig at heart. He had previously supported the Democrat, President Andrew Jackson in 1828 and 1832, and had major political disagreements with the northern, conservative wing of the Whig Party. His administration was characterized by bickering and frustration, as Henry Clay and Daniel Webster tried to control Tyler and shape the White Party to their own interests.

        1859-John Brown, Abolitionist leader who is remembered for his raid on US arsenal at Harper’s Ferry was hanged for treason at Charles Town, WV. On October 16 he and 21 followers had seized the federal arsenal at Harpers Ferry (now in West Virginia) to establish an abolitionist republic in the Appalachians and to fight slavery with fugitive slaves and abolitionist whites. Groups had been raiding “free states ”in retaliation for hiding slaves or helping them to escape to Haiti or Canada permanently. He had moved to Kansas to help organize resistance to these Southern raids. It is interesting to note the men who appeared upon the scenes of these opening hostilities at Harpers Ferry, as they became famous or celebrated characters in the great drama of the civil war. Among those who became Confederate generals were: S. Cooper, R. E. Lee, J. E. B. Stuart, John B. Floyd and Henry A. Wise; and among colonels, C. J. Faulkner and A. R. Boteler. In the committee of the United States Senate, appointed by resolution of December 14, 1859, to inquire into the facts attending this invasion, were Hons. Jefferson Davis and J. M. Mason, and this committee had before it as witnesses, Hons. W. H. Seward, J. R. Giddings, Henry Wilson and Andrew Hunter. John A. Andrews, of Massachusetts, secured funds to pay Brown's counsel. In the South, John Brown was thought of as a murdered and traitor who deserved the gallows, but in the North his gibbet was described as “the cross of a martyr.” In Concord, Mass., Henry David Thoreau wrote of Brown, “ When a government puts forth its strength...to kill the liberators of the slave, what a merely brute...force it is seen to be.” Longfellow wound a prophetic note: “This will be a great day in our history, the date of a new revolution...As I write, they are now leading old John Brown to execution...This is sowing the wind to reap the whirlwind, which will soon come.”

          1864-Confederate General Archibald Gracie, Jr., is killed in the trenches at Petersburg, Virginia, when an artillery shell explodes near him. Gracie was born in New York in 1832. He was educated in Germany before he attended West Point, from which he graduated in 1854. Although his family lived in the North, his father owned a business in Mobile, Alabama, and Gracie moved there upon his resignation from the army in 1856. Gracie soon became an ardent supporter of the southern cause, and he was active in the Alabama state militia. In early 1861, before Alabama seceded from the Union, Gracie was ordered by the governor to seize the federal arsenal at Mount Vernon. Gracie's command protected Richmond in the summer of 1864, and his leadership at Drewry's Bluff was instrumental in holding Union General Benjamin Butler's force at bay near the Confederate capital. Gracie fought during the siege of Petersburg for the rest of the year, and he was recommended for promotion to major general. Unfortunately, he was killed before the rank was confirmed. Most of Gracie's family remained in the North, and his relatives arranged for transfer of his body to Union lines. He was buried in New York City.

        1867- English writer Charles Dickens gives his first public reading in the United States, in a New York City theater. Dickens was a hit with the American public, who anxiously awaited each installment of his serialized novels. The line for his first reading in New York was more than a mile long.

        1873- The Reformed Episcopal Church was organized in New York City when 8 clergymen and 20 laymen broke from the Protestant Episcopal Church over a debate regarding proper church ritual.

As an engineer at Columbia Broadcasting Systems Laboratory, he devised a color television system and later the LP (long playing) record album, which transformed the recording industry.          1977- Joan S. Wallace is sworn in as assistant secretary of the U.S. Department of Agriculture. She is the first black woman to hold the post. The first woman appointed was Dorothy H. Jacobsen in 1964.

        1982-Barney C. Clark, 61, became the first recipient of a permanent artificial heart. The operation was performed at the University of Utah Medical Center at Salt Lake City. Near death at the time of the operations, Clark survived almost 112 days after the implantation. He died March 33,1983.

         1984 - Dan Marino connected for four touchdown passes and set an NFL record .for TD passes in a season (40). Miami’s Dolphins lost the game, however, to the Los Angeles Rams, 45-34. It marked the Dolphins’ first home loss of the season following six wins.

        1985 - The highest-rated "Monday Night Football" telecast was seen this night on ABC-TV. The game drew an audience share of 46.0 and a rating of 29.6. The Miami Dolphins beat the Chicago Bears, 38-25. The Miami win snapped the Bears’ 12-game winning streak. The Miami Dolphins scored on their first five possessions. The Bears thus finished the regular season with a 15-1 record, and the Dolphins preserved their unique status as the only NFL to go undefeated in an entire season, a feat they accomplished in 1972.

         1985-Organized crime bosses Paul Castellano and Thomas Bilotti are gunned down as they exit Sparks Steak House in New York City, making John Gotti, the organizer of the hit, head of the notorious Gambino crime family-the most powerful Mafia operation in New York. 1968, Gotti was convicted of hijacking a truck and was sentenced to three years in prison. But his real Mafia ascension began when he killed one of the Gambino family's enemies in May 1973. Despite concerted efforts by New York law enforcement to crush the Gambino family operation, Gotti continued to climb up the ladder. Wearing flashy, expensive suits, Gotti became something of a local hero in his Howard Beach neighborhood for his connection to organized crime. His unparalleled success at escaping conviction at trial earned him the nickname "Teflon Don." He was even acquitted of racketeering charges in 1986, despite the fact that the prosecution presented thousands of taped conversations in which Gotti was acknowledged as the head of the crime family. Gotti's streak of luck with the law ended in 1992, when he was convicted of murder and racketeering and sentenced to life in prison without the possibility of parole.  He died June 10,2002 while serving a life sentence without the possibility of parole.  Since being incarcerated in December of 1990, he spent twenty-three hours a day alone in a small cell and was not allowed any contact with the rest of the prison population.  When doctors diagnosed Gotti with throat cancer in September of 1998, he was brought to the United States Medical Center for Federal Prisoners in Springfield, Missouri.  Following surgery and thirty-six radiation treatments, he was transferred back to solitary lockup in Marion, Illinois.
