NorVergence Class Action Suit On Wednesday, September
1, 2004, an Order to Show Cause Seeking an Injunction to stop the leasing
companies from enforcing the leases was filed in the class action. In
addition, an amended complaint against 26 leasing companies was filed. “The Court has scheduled
the hearing date for the Order to Show Cause With Temporary Restraints
for Friday, October 1, 2004 at 2:30PM.”
(Leasing News reported that the judge will give “results” and that is not correct,
we are informed.) The web site www.njnorvergenceclassaction.com will be posting
a list of a network of attorneys in key states that is accepting the
defense of individual cases already filed by the leasing companies against
putative class members, while the class action continues to litigate.

Editor’s
Comment: “Get Leasing Companies” There appears to
be a wild fire in this movement to join a class action suit
“to get” leasing companies. It is interesting
to note on the many list serve internet communication systems, leasing
companies are being blamed as the “bad guys” for wanting to collect
lease payments, were in “cahoots” with NorVergence, knew all along about
the value of the “equipment” and telephone service
agreement, and many are not only seeking relief from lease
payments, but also seeking “damages.” So far, none of the
telephone companies, who provided the services, and must have understood
the situation, have not been named in any of the legal
actions filed, nor have they been castigated for their role in the
financing transactions. One of the key communications
resolves around Robert J. Fine, former head of the
NorVergence finance corporation, and former president of the
Eastern Association of Equipment Lessors.
His involvement leads
the customers to believe GE Capital, CIT, Wells Fargo, and
almost fifty other leasing companies were in “conspiracy” with
NorVergence. Those joining class
action suits believe leasing companies “hoodwinked” them
into signing equipment leases where the actual value
of the equipment was worth very little and both the seller
and lessor (creditor) were deceptive in what they represented to the
lessee (debtor) in the contract they signed. While it has been
determined some of the amounts are too small to fight individually
in court, a business decision due to the costs involved,
this alleged “deception” by the 50 leasing companies
does fit a class action suit. They also believe they are “consumers,”

Fires Attorneys, Trial Postponed until March, 2005 Leasing News has
been unable to confirm with lead attorneys Stephen L. Cohen or U.S.
Attorney Geoffrey Richard Kaiser this information, and evidently Pacer
does not have this information, but it appears the trial has been
postponed for a third time, going on three years from the original
complaints filed by the US Attorney’s office on June 27,2002. This is from a very
reliable source who is named in the transaction: “The RW Professional
case has been moved to March, 2005 at the earliest.
Barry ran out of money and his attorneys were granted permission
to resign. They were replaced by court appointed attorneys who promptly
said they needed additional time to review the materials. Judge agreed
and case moved to March. If
it goes to trial in March, it will have been almost three years since
he was arrested. Final verdict projection:
Guilty and sentenced to time served.
More good stuff to follow since one defendant in the case is
really stirring up the water trying to get off the hook without waiting
for Barry's trail. For example--I did not know that Barry and associates
had three companies (RW Professional, Professional Leasing Services
and Professional Finance). When Barry "hit the wall" with
cash flow, he wrote letters to the banks he defrauded and asked for
cash advances to help him overcome his short period of cash flow difficulties. Talk about big balls. Have a nice day. Loyalty
to Barry by some of his staunch supporters in the industry is slipping
away as they find Barry told them deals did not fund, but they did and
Barry kept all the commissions.” There are several
civil cases pending, such as the $20 million dollar from American Express
and Crawford and Sons and others, put “on hold” by court order
until a judgment is made in the criminal case. Through the many
depositions and motions it does appear Barry Drayer has sold his
original house, then bought another house, plus used his brother’s house
as collateral for bail. Both
Drayer’s have been under “house
arrest,” not serving time in jail awaiting this criminal trial. They do travel, at the specific approval of
the court. It was reported several
defendants have been willing to discuss turning state’s evidence,
while others believe the stalling tactic is to postpone the

Gen. Winfield Scott entered Mexico City. A Battalion of U.S. Marines
made its presence felt at the “halls of Montezeuma.” The United States was later able to claim a large Mexican
territory, including what was to become the state of California in 1850 ( following
the gold rush fever of 1849 ). 1814
- An attorney in Washington, DC, Frances Scott Key, was aboard a warship
that was bombarding Fort McHenry, the outpost guarding the city of Baltimore,
Maryland. Key wrote what would become famous words to express his emotions.
Those words would become "The Star-Spangled Banner", which
officially became the national anthem of the United States by an act
of Congress in 1931. 1847
- Mexico City was occupied by US troops after the defeated forces of
General Santa Anna were forced to abandon the city. The day before,
young Mexican cadets had tried unsuccessfully to defend the fortified
hill of Chapultepec. With the occupation of Mexico City, the United
States-Mexico conflict virtually came to an end. While some call the
1846-48 period the "Mexican War," others call it the "US
Invasion". 1861-
The first Civil War Naval Battle took place at Pensacola, FL.
Lieutenant John Henry Russell descended upon the Confederate
navy yard at Pensacola at 2 a.m. He had sailed the frigate Colorado past shore
batteries in the dark, and with a force of 100 sailors and Marines,
went for the southern privateer five gun Judah in the shipyard. After
hand-to-hand fighting, the contingent burned the vessel to the waterline
and left. They burned the five-gun steamer Judah, lying at anchor, and
spike the only gun in the yard. There
were no Confederate casualties. three of the
Union troops were killed and four wounded
President Lincoln thanked Russell personally and the Navy Department
honored him. 1882-
Birthday of Winnifred Sprague Mason Huck, U.S. Congressional Representative
from Illinois, serving out the term of her late father 1922-23. She
broke the rules about freshmen being still and introduced a number of
bills including the call for independence for the Philippine Islands.
She was an investigative reporter who even went to jail for four months
under an assumed name to bring to light the abuses in prison as well
as the difficulties in "going straight" afterwards. 1868

George K. Anderson of Memphis, TN, received a patent on typewriter ribbon. 1889-
Hull House in Chicago opened its doors. Formed by Jane Addams and Ellen
Starr, it was the first major settlement house in the United States.
In its first year of operation, it hosted more than 50,000 people. In
all, there would be more than 600 residents at various times ranging
from some of the most influential social reformers of the day to a future
prime minister of Canada - and just about everyone in between. Hull
House under Addams, in addition to social work and reform, served as
the "mother house" for the meeting and networking of reformers

of Margaret Fogarty Rudkin,
American businesswoman. who started making a healthy bread for one
of her sons in 1937 and parlayed those few loaves of bread it into a
major commercial company, Pepperidge Farms. The company had sales of
$32 million a year when she and husband sold out to Campbell Soup. She
stayed as president - supervising the day to day operations personally
as she had from the beginning - until a year before her death in 1967
of breast cancer, a disease from which she had since 1956.
